De multe ori însă, aceştia nici nu ştiu la ce au dreptul prin lege.<br />
Semnaţi contracte!<br />
De multe ori, închirierea unei locuinţe se dovedeşte mult mai la îndemână decât cumpărarea. În Europa de Vest, această tendinţă este preponderentă în rândul tinerilor. Şi în România condiţiile actuale de piaţă permit închirierea în condiţii mult mai accesibile. La data preluării locuinţei, trebuie să te asiguri că vei încheia un proces verbal de predare-primire, în care să menţionezi starea locuinţei. <br />
De asemenea, trebuie stabiliţi foarte clar termenii închirierii: valoarea chiriei, modul de plată, obligaţiile şi drepturile fiecăreia dintre părţi. Conform noului Cod Civil, care urmează să intre în vigoare, chiriaşul nu poate fi obligat să plătească în avans, cu titlu de reparaţii locative, sume stabilite pe baza estimărilor făcute exclusiv de către proprietar. Chiriaşul poate înceta contractul de închiriere fără motiv, dar cu respectarea unui termen de preaviz de cel puţin 60 de zile. <br />
Dacă prin lege nu se prevede altfel, evacuarea forţată a chiriaşului se face numai prin intervenţia instanţei de judecată, deci nu de către proprietar în persoană. Situaţiile litigioase cu proprietarul sunt totuşi de evitat. Potrivit noului Cod Civil, chiriaşul este obligat să plătească chiria până la data eliberării efective a locuinţei. Chiriaşul poate fi obligat de către instanţă şi la repararea prejudiciilor de orice natură cauzate proprietarului până la acea dată. <br />
De aceea, cea mai bună soluţie este negocierea încă de la început a unor prevederi care să permită încetarea contractului de către proprietar numai în anumite condiţii, printre care să se enumere şi un termen de preaviz rezonabil, care să îi permită chiriaşului să îşi găsească o alternativă locativă.<br />
