  112. <p><span style="text-decoration: underline;"><strong><em>Transcription:</em></strong></span></p><p><span style="font-weight: 400;">The US Immigration Department has made several changes that will make the immigration process for Cubans a lot easier. That&#8217;s what we&#8217;re going to talk about in this video.</span></p><p><span style="font-weight: 400;">Hello from Freedom Group. We are a group of 4 companies where we do taxes, accounting, immigration, real estate, insurance and financial planning, so that we can help you in many, many ways. </span></p><p><span style="font-weight: 400;">This week the US Department of Immigration announced several changes that they&#8217;re making two to their policies in order to make the immigration process a lot easier for our Cuban brothers. To talk about this subject, we&#8217;re going to bring in our immigration attorney, Mr. Robert Montalvo.</span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> Robert, how are you?</span></p><p><b>Robert M:</b><span style="font-weight: 400;"> I&#8217;m good. Carlos, how are you?</span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> Good. So, Robert, you told me that this week, immigration department in the US made several changes in order to make life a lot easier for people from Cuba to basically do an immigration process. So, what&#8217;s the news? </span></p><p><b>Robert M:</b><span style="font-weight: 400;"> Well, to start off with, let&#8217;s talk about what the Cuban Adjustment Act is. The Cuban Adjustment Act is the way for most Cubans to get their green cards in the USA. The main requirements are you have to be from Cuba, you have to be a native or citizen of Cuba. You were inspected and admitted or paroled into the United States. Being admitted means you came in with a visa, you were allowed into the country. Being paroled is a way that US Immigration and Customs Enforcement Department planned security allows a person into the US without having a valid visa, they parole them into the country. Then after being admitted or paroled, if you&#8217;re physically present in the US for more than a year, like everybody says, “the year and the day”, then you can apply your form I-45 to adjust and get the status of legal permanent resident. Also, you must be present in the US when you file your form.</span></p><p><span style="font-weight: 400;">So, most Cubans when they come in through the border, they&#8217;re given a parole if they didn&#8217;t have a valid visa, then they wait a year and a day and they can adjust and get their green cards. The problem is, around 2017 immigration stopped giving Cuban’s parole, and most of them were allowed into the country under what&#8217;s called a I-220A, which is an order of release on recognizance, which means immigration would let them into the country, but wouldn&#8217;t grant them the parole that they needed to get their green card.</span></p><p><span style="font-weight: 400;">Now USCIS has decided that all the people who arrived at a correct port of entry and are categorized as arriving aliens, which means you came into the country through the port, you didn&#8217;t cross into the country and then be captured by immigration. So, as long as you came in through the port correctly and were given either an order of release under cognizance, or were given a bond after being in detention, you still qualify for the Cuban Adjustment Act. </span></p><p><b>Carlos H: </b><span style="font-weight: 400;">So, it makes it a lot easier for them?</span></p><p><b>Robert M:</b><span style="font-weight: 400;"> Yes, because for many years since 2017, a lot of Cubans haven&#8217;t been able to adjust because they weren&#8217;t given the specific document that’s needed for the parole, and now they can. </span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> So, what&#8217;s the process, then, for Cubans that want to come in? What&#8217;s the process now, the new process? </span></p><p><b>Robert M:</b><span style="font-weight: 400;"> Well, the process is still really the same. You still have to file your I-485 to adjust to the status of your green card. The only difference is now you don&#8217;t have to present the I-94 parole that they used to be given to Cubans. Now all you have to prove is that you came in at the port of entry and you were categorized as an arriving alien. </span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> So how could a Cuban start this process? </span></p><p><b>Robert M:</b><span style="font-weight: 400;"> Well, the first thing you can do is you can call from aggression. We can give you a consultation, we can explain the entire process and if you want, we can help you with it. In this video we&#8217;re going to discuss the 7 most common questions on the K-1 fiancé visa and stay till the end because we&#8217;re going to talk about the type of questions that immigration asks you in the K-1 fiancé visa interview.</span></p><p><span style="font-weight: 400;">To talk about this, we&#8217;re going to bring our immigration attorney Robert</span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> Robert, how are you?