  42. <p dir="ltr">The weekend was a powerful geomagnetic storm, resulting in beautiful performances of northern lights from Canada to America and there is a possibility that colorful curtains in the sky may appear once again on Monday night.</p>
  43. <p dir="ltr">Northern lights, or Arora Borelis, occurs when particles from the sun are transported by rapid solar wind. It is often caused by a coronal mass ejection, or CME. It is a major expulsion of particles from the sun that travels faster than normal on the solar air.</p>
  44. <p dir="ltr">One of these CME hit Prithvi on Saturday, resulting in Aroras worldwide.</p>
  45. <p dir="ltr">The show continued on Sunday during the daylight in Canada, but then decreased. But we are still realizing the effects of CME, which talks with our magnetic field, which means we can still find a show.</p>
  46. <p dir="ltr">A geomagnetic storm is measured using the strength <a href="https://www.swpc.noaa.gov/products/planetary-k-index" target="_blank" rel="noopener">KP index</a>From one to nine. The higher the number, the stronger the storm will be. </p>

  76. <p dir="ltr">In May, Garry Kunneke, her husband Lloyd Rose, and her two dogs visited the Gooseri Lake Provincial Park in East Alberta, to set up a camp in their trailer, about 290 km south -southeast of Edmonton. </p>
  77. <p dir="ltr">The next day, Kunneke and her husband took their dogs for a walk in the park. </p>
  78. <p dir="ltr">&#8220;We decided that we really wanted &#8230; Get closer to the lake and just see what birds (were) there.&#8221; </p>
  79. <p dir="ltr">He said that by the route, he went into long grass, but said that he was in a brush for only a few minutes. </p>
  80. <p dir="ltr">Later that night, on his trailer, Kunneke&#8217;s husband told him that he felt something in his hair, and asked him to find him. </p>

  178. <p>The challenge filed by the Canadian Council with disability and other plaintiffs was first made on the Act in 2016 <a href="https://www.bclaws.gov.bc.ca/civix/document/id/complete/statreg/00_96288_01#section31" target="_blank" rel="noopener">&#8220;Deemed Consent&#8221; Provision</a>Which states that any person with involuntary status under the law agrees for psychiatric treatment.</p>

  217. <p>For mental health and addictions, BC Orthodox Critic Claire Ratte said that the provision of consent in the Mental Health Act was not in line with the best practices, and a collaborative approach to care was a better approach.</p>
  218. <p>She is arguing that, while the Mental Health Act is a good piece of law, the province is failing to support people with mental health and challenges of addictions, including people with brain injuries repeatedly from drug overdose.</p>
  219. <p>&#8220;I am more concerned about the lack of services that are out to support people with mental health and drug addiction,&#8221; he said. </p>
  220. <p>&#8220;And this is really where we are looking at these big failures, these big cracks are falling.&#8221;</p>

  263. <p>K. Carter is named in the case of Canadian Landmark Supreme Court, which empowered Canadian people to choose a medically aided death a decade ago.</p>
  264. <p>Price has completed the first assessment of its eligibility for the process and said that he hopes that the second assessment will be completed this week, which will clear their way to end their lives. He spoke openly and peacefully about his last days and his decision.</p>

  270. <p>It has been almost a year because the price first started experiencing the symptoms and received a diagnosis. Till a few months ago, he said, he was swimming and crying. He and his wife Daniel recently golfing, playing the best ball.</p>
  271. <p>&#8220;He pulled me down the course,&#8221; he said with laughter.</p>
  272. <p>But his energy is starting to fade. He knows how he wants the next step.</p>
  273. <h2>Family fought for mother</h2>
  274. <p>It was a price over 15 years ago, with his sisters Mary and Lee and his brother -in -law Hallis, the price made his way to Switzerland to live with his mother on his last day.</p>
  275. <p>The 89-year-old, living with spinal stenosis and selected to go into a non-profit facility abroad, who provided medical aided death. She became the 10th Canadian to do so.</p>
  276. <p>At that time, Assisted Death in Canada was illegal.</p>
  277. <p>Kay Carter wrote a letter explaining his decision and his family helped prepare a list of about 150 people, which to send it after death.   282. <p>When she reached the Dignitas convenience, she finalized the paperwork, settled in a bed and chased the barbiturate that would stop her heart with Swiss chocolate.</p>
  283. <p>&#8220;When she died, she slowly turned back,&#8221; Price said.</p>
  284. <p>After a few minutes, one of the convenience went to the door, &#8220;and the curtains out, and she says,&#8221; there, his soul is independent, &#8220;he said.</p>

