I generally will not accept a case if the client&#8217;s goal is to take the other party to task on every infraction. For example, &#8220;S/he was a minute late dropping off the kids, I want you to file a contempt of court motion.&#8221; I made the mistake once of representing a good friend with his case, with a single child support matter taking two years to resolve and the parties were constantly trying to one-up the other.I recently gave pro bono assistance to a father who I saw in family court representing himself. I met with him several times and gave advice on strategy and likely outcomes and the best way to approach his case. The best information I can convey sometimes is that the legal system is not about right or wrong but whether conduct is lawful and if a court can provide any relief to an aggrieved party. Other mantras I share are: you may never be vindicated, particularly in family court; bad things happen to good people, life isn&#8217;t always fair, mean people win sometimes; take the high road, live well and put this behind you as soon as possible.The father I am helping finally heard and most importantly accepted what I had to say including, put down your sword and extend an olive branch of peace. He listened to my advice and let me know he has obtained what he wanted on an informal basis while his next court date is pending. He understands what he must accept and cannot control, as distasteful as it can be. He recently called to tell me he will continue his case on his own because he fears any change in the status quo will cause a contentious reaction and since he is making forward progress he does not want to risk going backwards.I am so impressed by this gentleman who has already raised two children who are adults now and he is beside himself that he does not have the unfettered access to his two-year-old daughter that he had with his grown kids. He is of modest means and education but I am touched and moved by him each time we meet.CAREFUL WHAT YOU WISH FORA court/judge has no interest in one&#8217;s personal affairs, of a civil nature, until people cannot resolve a dispute on their own. Divorcing parents are free to make whatever child custody arrangements they choose, for the most part, and the court only gets involved if the parents can&#8217;t agree.Before I continue, its important to stress that parents can, and do, say any defamatory and untrue remark about the other with near impunity. Occasionally a judge may penalize a parent for making demonstrably untrue accusations, but this is the exception and not the rule and I have never heard of a judge referring a case to the district attorney for perjury charges despite most legal papers requiring a statement be executed under penalty of perjury. Individuals enjoy &#8220;judicial immunity&#8221; for all statements made in court papers and precludes a defamation lawsuit unless the untrue statements are published outside the ambit of the court papers. Judicial immunity extends to police investigations and reports, too.The idea behind judicial immunity is that people must feel free to use and participate in the judicial process without fear of being sued for what they say. Though in extreme cases it might be possible to institute an action for malicious prosecution or abuse of process. A criminal case for false police report might be pursued, too, but good luck with that. Police agencies don&#8217;t like to be put in the middle and often suspect ulterior motives.So now to the point of the section heading. After the fact, a parent came to me after filing a report of domestic violence/battery with the police and pursing a restraining order. The police investigated and the other parent denied and accused the reporting parent of abuse. The criminal case became a wash and the case rejected against both parents. The parent pursued the restraining order and cross allegations of abuse were made. The court issued mutual restraining orders and now they meet in a police lobby to accomplish the child custody exchange. They are refrained from contacting each other and once daily calls to the child when in the other parents care has ceased.The moral of the story, and it is not always possible, do what you can to make peace. Think before you act, because steps to gain leverage even when legitimate can backfire and have severe consequences.I recognize that attorney fees can mount very quickly particularly when he fees run from 200-350 an hour, and beyond the reach of many, however, family law is not a place for the faint of heart, uninformed, naive or idealistic. Most definitely, what you don&#8217;t know can and will hurt you. </p>

To compare term life insurance companies is really a matter of what&#8217;s important to prospective insurance client.Your priorityMy experience has been that what most people are concerned with when it comes to term insurance is what it will cost them.Clearly some term life insurance companies are more highly rated by companies such as A.M. Best, Moody&#8217;s, and Standard &#038; Poor.Some of the factors that determine a company&#8217;s rating are:</p>

If any of these factors, among the others that are used, are important to you when you compare term life insurance companies, how important are these factors to you in comparison to price?What if one company is considered one of the best term life insurance companies in the industry but the premium cost is double that for the same amount of coverage by one that is not considered one of the best rated term life insurance companies?What&#8217;s your priority?RatingsSimilar to being in school, term life insurance companies and all insurance companies are rated on an A-F basis.Seems easy to understand, right?Did you know that and &#8220;A&#8221; rated company can be rated anywhere from A++ to A-?Did you know that different ratings companies, including those mentioned above use different criteria to determine ratings?Did you know that an insurance company can be rated differently by the different ratings companies?If an insurer receives a favorable rating from one rating company and a less favorable one from another rating company, which one do you think they&#8217;re going to make sure you&#8217;re aware of?UnderwritingInsurance companies use the term underwriting to determine who pays how much for what. Different companies have different underwriting guidelines. Its name literally means that someone in the company places a signature on the policy saying a particular person meets the company&#8217;s underwriting guidelines.There are three main methods used for underwriting life insurance policies:</p>
  54. <p>Fully underwritten-most common-may involve medical exam (blood/urine specimen/attending physician statement).</p>
  55. <p>Simplified issue-less common-no medical exam-decision regarding issue usually swift</p>
  56. <p>Guaranteed issue-anyone who applies and meets certain conditions is guaranteed that a policy will be issued-(includes accidental death insurance and graded death benefit policies)<br />
  57. There are also different underwriting classifications. The most common:</p>