</span></p><p><b>Robert M: </b><span style="font-weight: 400;">I&#8217;m good Carlos, how are you?</span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> Robert is our immigration attorney here at Freedom Immigration. So, Robert, if people follow our channel, they know that recently we did a video comparing the marriage visa to the fiancé visa. Well, we are going to talk about the 7 most common questions people have concerning the fiancé K-1 visa.</span></p><p><span style="font-weight: 400;">What is the K-1 visa?</span></p><p><b>Robert M: </b><span style="font-weight: 400;">The K-1 visa is also known as the fiancé visa, it&#8217;s a special visa which allows the fiancé of a U.S. citizen to enter the US, marry their fiancé and adjust status in the US to get their green card.</span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> What are the benefits of the fiancé K-1 visa?</span></p><p><b>Robert M: </b><span style="font-weight: 400;">Well, the principal one is that you can get married in the US, after that you can adjust status here. You can also obtain an employment authorization document, although technically you can obtain one when you come in as a K-1 fiancé, I don&#8217;t recommend it because it work permits usually take a long time to get and that one only valid for 90 days from when you came in, so a lot of times when you file for the work permit, you&#8217;re not going to get in time. But once you get married and you file the adjustment of status, you can also obtain your work permit there, which is the most practical one. Your children can also travel with you abroad and be included in the petition, you can also avoid filing the traditional I-130 when you&#8217;re petitioning your spouse after you file out the I-129F, you can then continue to the I-485.</span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> Perfect. So, what are the requirements for the fiancé K-1 visa?</span></p><p><b>Robert M: </b><span style="font-weight: 400;">The principle one is that the petitioner must be a U.S. citizen; US residents can petition their spouses, but only US citizens petition a fiancé. You must have the intention to get married. You also must be free to marry, which means that any previous marriage on either party must have been already terminated. You must have met at least once in the two years before filing; there are certain exceptions to this which are like, extreme hardship because of political conditions in the country or medical issues, and they are also cultural exemptions when the culture of the country will not allow you to see your spouse before you get married.</span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> So, what is the process for the fiancé K-1 visa?</span></p><p><b>Robert M: </b><span style="font-weight: 400;">You must start by satisfying the requirements; be a US citizen petitioner, be free to may, everything already we spoke about. US citizens must file the I-129F form. After that is approved, he has to file the DS-160 so they get the interview with the national visa center. The beneficiary must then go and have their interview. After that they enter the US. Once they&#8217;re in the US they get married and file for adjustment of status with the form I-485. And then they have their interview, and after that&#8217;s approved, they can get their green card.</span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> Alright. What are the processing times for the fiancé K-1 visa?</span></p><p><b>Robert M: </b><span style="font-weight: 400;">Around six to eight months for the I-129F, then it all depends on the embassy and the availability they have for the visa interview.</span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> And then what are the fiancé K-1 visa fees? How much does it cost?</span></p><p><b>Robert M: </b><span style="font-weight: 400;">The principal one is $535 for the I-129F. You have to pay $265 for them to apply for the visa. Once they&#8217;re in the US, the I-485 is $1225. They also have to get a medical examination that varies among the doctors.</span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> So, it’s more or less like 2 grand that it takes.</span></p><p><b>Robert M: </b><span style="font-weight: 400;">Probably a little more, yeah.</span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> Without the examination fees, basically.</span></p><p><b>Robert M: </b><span style="font-weight: 400;">Yeah.</span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> Alright. Now, the question that everybody asks here at Freedom Immigration is, what are the questions or what type of questions does immigration ask in the K-1 fiancé visa interview?