  14. &lt;p&gt;From 7 June 2024, dealers must disclose whether a second hand vehicle they sell has been listed as a repairable write-off on the written-off vehicle register.&lt;/p&gt;
  15. &lt;p&gt;A &lt;a href=&quot;/publications/changes-motor-vehicle-dealers-sales-regulations-motor-vehicle-industry-bulletin-20-0&quot;&gt;previous bulletin&lt;/a&gt; provides further information about the changes to the Motor Vehicle Dealers (Sales) Regulations 1974. The prescribed forms and vehicle sale contract are changing.  Dealers should make sure they are familiar with the new requirements, including new prescribed forms.&lt;/p&gt;

  17. The updated forms are now available to &lt;a href=&quot;/publications/prescribed-sales-forms-motor-vehicle-dealers&quot;&gt;download &lt;/a&gt;on Consumer Protection’s website. All dealers must use the new forms from 7 June 2024.  The forms are:&lt;/p&gt;
  18. &lt;p&gt;&lt;strong&gt;Form 4 – Vehicle particulars&lt;/strong&gt;&lt;/p&gt;
  19. &lt;p&gt;&lt;u&gt;What has changed:&lt;/u&gt;&lt;br /&gt;
  20. Form 4 is the form that must be used with any second hand vehicle, including a motor cycle, that is displayed for sale.  Dealers who sell vehicles and motor cycles must complete all the details on Form 4.  New details include:&lt;/p&gt;
  21. &lt;ul&gt;&lt;li&gt;A Yes/No box indicating whether the statutory warranty under the Motor Vehicle Dealers Act applies to the vehicle.&lt;/li&gt;
  22. &lt;li&gt;A Yes/No box indicating whether the vehicle has been recorded as a repairable write-off on any written-off vehicle register.&lt;/li&gt;
  23. &lt;/ul&gt;&lt;p&gt;Minor changes have also been made to the wording on Form 4.  Form 4 no longer contains details about the statutory warranty. This information must be given to a purchaser as a separate form (outlined below).&lt;/p&gt;
  24. &lt;p&gt;&lt;strong&gt;Form 5 – Notice of defects excluded from warranty&lt;/strong&gt;&lt;/p&gt;
  25. &lt;p&gt;&lt;u&gt;What has changed:&lt;/u&gt;&lt;br /&gt;
  26. Minor amendments to Form 5 have been made to:&lt;/p&gt;
  27. &lt;ul&gt;&lt;li&gt;Delete the reference to a chassis number.&lt;/li&gt;
  28. &lt;li&gt;Refer to mileage as “kms/miles”.&lt;/li&gt;
  29. &lt;li&gt;Update the web address for the Department.&lt;/li&gt;
  30. &lt;/ul&gt;&lt;p&gt;&lt;strong&gt;Form 5A – Information statement – statutory warranty (for vehicles, other than motor cycles), and Form 5A – Information statement – statutory warranty (for motor cycles)&lt;/strong&gt;&lt;/p&gt;
  31. &lt;p&gt;&lt;u&gt;What has changed:&lt;/u&gt;&lt;br /&gt;
  32. Form 5A is a new form. It contains information about the statutory warranty that applies to a vehicle, including a motor cycle.  Two versions of Form 5A are available to download:&lt;/p&gt;
  33. &lt;ol&gt;&lt;li&gt;Form 5A for vehicles, other than motor cycles, has information about ‘The Used Car Warranty’.&lt;/li&gt;
  34. &lt;li&gt;Form 5A for motor cycles has information about ‘The Used Bike Warranty’.&lt;/li&gt;
  35. &lt;/ol&gt;&lt;p&gt;The statutory warranty information was previously part of Form 4. If a statutory warranty applies to a vehicle, including a motor cycle, Form 5A must be given to the purchaser.&lt;/p&gt;
  36. &lt;p&gt;&lt;strong&gt;Form 6 – Information statement – no statutory warranty&lt;/strong&gt;&lt;/p&gt;
  37. &lt;p&gt;&lt;u&gt;What has changed:&lt;/u&gt;&lt;br /&gt;
  38. Form 6 has been amended and is now an information statement that must be given to a purchaser if a vehicle, including a motor cycle, is not covered by the statutory warranty. Minor changes have also been made to the wording on Form 6.&lt;/p&gt;
  39. &lt;p&gt;&lt;strong&gt;Summary of changes – vehicle sale contract&lt;/strong&gt;&lt;br /&gt;
  40. The vehicle sale contract has changed.  Clause 8 of the vehicle sale contract has been amended to protect consumers and provide clarity for dealers by inserting a new clause which states that any amount sought by the dealer when the contract has been cancelled and the purchaser has breached the contract must be a genuine estimate of the dealer’s loss.&lt;/p&gt;
  41. &lt;p&gt;Pre-estimated damages are still limited to a maximum of 5%. From 7 June 2024 all vehicle sale contracts must include the amended clause 8.&lt;/p&gt;

With her special day just around corner, Consumer Protection has some advice for you if you’re thinking about giving Mum a gift card or voucher to her favourite store or local business.&lt;/p&gt;