  291. <h2>Long road after 2010</h2>
  292. <p>The Carter family had a long road after the death of Kay in January 2010.</p>
  293. <p>His eldest daughter Lee, the driving force behind taking the case to the Supreme Court, issued a unanimous decision in early 2015, killing the sections of the criminal code, which made someone illegal to help end their lives.</p>
  294. <p>In 2016, the federal government passed the law which formed the country for medical assistance in dying and made it legal for those whose death was &#8220;properly visionary&#8221; to apply for an evaluation.</p>
  295. <p>Following the 2019 verdict in the Quebec Superior Court, it was found that it was unconstitutional to assemble to die, whose death was perfectly removing, the liberal government updated the law in 2021.</p>
  296. <p>The update consisted of a controversial section that people are considered to be eligible for only a supportive death from a mental disorder. The proposed change caused widespread concern between the provinces and some mental health professionals, and is now delayed by March 2027.</p>

  329. <p>Marjori Mitchell, recently named Health Minister in Prime Minister Mark Karney&#8217;s new government, said in an interview that it was a question of balance.</p>
  330. <p>&#8220;This is very personal for the people, and I think in some provinces, they are not there yet,&#8221; he said.</p>
  331. <p>But when asked if the government was planning to allow advance requests, he postponed his colleague in the Department of Justice. A spokesperson of Justice Minister Sean Fraser said that Mitchell would be given the best place to respond.</p>
  332. <p>Health Canada is ready to release a report with major conclusions with its consultation on the matter in this spring.</p>
  333. <p>Medical aid in dying in Canada is becoming more common. In 2023, the latest year for which national statistics are available, 19,660 people applied for the process and more than 15,300 people were approved.</p>
  334. <p>More than 95 percent of the people were people whose death was considered to be perfectly away.</p>
  335. <p>Price Carter said that he wants to talk about his situation because he wants Canadian to talk about death, as uncomfortable.</p>

  355. <p>Edgewood, B.C. isn&#8217;t usually the sort of place that would be on the radar of high-ranking White House officials. </p>
  356. <p>On the west shore of Lower Arrow Lake and surrounded by the Monashee Mountains, it&#8217;s a roughly 200-kilometre drive from Kelowna, B.C., on a winding road. An unincorporated community, the latest census put it at a population of 235 people working in farming, forestry and tourism.</p>
  357. <p>But since December 2024, it&#8217;s been making international headlines over the fate of a group of ostriches living on one particular farm near the end of a rural road: Universal Ostrich, owned by Karen Espersen and Dave Bilinski and whose spokesperson is Katie Pasitney, Espersen&#8217;s daughter.</p>
  358. <p>In December, Canadian Food Inspection Agency (CFIA) officials were tipped off that some of the large birds on the farm had died, with tests confirming the presence of avian flu. That resulted in a cull order, which the farm has fought, picking up high-profile allies along the way and a court ruling allowing the cull to move forward.</p>
  359. <p>Among the farm&#8217;s supporters are U.S. Health Secretary Robert F. Kennedy, Jr., former TV host  and current administrator for the U.S. Centers for Medicare and Medicaid Services Dr. Mehmet Oz, and U.S. billionaire John Catsimatidis, all of whom who have now publicly urged Canadian officials to allow the ostriches to live.</p>

As Brady Strachan reports, a couple of high-profile officials within the U.S. administration have met with Canadian authorities and asked them to preserve the ostriches for scientific research. </span></span></span></div>
  376. <p>Meanwhile, the CFIA argues that as difficult as the decision is, the cull must move forward to protect public health and Canada&#8217;s agriculture industry.</p>
  377. <p>On May 30, the agency said the farm <a href="https://www.canada.ca/en/food-inspection-agency/news/2025/05/update-on-the-cfias-actions-at-an-hpai-infected-premise-at-a-british-columbia-ostrich-farm.html" target="_blank" rel="noopener">has been fined $20,000 for its failure to report the initial infection and deaths of birds</a>, and for its later failure to adhere to quarantine and cull orders.</p>
  378. <p>And at the centre of it is a farm full of ostriches in a tucked-away part of the province.</p>
  379. <p>&#8220;We&#8217;ve taken years to be able to pet these guys, walk among these guys,&#8221; Espersen said in a Facebook video, surrounded by her birds, in early May.</p>
  380. <p>&#8220;If we don&#8217;t stand for this … then what kind of world have we become?&#8221;</p>
  381. <p>Here&#8217;s what you need to know about this story, so far:</p>
  382. <h2>The avian flu context</h2>
  383. <p>The government of Canada, as well as other governments worldwide, are currently monitoring an outbreak of a strain of highly pathogenic avian influenza (HPAI) known as H5N1. Though it mainly infects birds, it can spread to other animals and humans, which typically happens through direct contact with infected birds or contaminated environments, the government says.</p>
  384. <p>While human infection is rare, the fatality rate is &#8220;approximately 52 per cent&#8221;, the government says, though it cautions that number may be an overestimate &#8220;given that mild infections can go undetected and under-reported.&#8221;</p>
  385. <p>The first human case of H5N1 contracted in Canada was reported in B.C. in November 2024.</p>
  386. <p>Avian flu&#8217;s primary impact has been seen among domestic birds, particularly chickens. Because poultry live together in close quarters, the virus can spread quickly among the flock, leading to high mortality rates and potential mutations. The disease has been blamed as a primary factor for high egg prices in the United States as laying hens were killed.</p>
  387. <p>In response to the virus, the CFIA has a &#8220;stamping out&#8221; policy which requires all domestic birds in a flock to be killed even if the virus is detected in just one bird. Thousands of birds have been culled under this policy.</p>