</span></p><p><b>Robert M: </b><span style="font-weight: 400;">There are three main types of questions:</span></p><p><span style="font-weight: 400;">First one is background questions about the beneficiary, that&#8217;s the foreign fiancé. They&#8217;re going to ask you where you are from. Where did you grow up? Where did you go to school? Where have you worked? They are going to ask about your family; that&#8217;s like the first category, just to verify that everything matches up with what you put in the form.</span></p><p><span style="font-weight: 400;">They are also going to ask questions about how well you know the petitioner. They are going to ask questions like, where he was born, about his family, about where he&#8217;s worked, just to see if you know your fiancé.</span></p><p><span style="font-weight: 400;">And then the other questions are about the relationship. They&#8217;re going to ask where you met, how long have you known each other, what have you guys have done together, like the classic one I&#8217;ve heard is like, does he have any tattoos? they&#8217;re going to ask how many siblings they have</span></p><p><span style="font-weight: 400;">It’s all going to be questions relating to those three categories: Background questions about the beneficiary; questions about how well they know the petitioner; and questions about the relationship.</span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> Very good. To talk more about this, we are going to bring our immigration attorney Mr. Robert</span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> Robert, how are you?</span></p><p><b>Robert M:</b><span style="font-weight: 400;"> I&#8217;m good Carlos, how are you?</span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> Robert is our immigration attorney here at Freedom Immigration. So, Robert, we know a lot of people try to come to the US via an immigration visa concerning marriage. There&#8217;s a marriage visa and there&#8217;s a fiancé visa, there are both different programs. So, what&#8217;s the main difference between marriage visa and the fiancé visa for US immigration?</span></p><p><b>Robert M:</b><span style="font-weight: 400;"> Well, the main difference is where you&#8217;d get married, because for a marriage visa you&#8217;d have to be married before you apply, in that case you get married in a foreign country and then you apply for your spouse to come into the US. A fiancé visa, you actually petition them as a fiancé, not as a spouse yet. Also, a difference is only US citizens can apply for a fiancé, while legal permanent residents and US citizens can both apply for spouses via marriage visa. </span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> So, basically one of the differences is where do you want to marry?</span></p><p><b>Robert M:</b><span style="font-weight: 400;"> Yeah. You decide, if you want to marry in the US, then your option is a fiancé visa, but if you are okay getting married in a foreign country, maybe you want to have the wedding around your spouse&#8217;s family, in that case the you just get married outside the US and apply for the marriage visa.</span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> Okay. Obviously one of the things that make a difference is where do you want to live, right?</span></p><p><b>Robert M:</b><span style="font-weight: 400;"> Correct, because if you want to live in the US, then the fiancé visa is a good option, especially if the resident or the US citizen is living in the US, then you want to apply for the fiancé visa, so you don&#8217;t have to spend a lot of time outside. Meanwhile, in a marriage visa if you want to live outside, then you can just get married outside and then take your time and apply for the marriage visa, if you&#8217;re not in a hurry to come to the US.</span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> And one of the things that people need to consider is, how long are they willing to be separated, right?</span></p><p><b>Robert M:</b><span style="font-weight: 400;"> Yes. Because in most cases the marriage visa takes more time to process and get the person into the US; versus the fiancé visa, because it has a lot more vetting because you&#8217;re actually giving the person a green card. In the fiancé visa they are coming to the US to then be able to get married and then apply for the green card. So, if you are worried about being separated, the fiancé visa is a faster option, but if you are more that you want the person to get the green card faster, then you apply for a marriage visa. </span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> Is there a difference in cost of a marriage visa and for the cost of a fiancé visa?</span></p><p><b>Robert M:</b><span style="font-weight: 400;"> Yes, the marriage visa is going to be cheaper because all the costs related to the embassy are more or less the same between the marriage and the fiancé visa. The difference is, after the fiancé comes into the US, then they have to apply for the green card and pay all the immigration fees related to the green card. Meanwhile, the marriage visa, they go through all the embassy&#8217;s fees and then when you get to the US, they&#8217;re already a legal permanent resident. </span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> Then, what&#8217;s the difference between these visas for the permission or the ability to work?