<p>A mediator plays a key role in divorce proceedings. When both parties in a <a href="https://afarleylaw.com/family-law/divorce/">divorce</a> can meet individually with a mediator who acts as a neutral third party to help with a peaceful resolution, both parties typically make better and more reasonable decisions.</p>
<p><strong>Mediators tend to have the following characteristics in divorce proceedings:</strong></p>
<ul class="wp-block-list">
<li>Their interests revolve around only reaching a mutually agreeable resolution to issues that come up in a divorce.</li>
<li>They have no authority to render judgments in a divorce.</li>
<li>Mediators may not be subpoenaed and cannot willingly testify on behalf of or against either party.</li>
<li>Any information regarding either party’s position on issues will be kept in confidence.</li>
</ul>
<h2 class="wp-block-heading">Court-Ordered Mediation</h2>
<p>Some family courts may require both parties to try and resolve their differences through a mediator before a final hearing. There is no requirement to reach a solution here, however, only that you attend as mandated. Either party can choose to end the mediation at any point as well as the mediator. This is simply an attempt on the part of the court to reach a resolution without having to go through the court process.</p>
<h3 class="wp-block-heading">Do I still need an attorney?</h3>
<p>The mediator can be the voice of reason in divorce proceedings, but it is still highly recommended that you have a divorce attorney present during <a href="https://afarleylaw.com/family-law/divorce/mediation/">mediation</a>. Only an attorney can provide you with legal advice. If one party in the mediation is more aggressive, sophisticated, and better informed, the mediator will not seek to redress this imbalance. <p>If an officer pulls you over and suspects that you have been drinking and driving, he will ask you to perform any number of field sobriety tests. These are meant to help the officer confirm that you are intoxicated.</p>
<p>Before you take any of these tests, it is important that you understand they are not mandatory. You can ask to opt out of them if you would prefer; however, this may only serve to confirm an officer’s suspicion that you were guilty of <a href="https://afarleylaw.com/dui/">DUI</a>. Still, you are not required to take a field sobriety test. Here is a brief overview of what you will face in a <a href="https://afarleylaw.com/dui/field-sobriety-tests/">field sobriety test</a>.</p>
<h3 class="wp-block-heading">What type of tests should I expect?</h3>
<p>If you agree to a field assessment, you can expect one of three main tests. The first is the horizontal gaze nystagmus, in which an officer will pass an object in front of your face and study your ability to track the object with your eyes. If your eyes jerk or tremble, the officer may conclude that you have been physiologically impaired by intoxicants.</p>
<p>Because this test is not conclusive, the officer will likely ask you to perform the walk and turn test and/or the stand on one leg test. If you perform the walk and turn test, you will have to walk in a straight line, heel-to-toe, for twelve steps. If you are asked to perform the stand on one leg test, you will have to hold one leg in the air for thirty seconds. In both cases, the officer will determine whether or not to arrest you based on your <em>apparent</em> DUI status. Other tests may include reciting the alphabet, counting, or standing straight.</p>
<p>Because field tests are based on observation, they are not always accurate. In fact, they can be made more difficult by individual circumstances, including the grade and texture of the ground you have to perform each test on. Fortunately, these tests are required to be recorded by an officer and may be used to support your case if the proper procedure wasn’t followed. <p>Many people assume that a breath test is a decisive measure of intoxication. Fortunately, the chemical means of determining a BAC are far from foolproof. If you were charged with <a href="https://afarleylaw.com/dui/">DUI</a> under the premise of a breath test at or above 0.08%, you can still fight your charges.</p>
<p>There are a number of ways you can combat a failed breath test. For example, the results of a breath test are based on an average ratio of alcohol particles in a person’s blood to alcohol particles in their breath. Because this is an average, it is often inaccurate on a case-by-case basis. Your lawyer may take your weight, height, and metabolism into account when defending against an unfavorable breath analysis.</p>
<p>Because the breath test takes place a few hours after driving, a person charged with DUI may have been under the legal limit at the time of arrest. They may have even been under 0.08% at the time of testing, but were charged with DUI because of the margin of error in testing. Your attorney may use these arguments to demonstrate your innocence in a drinking and driving case. Other avenues of defense include proving that the officer did not have a reasonable cause to pull you over, or demonstrating that some alcohol remained in your mouth, spiking the test results.</p>

<p>This may mean determining who will receive cars and who will have possession of a home. At present, North Carolina state government is considering a bill which would but a two-year hold on all divorces in an attempt to discourage couples from getting a divorce. According to the bill, the two-year waiting period would apply to any divorces that are not at-fault, and during this time couples would be asked to take courses and classes as well as attend some couples counseling sessions. According to the Charlotte Observer, the new law would be named the Healthy Marriage Act and would mandate a two-year-wait before married couples can split.</p>
<p>All throughout those two years the couples must complete a list of counseling courses and workshops which are supposed to improve a couples communication skills and help them with conflict resolution. The state believes that this act has the power to keep some marriages from disintegrating. The lawmakers think that couples may consider the decision of divorce for a longer amount of time when the process is so tedious and requires so much time. For those who do choose to go through with divorce, the classes may help them to determine that they were overreacting and to reconcile with one another.</p>
<p>At present, divorcing North Carolinians are required to wait one year in order to get their divorce, but not all couples are required to take classes as a part of the marriage act. Also within the Healthy Marriage Act is a revision of law which currently maintains that if a husband and wife are intimate with one another during separation it does not count as terminating their separation. The Healthy Marriage Act would instead demand that when a husband and wife are intimate despite their apparent separation, it would restart the entire two-year waiting period.