  404. <p>&#8220;Allowing a domestic poultry flock known to be exposed to HPAI to remain alive allows a potential source of the virus to persist,&#8221; the CFIA  <a href="https://inspection.canada.ca/en/animal-health/terrestrial-animals/diseases/reportable/avian-influenza/latest-bird-flu-situation/investigations-and-orders/british-columbia-ostrich-farm/judicial-review" target="_blank" rel="noopener">said in a statement</a>.</p>
  405. <p>&#8220;A human case of H5N1 in B.C. earlier this year required critical care, and an extended hospital stay for the patient, and there have been a number of human cases in the United States, including a fatality.&#8221;</p>
  406. <h2>Disease detected at Universal Ostrich</h2>
  407. <p>According to <a href="https://decisions.fct-cf.gc.ca/fc-cf/decisions/en/item/528164/index.do#_Toc198034606" target="_blank" rel="noopener">court documents</a>, in early December 2024 the farm was home to about 450 ostriches, some more than three decades old. Partway through the month, several ostriches on the farm developed &#8220;flu-like&#8221; symptoms, which started about a week after 300-500 ducks landed on the premises.</p>
  408. <p>The farm says that from Dec. 14, 2024 to Jan. 14, 2025, &#8220;69 young male and female breeders died, most of them under four years old.&#8221;</p>
  409. <p>On Dec. 28, the CFIA investigated following an &#8220;anonymous report of multiple ostrich deaths&#8221; at the farm, the court document says, and a quarantine was ordered the same day four more ostriches died.</p>
  410. <p>Samples were collected from two of the dead ostriches and by Dec. 31 they had tested positive for avian flu at the Canadian Animal Health Surveillance Network laboratory in Abbotsford, B.C.. On Jan. 3 the National Centre for Foreign Animal Disease in Winnipeg confirmed H5N1.</p>
  411. <p>The order to cull the flock was given on Dec. 31.</p>
  412. <h2>Quarantine orders not followed</h2>
  413. <p>Inspectors also noted the ostriches were in open pens, allowing for free access by wild birds and animals, and that staff at the farm shared equipment and &#8220;moved freely among open pens&#8221;, posing a biosecurity hazard when the disease was present.</p>
  414. <p>Even in January, after quarantine orders were in place, inspectors noted wild animals were still freely interacting with the ostriches and other safety measures weren&#8217;t being followed.</p>
  415. <p>&#8220;The record also shows that the Applicant&#8217;s farm also exhibited sick ostriches being moved to treatment pens in contravention of quarantine requirements, dead ostriches dragged through pens populated with living ones without robust separation measures, and unauthorized individuals walking inside the infected zone,&#8221; the judge wrote.</p>
  416. <p>In its May 30 statement, the CFIA wrote that the farm&#8217;s failure to quarantine its birds increased the chance of transmission and &#8220;reflect a disregard for regulatory compliance and animal health standards.&#8221;</p>
  417. <h2>Claims of herd immunity</h2>
  418. <p>When the cull order was given on Dec. 31, 2024, the farm was given a compliance deadline of Feb. 1, 2025.</p>
  419. <p>They used that time to try and build a case for the ostriches to be spared.</p>
  420. <p>According to the court case, the farm&#8217;s operators began raising the ostriches in the mid-1990s, and Espersen and Bilinski say they incorporated Universal Ostrich Farms, Inc. in 2001 with a focus on &#8220;ethical breeding and care.&#8221;</p>
  421. <p>In court, the farm&#8217;s lawyer says that the farm&#8217;s operations include selling breeding stock, raising birds for slaughter and meat and agri-tourism.</p>