</span></p><p><b>Robert M:</b><span style="font-weight: 400;"> Well, if you apply for the marriage visa, the person comes in as a legal permanent resident, which means they&#8217;re automatically authorized to work. The fiancé visa, the person comes in and has 90 days to get married, the sooner you get married, the sooner you are going to start your process. Once you file for the green card, now because of covid it&#8217;s taking between 4-6 months to be able to get your work permit after you apply. So, with the marriage visas you&#8217;d also be able to work immediately, versus the fiancé visa where you&#8217;d have to wait until you get married, get your process going on and get your work permit.</span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> Okay. If people don&#8217;t know which is a better option for them, the marriage visa or the fiancé visa, what other considerations people need to know to make a choice, which one is better for me?</span></p><p><b>Robert M:</b><span style="font-weight: 400;"> Well, you&#8217;d also have to take into consideration if either party has children, especially if it&#8217;s the foreign national&#8217;s children and they intend to immigrate with them, there will be additional immigration processing fees there. Another fact may be if the person is working, because if you are employed and you do a fiancé visa, you&#8217;d have to leave your country, stop working until you are able to get your work permit in the US. Meanwhile, a marriage visa, if you get petitioned, you can basically still work in your work country until your process is approved and you&#8217;re able to come in as a green card holder and continue to work, maybe education, if you own property and want to sell it. There are many other considerations each particular case can have. </span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> So, in conclusion, Robert. Which one of these visas is better? Is the immigration marriage visa better or the fiancé visa better for immigration?</span></p><p><b>Robert M:</b><span style="font-weight: 400;"> Well, if you are only a legal permanent resident, your only option is the marriage visa. If you&#8217;re a US citizen, then you have to weigh your options, you have to see what&#8217;s better for you. Again, if your spouse just wants to get into the US faster, then the fiancé visa is a better option, but if you overall want to finish the process faster, then do the marriage visa, because you&#8217;d came in as a green card holder.</span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> So, now you know, that&#8217;s the difference between the marriage visa and the fiancé visa for US immigration. </span></p><p><span style="font-weight: 400;">Robert, if people want to start any type of immigration process, what do they have to do?</span></p><p><b>Robert M:</b><span style="font-weight: 400;"> Call Freedom Immigration at 407-910-4770.</span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> Perfect.   836. <p><span style="text-decoration: underline;"><em><strong>Transcription</strong></em></span></p><p><span style="font-weight: 400;">Usually if you come into the United States illegally, you can&#8217;t get a green card, but there is an exception and that&#8217;s what we are going to talk about in this video.</span></p><p><span style="font-weight: 400;">Hello from Freedom Group, we are a group of four companies where we have been providing quality services of tax accounting, immigration, real estate, insurance and financial planning.</span></p><p><span style="font-weight: 400;">In this video we are going to talk about a very little-known immigration process where if you came into the US illegally, you can still get your green card. So, to talk about this we&#8217;re going to bring our immigration attorney Robert.</span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> Hey Robert, how are you doing?</span></p><p><b>Robert M:</b><span style="font-weight: 400;"> Good Carlos, how are you?</span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> Good. Robert is our immigration attorney here at Freedom Immigration. So, Robert, usually when people come into the US illegally it&#8217;s almost impossible for them to get a green card, but there is a way. What&#8217;s the way that they can get a green card even though they came in illegally. </span></p><p><b>Robert M:</b><span style="font-weight: 400;"> Well, because people come in illegally to obtain the green card you require a legal entry. Now, there is a disposition in the immigration nationality act know as section 245(i), which allows you if you have a previously approved either labor certification or visa, to obtain your green card here in the United States regardless of whether you entered illegally, or whether you worked without authorization, or whether you failed to maintain continuous status.</span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> Okay. So, there is a way, right?