  55. &lt;p&gt;A minimum three-year expiry period applies to most gift cards and the expiry date must be clearly displayed. This means you can easily see and challenge the date if they get it wrong. It also ensures the recipient of your gift won’t be caught out not knowing when it will expire.&lt;/p&gt;
  56. &lt;p&gt; &lt;/p&gt;
  57. &lt;p&gt;There are some exemptions to this such as free promotional or bonus gift cards, like a $50 wine voucher valid for one month that is mailed to a consumer as a free bonus with a purchased item.&lt;/p&gt;
  58. &lt;p&gt; &lt;/p&gt;
  59. &lt;p&gt;Businesses cannot charge post-purchase fees or administration charges that reduce the value of the gift card. These could be activation, account-keeping, and balance enquiry fees.&lt;/p&gt;
  60. &lt;p&gt; &lt;/p&gt;
  61. &lt;p&gt;Other terms and conditions that come with gift cards can vary for every business, so it’s best to check if there’s any spending limits, how the business will give change if the full amount isn’t spent, which stores accept the voucher (particularly important for shopping centre vouchers), if a lost or stolen card can be replaced and how to check the remaining balance.&lt;/p&gt;

  63. &lt;p&gt;It’s estimated more than a third of gift cards go unused and an unused gift card is virtually a donation to the retailer. Three years is a long time to spend a gift card but it’s also a long time to forget. Suggest Mum puts a reminder in her phone or calendar to use the voucher before it expires.&lt;/p&gt;

  65. &lt;p&gt;It’s also a good idea to use a gift card sooner rather than later, as you can’t be certain the retailer will still be around three years down the track.  Unspent gift cards may become worthless if a business goes bust, closes its doors or changes owners.&lt;/p&gt;

  67. &lt;p&gt;Gift vouchers are like cash – if mum loses it, she can’t claim it, so ask her to keep it in a secure place until she’s ready to go shopping.&lt;/p&gt;

  211. &lt;p&gt;A whopping 83 per cent of Australians have experienced negative consequences after falling victim to dark patterns according to a Consumer Policy Research Centre study. They reported financial harm or a feeling of being manipulated, and a quarter of Australians said dark patterns led them to share more personal information than they wanted.&lt;/p&gt;

  213. &lt;p&gt;The research also showed younger consumers (aged between 18 and 28 years) are even more negatively impacted by dark patterns. They are more likely to part with more of their money and their personal information than any other age group. This impacts their financial wellbeing and means more businesses have access to their personal information.&lt;/p&gt;

  215. &lt;p&gt;If you spot dark patterns and don’t want to accept them, choose a different retailer, or shop in store.  To avoid post-purchase regret don’t be rushed into buying something, shop around and stick to your budget, make sure the website is reputable or even ask friends and family for recommendations. It’s also important to know your consumer rights so make sure you read the fine print before clicking ‘buy’, keep your proof of purchase and know when you’re entitled to a refund, repair or replacement.&lt;/p&gt;

  301. &lt;p&gt;Selling the wrong property to a buyer has resulted in a Kelmscott real estate agency accepting a reprimand and the payment of $7,000 in fines and costs following disciplinary action by Consumer Protection.&lt;/p&gt;

  303. &lt;p&gt;&lt;strong&gt;John O’Neil &amp;amp; Son Pty Ltd&lt;/strong&gt; was fined $6,000 and ordered to pay $1,000 in costs by the State Administrative Tribunal (SAT) for breaching the Real Estate and Business Agents and Sales Representatives Code of Conduct 2016 when it failed to exercise due care, diligence and skill during the preparation of a sales agreement. &lt;/p&gt;

  305. &lt;p&gt;The action related to two lots of adjacent, street front, strata-titled land in Camillo belonging to the same sellers. The two certificates of title listed street addresses that did not match the physical street addresses of the lots. During the preparation of a sale agreement in March 2022, the agency relied on the street address given by the seller to obtain the certificate of title and strata plan. The agency failed to notice that the lot on the purchased certificate of title did not correspond with the lot on the strata plan that was planned to be sold. The mistake was not spotted during the sale and resulted in the certificate of title being issued in the buyer’s name for the wrong property.&lt;/p&gt;

  307. &lt;p&gt;The error only came to light after the buyer had moved in and was informed during a call about her First Home Owners Grant that the lot number on her application did not match official records.&lt;/p&gt;

  309. &lt;p&gt;The agency has apologised to the parties affected by this error and has also taken steps to ensure that the sales representative who has physically viewed the property correctly identifies it using more than just the certificate of title prior to preparing the Selling Agency Agreement or Contract of Sale.&lt;/p&gt;

  311. &lt;p&gt;Commissioner for Consumer Protection Trish Blake said it was disappointing the error had not been picked up at any stage during the sale process.&lt;/p&gt;

  313. &lt;p&gt;“Mistakes of this nature are unacceptable and represent major breaches of the laws that are designed to protect both buyers and sellers of real estate in WA,” Ms Blake said.&lt;/p&gt;

  315. &lt;p&gt;“Agents must ensure that they have the proper procedures in place to prevent any errors being made which could result in disciplinary action.&lt;/p&gt;