  426. <p>However, the farm also says it <a href="https://saveourostriches.com/press-releases/official-statement-from-universal-ostrich-farms-inc-may21-2025/" target="_blank" rel="noopener">pivoted during the COVID-19 pandemic</a> to focus instead on research, specifically on trying to use ostrich eggs to produce antibodies for COVID-19 or other viruses. &#8220;Meat processing ceased in the summer of 2019,&#8221; it said in a statement.</p>
  427. <p>The farm says it partnered with Yasuhiro Tsukamoto of Kyoto Prefectural University in Japan for this work.</p>
  428. <p>Neither Tsukamoto nor the university have responded to CBC News in relation to the story but the researcher, known in some circles as &#8220;Dr. Ostrich,&#8221; has <a href="https://www.theguardian.com/world/2021/dec/10/scientists-ostrich-cells-glowing-covid-detection-masks" target="_blank" rel="noopener">previously made headlines for his work with ostrich eggs and COVID-19</a>.</p>
  429. <p>CBC News also heard from a researcher who has confirmed his work with Universal Ostrich.</p>
  430. <p>&#8220;Dr. Yasuhiro Tsukamoto and I are Co-CEOs of Ostrich Pharma USA (OPUSA),&#8221; said Stuart Greenberg in an email.</p>
  431. <p>&#8220;OPUSA has been tasked with commercializing the specialized ostrich antibodies produced by Dr. Tsukamoto and his research team in Japan. We have been working with Universal Ostrich in B.C. to develop the techniques for large-scale production of ostrich antibodies derived from the yolks of their eggs,&#8221; the email continues.</p>
  432. <p>&#8220;Our focus has been on the production of antibodies against human digestive enzymes to produce a dietary supplement for weight loss.&#8221;</p>
  433. <p>Tsukamoto has not confirmed his work in this area.</p>
  434. <p>Additionally, Universal Ostrich maintains that all of the birds that died due to avian flu were acquired &#8220;after 2020.&#8221;</p>
  435. <p>This is important to them because they say that in March 2020, a flu-like disease infected their herd which they believe gave the survivors &#8220;natural and eventual herd immunity,&#8221; and say that since January the remainder of the ostriches are &#8220;happy and healthy&#8221; showing no sign of sickness.</p>
  436. <h2>Exemption denied</h2>
  437. <p>According to the court case, the farm first raised the possibility that its ostriches had developed immunity to avian flu during a Jan. 2 phone call with a CFIA case officer, who explained the process for receiving an exemption to the cull order.</p>
  438. <p>In followup emails, the officer provided the forms and documentation that would be needed to make the case that the birds should not be killed, and the farm made its application.</p>
  439. <p>However, by Jan. 10 the exemption was rejected.</p>
  440. <p>According to the courts, the CFIA concluded the farm &#8220;failed to demonstrate the existence of any distinct epidemiological unit,&#8221; that was not likely to be exposed to avian flu, nor had it submitted &#8220;sufficient evidence to support its claims of genetic rarity and value qualifying the flock for an exemption,&#8221; the latter of which could be proven through breeding books, recognition from breed associations, or genomic testing.</p>

  445. <p>The May 30 statement from the CFIA also said the farm failed to provide &#8220;research documentation&#8221; and that the farm lacks facilities &#8220;suitable for controlled research activity or trials.&#8221;</p>
  446. <p>The court case also noted that there has only been one exemption to the &#8220;stamping out&#8221; policy granted in Canada during the current H5N1 outbreak, in the case of a turkey farm infected in 2022 that was able to demonstrate the complete separation, including biosecurity measures, of turkey flocks where some birds had been infected.</p>
  447. <p>Not only were the spared birds kept in separate barns from the infected animals with distinct ventilation and a &#8220;shower in/shower out&#8221; procedure, but the facility was also able to demonstrate the birds had &#8220;rare and valuable genetics&#8221; used for &#8220;high value pedigree birds.&#8221;</p>
  448. <p>The CFIA also refused the ostrich farm&#8217;s request that it do follow-up testing on its surviving birds.</p>
  449. <h2>Legal courts and court of public opinion</h2>
  450. <p>The farm went public with its plight early, with Pasitney first speaking to CBC News on Jan. 9.</p>
  451. <p>The story was also covered by local outlets and was later picked up as a campaign by the Ezra Levant-owned website the Rebel, which in a Jan. 24 post encouraged readers to begin emailing the CFIA and other officials, claiming the cull was in part because of the influence of major pharmaceutical companies.</p>
  452. <p dir="ltr">Also involved is B.C. Rising, a group with a website that includes a section arguing that COVID-19 was part of a United Nations-led plot to take control of vast swaths of land and that 15-minute cities, an urban planning tool aimed at creating walkable neighbourhoods, is actually a plot to trap people in individual sectors of their city.</p>
  453. <p dir="ltr">The site now has a section titled &#8220;Save Our Ostriches&#8221; and helped organize a &#8220;convoy&#8221; of people to visit the farm and show their opposition to the kill order.</p>