</span></p><p><b>Robert M:</b><span style="font-weight: 400;"> Yes.</span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> And what are the benefits of this section 245(i)? </span></p><p><b>Robert M:</b><span style="font-weight: 400;"> It allows immigrants that would otherwise not be able to adjust status to that of a green card holder in the US, because most people if they came here illegally, they are going to have to leave the country, they are going to have to require a waiver to be able to get an interview at the embassy. This way it would not be necessary and you&#8217;d be able to adjust status here in the US. </span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> Good. So, people who want to do this 245(i) section, what are the requirements of this section 245(i)?</span></p><p><b>Robert M:</b><span style="font-weight: 400;"> The main one is that you have to have an approved immigrant petition, an i-140 or an i-130, or in some cases a labor certification dated before April 30th 2001. If you were previously petitioned and the I-130 was approved but you were never able to get a visa or adjust, that won&#8217;t matter and you&#8217;d be able to get the 245(i) paying a fee of about $1000 to immigration on top of the regular green card fees, then you&#8217;d be able to adjust via another petition where you have to have a visa immediately available to you, say being petitioned by a child of by a spouse.</span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> All right, and how is the application process? How do people apply for this section 245(i) in immigration?</span></p><p><b>Robert M:</b><span style="font-weight: 400;"> Like I mentioned, you have to have been the beneficiary of the immigrant visa, you have to been physically present in the US since December 21st of 2000, and then all you really have to is you file the I-485 which is the traditional green card application, the adjustment status; and supplement A, which is specific for the 245(i) process.</span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> And what documents are required to apply?</span></p><p><b>Robert M:</b><span style="font-weight: 400;"> Well, the basic; I-485 documents, copy of your passport, medical examination, you have to provide an affidavit of support, birth certificate, your passport size photos. Additionally to that, obviously the $1000 extra fee, your proof that you&#8217;ve been in the US since December 21st of 2000, and a copy of the approved immigrant petition or labor certification.</span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> Now, people who apply for this section 245(i) of the immigration nationality act, do they get a work permit or not?</span></p><p><b>Robert M:</b><span style="font-weight: 400;"> Yes, because they are applying for adjustment of status; when you apply for adjustment status under form I-485, you qualify for a work permit. </span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> Good. In your experience Robert as an immigration attorney, is this a good option, the section 245(i) is it a good option for immigrants?</span></p><p><b>Robert M:</b><span style="font-weight: 400;"> Again, if a person has the approved petition from before 2001, it&#8217;s a great option because then you&#8217;d be able to adjust here in the US.</span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> Perfect. So, now you know that there is a way that even if you came illegally into the United States, there is this rule in this section of the immigration law that allows you to get a green card even if you came in illegally.</span></p><p><span style="font-weight: 400;">So, Robert, if people want to start any type of immigration process, what do they have to do?</span></p><p><b>Robert M:</b><span style="font-weight: 400;"> Call Freedom Immigration at +407-910-4770.</span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> Perfect. To talk more about this, we are going to bring our immigration attorney Robert. </span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> Robert, how are you?</span></p><p><b>Robert M:</b><span style="font-weight: 400;"> I&#8217;m good Carlos, how are you?</span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> Good. Robert is our immigration attorney here at Freedom Immigration. Robert, as you know here at Freedom Immigration, we help a lot of foreign entrepreneurs coming to the US with EB-5 visas, E-2 visas, investment visas, business visas; but many of them don&#8217;t know there is an option called the international entrepreneur parole program. What&#8217;s this program about and how does it work?</span></p><p><b>Robert M:</b><span style="font-weight: 400;"> It&#8217;s not very well known but the international entrepreneur program is a special rule allowing the department of homeland and security to use the parole authority to grant a period of authorized stay to a foreign entrepreneur; it&#8217;s like a permission to enter, it&#8217;s not a visa, it&#8217;s determined case by case basis, and you must demonstrate that your continuous staying in the US is a significant benefit to the US.  </span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> Okay. So, what are the benefits of the US immigration international entrepreneur program?</span></p><p><b>Robert M:</b><span style="font-weight: 400;"> It allows foreign entrepreneurs to come to the US and work for their business. It also does not require the entrepreneur to invest his or her own money. Children can come and study, you can also bring your spouse to apply for a work permit. Up to 3 entrepreneurs can come to the US and work for the same startup; it&#8217;s specifically for startup companies. The initial parole is for two and a half years and you have the ability to renew it for an additional two and a half years, for a total of five years.</span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> So, it is interesting that the investment capital does not have to come from the entrepreneur itself. </span></p><p><b>Robert M:</b><span style="font-weight: 400;"> No.</span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> Okay. What are the requirements of the international entrepreneur parole program? </span></p><p><b>Robert M:</b><span style="font-weight: 400;"> The entrepreneur only has to own a minimum of 10% of the startup company. The startup company is a company that was started by an entrepreneur to seek development and validate a scalable business model. The startup company has to be formed in the last 5 years, so it has to be relatively new; and you must have a substantial demonstrated potential for rapid growth and job creation. Examples of that would be: Showing you have at least $200.000 invested by a qualified US investor; show at least $100.000 dollars in federal state local government awards or grants; or show partial award or investment and have other reliable and compelling evidence.</span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> Okay. Is this difficult to get, or what is the application process for this US immigration international entrepreneur parole program.</span></p><p><b>Robert M:</b><span style="font-weight: 400;"> The process is not that difficult; you submit the i-941. The fees are $1285. Documents that are required you have to show that the company meets the definition of startup; you have to demonstrate your ownership stake in the startup; you have to show in the description of the role of the startup with evidence; you have to demonstrate that the entrepreneur has a specific role in the startup, his job in the company; and you have to obviously have identity documents, passport, birth certificate, that type of stuff.</span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> Okay; and this is something that you need to renew?</span></p><p><b>Robert M:</b><span style="font-weight: 400;"> Like I say, the initial authorization period is for two and a half years, and then you can renew it for another two and half years; but to obtain the initial parole you have to demonstrate that the startup continues to prove a significant public benefit, as evidenced by increased capital investment revenue or job creation.</span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> Good. So, Robert, in your opinion, is this a good option for foreign entrepreneurs for Us immigration?</span></p><p><b>Robert M:</b><span style="font-weight: 400;"> It&#8217;s a good way to get in the door, getting to the US, that way then you can try to apply for a different type of authorized state, like obtaining visa, obtaining a green card thought maybe EB-5; but like if you are going to start a company, it&#8217;s a good way to get your foot in the door.</span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> Good. So, now you know, if you are a foreign entrepreneur now you have another option for US immigration.</span></p><p><span style="font-weight: 400;">Robert, if someone wants to start this immigration process, what do they have to do?</span></p><p><b>Robert M:</b><span style="font-weight: 400;"> Call Freedom Immigration at 407-910-4770.</span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> We are also going to put the link to the Freedom Immigration website in the description of this video. In this we are going to talk about the 7 most asked questions concerning the immigration TPS, or the temporary protected status from US immigration. </span></p><p><span style="font-weight: 400;">To talk about this topic, we are going to bring our immigration attorney Robert.</span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> Robert, how are you?</span></p><p><b>Robert M:</b><span style="font-weight: 400;"> I&#8217;m good Carlos, how are you?</span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> Robert is our immigration attorney here at Freedom Immigration. Robert, what is TPS or what is the immigration Temporary Protected Status.