  458. <p>The farm welcomed supporters, while also posting a disclaimer stating it did not necessarily agree with all of the material being circulated by those who had taken up the cause of saving the ostriches.</p>
  459. <p dir="ltr">&#8220;We&#8217;re just trying to do what&#8217;s right,&#8221; Pasitney said.</p>
  460. <p>In the meantime, the farm contracted a lawyer to apply for the cull to be stayed until the case could be heard by the courts, arguing Universal Ostrich would suffer &#8220;irreparable harm&#8221; should it move ahead.</p>
  461. <p>That stay was granted, and the case went to federal court for two days of hearings on April 14 and 15.</p>
  462. <h2>Legal and scientific debate</h2>
  463. <p>During the hearings, Universal Ostrich pleaded its case for an exemption, reiterating many of its previous claims about herd immunity and the scientific value of its birds.</p>
  464. <p>It also called on three individuals who argued that the stamping-out policy used by the CFIA was not required, at least in the case of the ostriches.</p>
  465. <p>Those individuals were Steven Pelech, a UBC professor and biochemist with training in immunology and virology, Bryan Brindle, an immunologist at the University of Guelph and Jeff Wilson, a former senior epidemiologist and manager at the Public Heath Agency of Canada.</p>
  466. <p>Collectively, the trio made the case that ostriches should be treated as different from hens or other poultry due to a combination of their long lifespan (three to five decades) and the fact that they don&#8217;t live in as densely populated conditions as hens.</p>
  467. <p>They also argued that the CFIA should have been open to further testing of the surviving birds after the initial deaths occurred.</p>
  468. <p>But the CFIA pushed back.</p>

  473. <p>&#8220;Whether or not the birds recover and appear healthy is not the concern when implementing a cull policy,&#8221; said Paul Saunders, the agency&#8217;s lawyer. </p>
  474. <p dir="ltr">&#8220;That concern also includes the potential for the mutation of the virus among healthy birds&#8230;. an infection in birds could be a precursor to a human flu pandemic. Regardless of how likely that is, once it happens, it&#8217;s happened, so that is a concern motivating the CFIA&#8217;s response.&#8221;</p>
  475. <p>The CFIA also relied on a report from Shannon French, a veterinary epidemiologist trained in epidemiology, virology and poultry health management, outlining the international scientific standards that inform its decision-making.</p>

  480. <p>The agency&#8217;s legal team also attacked the trio of scientists put forward by the farm, stating none have ever worked with ostriches, and that much of their testimony was &#8220;speculative&#8221; and &#8220;well outside mainstream peer-reviewed literature.&#8221;</p>
  481. <p>Likewise, the farm&#8217;s lawyers attacked French for not being impartial given her professional association with the CFIA.</p>
  482. <p>&#8220;Unsurprisingly, each side seeks to narrow the evidentiary footprint of the other, and asks this Court to rely on the opinion of their experts should opinions diverge,&#8221; Justice Russel Zinn wrote, ultimately declaring it would be inappropriate for him or any other judge to do so.</p>
  483. <p>Instead, he focused on the fact that the CFIA was the agency in Canada tasked with managing the complex scientific and technical decisions in relation to avian flu.</p>
  484. <p>&#8220;When Parliament leaves technical or scientific assessments to specialized administrative bodies, it signals that those bodies, not the courts, are best positioned to make judgments on complex, expertise-driven matters,&#8221; he wrote, allowing the cull to proceed.</p>
  485. <h2>A difficult decision</h2>
  486. <p>Both Zinn and the CFIA noted the emotional and economic toll any cull takes on farmers.</p>
  487. <p>They also noted that the cull is not punishment but instead based on the public good, which is also why farms receive financial compensation when they take place — up to $3,000 per animal in the case of the ostriches.</p>
  488. <p dir="ltr">&#8220;While compensation may not offset the emotional toll of depopulation, it can provide resources to recover and reestablish operations,&#8221; CFIA said.</p>
  489. <p>But that&#8217;s not feasible for Universal Ostrich, Pasitney said. Her mother is in her 60s, her business partner in his 70s, and they don&#8217;t feel they can start over with a new set of birds, especially ones as finicky as ostriches.</p>
  490. <p dir="ltr">&#8220;They&#8217;re in the pecking order,&#8221; Pasitney said. &#8220;They know them.&#8221;</p>

  495. <p>Scientists not involved in the court case say the CFIA and Universal Ostrich are trying to navigate a difficult position.</p>
  496. <p>Jean-Pierre Vaillancourt, a professor at the University of Montreal&#8217;s veterinary school, says Canada has <a href="https://inspection.canada.ca/en/animal-health/chief-veterinary-officer/woah" target="_blank" rel="noopener">signed a treaty</a> with the <a href="http://www.woah.org/fileadmin/Home/eng/Health_standards/tahc/current/glossaire.pdf" target="_blank" rel="noopener">World Organisation for Animal Health</a>, which means it has agreed on certain specific measures, like culls, when it comes to controlling avian flu.</p>
  497. <p>&#8220;We try to extinguish the fire — so essentially the virus can&#8217;t feed and replicate if it has other birds around,&#8221; he said.</p>
  498. <p>J. Scott Weese, a professor at the Ontario Veterinary College, told CBC News in an email that a decision to cull animals at a farm is a cost-benefit decision, where the costs and benefits can&#8217;t be quantified easily.</p>
  499. <p>&#8220;In general, culling makes more sense when there&#8217;s widespread infection, risk to people around the animals, limited other exposure risk, where disease is more severe and where there&#8217;s less value — economic, conservation, human-animal bond — of the animals,&#8221; he said.</p>
  500. <p>But Weese added that H5N1 is now well established in Canada, and there may be less justification for culling from the standpoint of controlling disease.</p>
  501. <p dir="ltr">&#8220;An individual group of birds is a drop in the bucket now,&#8221; he said. &#8220;Culling probably has little population benefit.&#8221; </p>
  502. <p dir="ltr">He added, though, that from a &#8220;risk aversion standpoint,&#8221; a cull is the &#8220;easiest thing&#8221; to do.</p>

  507. <p>And Fiona Brinkman, a professor at Simon Fraser University&#8217;s department of molecular biology and biochemistry called the spread of avian flu &#8220;a tragedy,&#8221; saying that she had hoped the CFIA would conduct new tests of the ostriches while she also recognized the worry that they could be reinfected or asymptomatic, passing the flu back and forth with wild birds.</p>
  508. <p>&#8220;There&#8217;s a real problem with the birds not being able to be sheltered,&#8221; she said. &#8220;Poultry, for example, you can put them in a barn. That&#8217;s not appropriate for ostriches.&#8221;</p>
  509. <p>And rights group Animal Justice has become involved, arguing that rather than mass culls, Canada should focus on improving conditions at large-scale poultry farms where birds are kept in more confined conditions.<br /> </p>

  519. <h2>Political pushback</h2>
  520. <p>Despite the ruling, B.C.&#8217;s premier has expressed frustration with the CFIA for not showing more &#8220;flexibility&#8221; in its decision making.</p>
  521. <p>&#8220;We understand the importance of containing the bird flu and the important role that agency plays,&#8221; he said following the court ruling. &#8220;What&#8217;s hard to watch is a lack of discretion and ability to evaluate case-by-case scenarios.&#8221;</p>
  522. <p>He said putting the specifics of the ostrich case aside, it&#8217;s a &#8220;consistent experience the province has had with federal agencies.&#8221;</p>
  523. <p>Conservative MP Scott Anderson has visited the farm, which is in his riding, and says he has asked the CFIA to &#8220;hold off&#8221; on the cull and be open to other solutions.</p>
  524. <p>Another politician to visit is independent MLA Jordan Kealey of Peace River North, who is a farmer himself.</p>
  525. <p>He told CBC News the case had struck fear into many independent farmers who worry that with avian flu so prevalent among wild birds, it will be nearly impossible to avoid exposure and, ultimately, will lead to the loss of animals.</p>
  526. <p>Meanwhile, the Regional District of Central Kootenay voted to not accept the carcasses of any killed ostriches at local landfills unless followup testing of the birds was done, and the results made public. That meeting was attended by nearly 300 supporters of the farm via Zoom.</p>
  527. <h2>Threats, deaths and RCMP involvement</h2>
  528. <p>Since the ruling, a few dozen supporters have camped out at the farm, at the encouragement of its owners, with Espersen encouraging them to &#8220;come surround the farm&#8221; and &#8220;don&#8217;t let them do this to these beautiful animals.&#8221;</p>

  545. <p>The farm has urged its supporters to be peaceful and spoken out against threats of violence that have been made by some opposed to the cull.</p>
  546. <p>The union representing CFIA workers says it has fears over some of the rhetoric being posted online, including death threats against members.</p>
  547. <p>&#8220;Nobody likes to see their flocks culled, and we certainly don&#8217;t take any pleasure in doing it, but &#8230; it is our jobs, it&#8217;s our mandate for the safety of Canadians to ensure that we carry out our job,&#8221; said Milton Dyck, the president of the Agriculture Union, in an interview with CBC News.</p>
  548. <p>In its May 30 statement, the CFIA said the farm owners and supporters had gathered in &#8220;an apparent attempt to prevent the CFIA from carrying out its operations at the infected premises.</p>
  549. <p>&#8220;This has delayed a timely and appropriate response to the HPAI infected premises, resulting in ongoing health risks to animals and humans,&#8221; the statement read.</p>
  550. <p>On the other side, Universal Ostrich says two of its birds have been shot, one on the night of March 21 and the other on the night of May 23.</p>
  551. <p>RCMP has not confirmed the cause of the deaths but says it is investigating both instances.</p>
  552. <p>RCMP liason officers have also been paying regular visits to the farm in what they describe as an effort to maintain safety for everyone involved.</p>