</span></p><p><b>Robert M:</b><span style="font-weight: 400;"> Temporary Protected Status is a temporary benefit that does not lead to lawful permanent resident or any permanent immigrations status. The Secretary of homeland security can designate foreign countries for TPS due to conditions in that country that temporarily prevent the individuals from returning to their home country safely, or in certain circumstances when the country is unable to handle the return of these nationals.</span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> What are the benefits of the immigration TPS status?</span></p><p><b>Robert M:</b><span style="font-weight: 400;"> If you are granted TPS you are not removed from the US; even if the person has a deportation order, they cannot be physically removed from the US. You can also use it to obtain employment authorization and you, in some cases, can be granted travel authorization.</span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> And what are the requirements for immigration TPS?</span></p><p><b>Robert M:</b><span style="font-weight: 400;"> The first thing is that you must be a national of a country designated for TPS, or a person without nationality who had recently resided in that designated country. You need to file for TPS during the open window for registration, and you must have been continually present in the US since the effective day of the most recent designation for your country. And you also have to be continually residing in the US since the date specified for your country.</span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> And then, who is ineligible for the immigration Temporary Protected Status?</span></p><p><b>Robert M:</b><span style="font-weight: 400;"> Who is ineligible are individuals who&#8217;ve been convicted of a felony or two or more misdemeanor committed in the US. If you are found inadmissible under non-waiver criminal and security related grounds. If you are also subject to any of the mandatory bars for asylum. This is even the example of people who have committed persecution against other people or terrorism. Obviously failing to meet the continuous physical presence or registration requirements. Also, failing to register after your initial TPS grant lapse.</span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> Okay. And then one of the most common questions that we get here at Freedom Immigration is, what evidence is needed to apply to immigration TPS?</span></p><p><b>Robert M:</b><span style="font-weight: 400;"> The basic one is evidence of your nationality to make sure you qualify; the date of your entry; and the evidence of your continuous residence that can be like mail, rental or lease agreements; evidence like transferring money out of the US; basically, anything that can prove that you&#8217;ve been in the US continuously.</span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> What are the fees for TPS?</span></p><p><b>Robert M:</b><span style="font-weight: 400;"> Well, the initial registration is only $50 dollars, but then if you also want a work permit, a work permit is $410 dollars + $85 for the biometrics, which would be a total of $495.</span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> Currently, what countries can apply for TPS?</span></p><p><b>Robert M:</b><span style="font-weight: 400;"> The current open ones are: Myanmar, until November 25th 2022. Haiti, still open until February 3rd 2023. Somalia, until March 17th 2023. Syria, until September 30th 2022. Venezuela, they recently extended until September 9th 2022. Yemen, until March 3rd 2023.</span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> In conclusion, Robert, do you think the TPS is a very good option for immigration?</span></p><p><b>Robert M:</b><span style="font-weight: 400;"> Yes. Any of these nationals who have been in the US and they qualify for TPS, it gives them an option to be able to stay in the country and basically protects them from deportation. </span></p><p><b>Carlos H:</b><span style="font-weight: 400;"> Okay, perfect. How are you? </span><span style="font-weight: 400;">  </span></p><p><b>Carlos: </b><span style="font-weight: 400;">Good. Robert is our immigration attorney here at Freedom Immigration. So, Robert, what is the EB-2 visa? </span><span style="font-weight: 400;">  </span></p><p><b>Robert: </b><span style="font-weight: 400;">Well, the EB-2 visa is an employment-based visa where you can obtain a green card which is available for those people with exceptional abilities or advanced degrees. Okay, there are actually three categories under the EB-2 visa, which is EB-2 a for people who hold advanced degrees, EB-2 B, for people with exceptional abilities, and then a specific EB-2 c category. That is when it is in the national interest of the United States that this person receives their green card. </span><span style="font-weight: 400;"> </span></p><p><b>Carlos:</b><span style="font-weight: 400;"> Okay. And approximately how many EB-2s? Does the United States Immigration Department give every year? </span><span style="font-weight: 400;">  </span></p><p><b>Robert: </b><span style="font-weight: 400;">They grant approximately 40,000 visas every year? </span><span style="font-weight: 400;">  </span></p><p><b>Carlos:</b><span style="font-weight: 400;"> Okay, so it&#8217;s limited? It&#8217;s very limited then. </span><span style="font-weight: 400;"> </span></p><p><b>Robert:</b><span style="font-weight: 400;"> Yes.  </span><span style="font-weight: 400;"> </span></p><p><b>Carlos:</b><span style="font-weight: 400;"> Okay. And then what are the benefits of the EB-2 visa? </span><span style="font-weight: 400;">  </span></p><p><b>Robert: </b><span style="font-weight: 400;">Well, first off, you get legal permanent residency, you get to get a green card in the United States, which can eventually lead you to citizenship, and also your spouse and unmarried children can accompany you and also get green cards. </span><span style="font-weight: 400;">  </span></p><p><b>Carlos:</b><span style="font-weight: 400;"> Okay? And what are their requirements to get the EB two visa? </span><span style="font-weight: 400;">  </span></p><p><b>Robert: </b><span style="font-weight: 400;">Well, the EB-2 would be an advanced degree you need or have equivalent experience, you would need like a postgraduate degree or five years of experience in that field, you have to have a valid job offer. So, we have to be petitioned by an employer, specifically in the area where you have the advanced degree, and your employer would have to get a labor certification from the US Department of Labor to prove that there&#8217;s nobody in the United States that can fill that job. Exceptional ability, you have to obviously demonstrate your exceptional ability, having the same valid job offer in the field where you have the exceptional ability and get the same labor certification. Now for the national interest waiver, it can be self-petitioned, but you specifically, which is the hard part, have to prove that it is in the national interest of the United States, you will be granted your green card. </span><span style="font-weight: 400;">  </span></p><p><b>Carlos:</b><span style="font-weight: 400;"> Okay. And then what documentation is required to apply for an EB two visa. </span><span style="font-weight: 400;">  </span></p><p><b>Robert: </b><span style="font-weight: 400;">It&#8217;s a lot of documents, but basically a passport copy of your resume, evidence of your extraordinary ability as an award for your publications, obviously, evidence of your education, letters of recommendation, the employment contract, and then explain to others specifically what it is you would be doing in the US. </span><span style="font-weight: 400;">  </span></p><p><b>Carlos:</b><span style="font-weight: 400;"> Okay? And what are the fees for the EB-2 visa? </span><span style="font-weight: 400;">  </span></p><p><b>Robert: </b><span style="font-weight: 400;">The USC fee to be approximately $2200. That&#8217;s what you have to pay the government. There is premium processing in the USCIS available at about $1140. And then plus attorney&#8217;s fees depending on who you hire to do the work. </span><span style="font-weight: 400;">  </span></p><p><b>Carlos:</b><span style="font-weight: 400;"> Okay. And how much time does the EB two visa process take? </span><span style="font-weight: 400;"> </span></p><p><b>Robert: </b><span style="font-weight: 400;">Well, the labor certification by itself will take approximately six months, then once your priority date is reached, once the petition is approved, it would depend on what country you&#8217;re from. Most countries the dates are current, but there&#8217;s specific backlogs for India and China. So, in conclusion, would you recommend the EB two visa? And who would this be good for? </span><span style="font-weight: 400;">  </span></p><p><b>Robert: </b><span style="font-weight: 400;">It</span> <span style="font-weight: 400;">would be good for specifically doctors, engineers, people with advanced degrees. And it&#8217;s sad for the people from India and China. But if you were from a different country as those two then you would be able to get this in approximately 18 months, which would be very good timing. </span><span style="font-weight: 400;"> </span></p><p><b>Carlos:</b><span style="font-weight: 400;"> So why would it not be a good option for let&#8217;s say a doctor or an engineer from China or India? </span><span style="font-weight: 400;">  </span></p><p><b>Robert: </b><span style="font-weight: 400;">Because they&#8217;d have to wait approximately between seven to 10 years from when they could actually come into the country. </span><span style="font-weight: 400;"> </span></p><p><b>Carlos:</b><span style="font-weight: 400;"> Okay, because they have a backlog for those countries. </span><span style="font-weight: 400;">  </span></p><p><b>Robert: </b><span style="font-weight: 400;">USCIS has been saying that they&#8217;re gonna try to work to eliminate those backlogs, but so far, nothing really has happened.  </span></p><p><b>Carlos:</b><span style="font-weight: 400;"> Okay, good.