  561. <p>That website, published through the Substack platform, describes itself as a network aimed at &#8220;exposing fraud and corruption, particularly in medicine and beyond,&#8221; and says it has its roots in pushing back against public health policies stemming from the COVID-19 pandemic. </p>
  562. <p>Catsimatidis then used his platform, which includes a radio show on a New York-based station he owns, to bring the topic up to other leaders, including Kennedy. During an April episode of his program with the health secretary, Catsimatidis claimed the ostriches were being killed because of corruption and pharmaceutical companies, with Kennedy responding that it was a &#8220;huge mistake.&#8221;</p>
  563. <p>Kennedy then followed up with a letter posted X on May 23, stating that he had met with the president of the CFIA and was requesting that Canada consider not culling the herd but rather work with the United States to research them.</p>

  573. <p>Through all this, the CFIA has remained steadfast in its policy to have the flock culled, saying stamping out is a necessary policy needed to protect public health and Canada&#8217;s argriculture industry.</p>

  739. <p dir="ltr">&#8220;North America has no regulatory or policy rule in North America,&#8221; said Mark Winfield, professor of environment and urban changes at Toronto&#8217;s York University and Sustainable Energy Initiative of the school.</p>
  740. <p dir="ltr">&#8220;This is a wild west,&#8221; he told CBC News. &#8220;Drivers who usually &#8230; provide stability like stability and the foundation for that kind of business is not just there.&#8221;</p>

  746. <p dir="ltr">Canada is a federal government <a href="https://www.cbc.ca/news/politics/canada-electric-vehicles-2035-1.7063993" target="_blank" rel="noopener">Made a plan</a> There is no national structure for EV batteries after 2035 to get 100 percent zero-furnace sales for passenger cars, but after being too old to power to a car. There are no federal rules around EV battery recycling and BC, the only province that announced adjacent regulation, now says it is far from that plan. </p>
  747. <p dir="ltr">Meanwhile, EV sales continue to climb in Canada, EVS has increased by 17 percent of all new cars sold in 2024. Last year, Canada had over 270,000 new vehicle registration battery-powered EVS or hybrid plug-in EVS. </p>
  748. <p dir="ltr">Vinfield said, &#8220;Every EV that is sold, is eventually going to convert into an end-of-conjumer-life battery,&#8221; Vinfield said, in a decade, there will be &#8220;millions of millions&#8221; of EV batteries at the end of life globally. </p>
  749. <p dir="ltr">The European Union determines the rules in 2023 that Canada could use as a model, saying Winfield, which includes requirements for recycled materials in the new battery starting in 2031, and expanded responsibilities for the lifetime of battery for producers.</p>
  750. <p dir="ltr">1 November 2024 <a href="https://iea.blob.core.windows.net/assets/3af7fda6-8fd9-46b7-bede-395f7f8f9943/RecyclingofCriticalMinerals.pdf" target="_blank" rel="noopener">Report</a> How to increase significant mineral recycling, IEA recommended providing clear, long -term rules, which is noted that &#8220;it is important to instill confidence in investors and recycling companies.&#8221; </p>
  751. <p dir="ltr">Maria Kelher, an environmental advisor who previously worked with the environment and climate change on the management of EV battery recycling, said some rules would promote investment and help to increase commercially participating projects in Canada and North America. </p>
  752. <p dir="ltr">&#8220;If the government says that you have recycled materials (in a new battery), it provides certainty to recyclars, as companies buying products have to buy their products,&#8221; he said. </p>
  753. <p dir="ltr">&#8220;So it runs the market.&#8221;</p>

  758. <h2 dir="ltr">How EV Battery Recycling works</h2>
  759. <p dir="ltr">Recycling lithium-ion battery that power EVS occurs in two stages. First, the battery is cut into a substance called black mass, which contains important minerals such as cobalt, nickel, and lithium. Then, minerals are extracted from black mass, refined and sold to make new batteries. </p>
  760. <p dir="ltr">This step is where Kelher says recycling can be really attractive </p>
  761. <p dir="ltr">&#8220;The key is to sell in the battery supply chain,&#8221; he said, given that the recycled material extracted from the black mass must be of frequent high quality for manufacturers to use it. &#8220;If you can do it, it&#8217;s fantastic.&#8221;</p>
  762. <p dir="ltr">Recyclic Battery content of Cubek and BC is one of the recycling features in Lithian Technologies Canada at the Inc., which has started producing black mass from EV batteries in recent years.</p>
  763. <p dir="ltr">And Ontario -based Electra Battery Material is conducting a successful recycling test from 2022, but has not yet reached commercial production. They are targeting to build a new plant <a href="https://www.cbc.ca/news/canada/sudbury/ev-battery-recycling-joint-venture-1.7328249" target="_blank" rel="noopener"><u>In a joint venture</u></a>    With three fire groups at Northern Ontario, they say that in 2027, the eV battery can start recycling.</p>
  764. <p dir="ltr">But the removal of minerals from black mass to create new batteries is mostly centered abroad, especially in China and South-East Asia where EV battery recycling industry has increased with manufacturing. </p>

  769. <h2 dir="ltr">Giving a second life to the battery </h2>
  770. <p dir="ltr">Kelher believes that there is still a lot of time for the market before requiring regulation in Canada. </p>
  771. <p dir="ltr">The EV battery was originally predicted for the last eight years, but now, they have a lifetime of 12 to 15 years in vehicles. According to industry reports and experts, they can also retain 80 percent of their capacity after use in vehicles, and 10 more for life to 10 more years.</p>
  772. <p dir="ltr">The same Vancouver-based moment is trying to get a partnership with vehicle manufacturers and dealerships to reproduce the old EV batteries for use in energy energy storage systems. </p>
  773. <p dir="ltr">Moment Energy co-founder and Chief Operating Officer, Sarine Ratan, told CBC News that he was already looking at the ramp re-preparation, and expect the first peak to start in 2030.</p>
  774. <p dir="ltr">Ratan said, &#8220;To be really streamlined for this, I think having a federal policy will lead to a long way,&#8221; it is necessary that it is not leaving the revival step.</p>

  779. <p dir="ltr">Finally, Kelher says that the regulations are not required until the EV battery recycling the recycling market develops more safe supply, she says anything, &#8220;until you have a scale, until you have enough batteries at the end of life.&#8221;</p>
  780. <p dir="ltr">But Winfield argues that we need to move to the infrastructure to deal with the battery designed to enter the recycling market in waves.</p>
  781. <p dir="ltr">Based on EVS&#8217;s annual new vehicle registration in Canada since 2011, and a vehicle will be at least 93,000 EV batteries that require recycling up to 2040, with 500,000 ready between 2040 and 2045. </p>
  782. <p dir="ltr">&#8220;I don&#8217;t think there is no excuse to not be ahead of this,&#8221; Winfield said. &#8220;This will be a monumental lack of foresight.&#8221;</p>
  783. <h2 dir="ltr">So what are Canadian governments doing? </h2>
  784. <p dir="ltr">Environment and Climate Change Canada (ECC), in an email statement, told CBC News that the EV battery is to manage the provinces and regions to manage at the end of their lives.</p>
  785. <p dir="ltr">The ECC pointed to the BC&#8217;s 2021 announcement that it would add EV battery to its extended manufacturer responsibility program by 2026, which would require EV automekers to arrange for recycling or recycling their batteries.</p>
  786. <p dir="ltr">Except BC, CBC News said that it is no longer adding EV battery to the program till 2026.</p>
  787. <p dir="ltr">The provincial ministry of the Environment and Parks stated that the change came to light &#8220;after consultation with the change&#8221; and &#8220;fast -developed electric vehicles (EV) battery markets&#8221; after consultation with industry and other affected parties. It also stated that it could &#8220;detect further consultation,&#8221; but when regulation can be considered, not providing a new timeline for this. </p>

  804. <p dir="ltr">ECC also pointed to a voluntary battery recovery program launched in Quebec in 2023. <a href="https://recuperationdesbatteriesve.ca/en/ev-battery-recovery-home/" target="_blank" rel="noopener"><u>This program</u></a>    Consumers allow the vehicle to reach the manufacturers who will pick up the dried battery and arrange the next stages. </p>
  805. <p>Quebec considered adding EV batteries to an extended manufacturer responsibility program in 2021, but after receiving the response from the industry, the province said that it left the idea. According to an email statement, the province also organized two workshops to detect &#8220;how the region should be regulated&#8221; in 2023 and 2024.</p>
  806. <p dir="ltr">Ontario, in which EV is one of the highest -adoption rates in Canada, told CBC News that it does not plan to include EV batteries in its manufacturer requirements because they &#8220;have been diverted from landfills through voluntary initiative.&#8221; The Ministry of Environment, Protection and Parks said that it would &#8220;continue to monitor management activities&#8221; to see if the rules should be introduced in the future.</p>
  807. <p dir="ltr">In Canada, the automakers and industry players say that they are already arranging recycling on their own-most EVs offer a country-wide recovery of battery, and many have participated with recycling plants for battery Shreeding. However, without inspection, the success of these initiatives is not clear. </p>