  59. <p>Standard-most common</p>
  60. <p>Sub-standard, also known as rated or table<br />
  61. Some companies subdivide the classifications. For example:</p>

Table can be in the form of a number (usually 1-6) or a letter (usually A-G) &#8211; the higher the number or letter, the higher the premium.ConvertibilitySome companies allow for conversion of a term policy to a permanent policy at a later date without proving insurability.Other companies allow for conversion but require proof of insurability.Some companies do not offer convertibility at all.If convertibility is offered, it is often within certain time limits.If you&#8217;re sure you want term and nothing else, then this is not something you need to consider.PriceThe main factors that affect price:1. Health2. Age3. Life styleThey are numbered as such because that is generally the order of priority companies use to classify prospective clients.Poor health can and will exclude someone regardless of age and lifestyle and no amount of money will buy insurance. On the other hand excellent health can go a long way in reducing premiums.A person&#8217;s age is the next factor. The age is compared to mortality rates. Different companies have different charts for mortality rates.Another way to describe mortality rate is how many years someone of their age is away from death.Statistically speaking, insurance companies know pretty accurately how many people of a certain age will die before their next birthday.Life style is the third factor. The most common consideration is whether someone smokes but there are others as well, such as what someone does for a living. Certain professions are more hazardous than others.A person&#8217;s hobbies have an effect as well. Sky diving, and speed racing are often frowned upon, and may not result in denial of coverage, but could result in higher premiums.Regardless of all factors, female rates are nearly always lower than male rates.Fully underwritten vs. simplified issue vs. guaranteed issueAll things being equal, fully underwritten is going to result in the best priced premium. However, often times all things are not equal.Are you sure your health is as good as you think it is or is it possible a blood/urine sample, saliva swab, or doctor&#8217;s report could reveal something you&#8217;re not aware of, or if you&#8217;re not the most ethical person, perhaps something you simply don&#8217;t want to reveal?A fully underwritten policy takes much more into consideration when determining rating class and price than a simplified issue policy.Depending on your point of view, that can be an advantage or a disadvantage.Assuming you&#8217;re being honest and there&#8217;s not already information reported about you to the medical information bureau (MIB), your chances of a policy being issued as applied for are as high as 9 out of 10 if you apply for a simplified issue policy.On the other hand, there is about a 60% chance you will not qualify for a fully underwritten policy as applied for.A guaranteed issue policy will definitely be issued. You will know if you qualify before actually signing the application. It&#8217;s either yes or no. However because it&#8217;s guaranteed, the price is usually much higher, unless it is a conditional policy such as an accidental death policy.ConclusionUnless you know the ropes and/or can take the time to weigh all the factors when comparing term life insurance companies, an experienced professional can steer you the best term life insurance companies for you to consider.Having said that, if you want to be absolutely sure that you&#8217;ll get the insurance you want, it&#8217;s best to buy a guaranteed issue policy.If you&#8217;re pretty sure you&#8217;re in good health but don&#8217;t want to go to the trouble of a medical exam or paramedical exam (blood/urine), or you don&#8217;t want to reveal certain matters that could affect your ability to obtain insurance, you should consider a simplified issue policy.Once you qualify for a policy, assuming no fraud is involved, the only one who can cancel the policy once it&#8217;s been issued is you. The insurance company cannot cancel you as long as the premiums are paid.Perhaps it makes sense to apply for a guaranteed or simplified issue policy first. Call your bank(s) to be sure your ATM/debit cards can be used overseas. Ask what the fees are for using your card abroad, such as transaction and foreign currency conversion fees. Tell them what countries you will be visiting and when. Get phone numbers to call from overseas if you need to. Most banks have international collect numbers that you can call from a pay phone if need be.NOTE: Look at your bank cards and credit cards to be sure they won&#8217;t expire during your trip. It&#8217;s a very easy thing to overlook, but the biggest pain in the butt to fix!Documents. Photocopy important documents such as your passport, credit cards, visas, travelers&#8217; cheques, travel insurance policy and itinerary. Leave a copy with a reliable loved one so that if need be you can call and have the documents faxed/emailed to you. Email a copy to yourself, and make sure your email password is as tight as Uncle Scrooge.Travelers insurance. You will probably never have to use it, but it&#8217;s a must. Compare policies. Nomad and travel1 are excellent companies I&#8217;ve used.Keeping in Touch. If you are planning to take your mobile phone with you, call your carrier to find out exactly what the rates are to make and receive calls and texts in each country you plan to travel to. Even better, get your phone unlocked and buy a local SIM card when you arrive. Usually for just a few dollars, you can have your own number on which you can receive calls for free (someday, hopefully the United States will get on board with the rest of the world and not charge you to receive calls&#8230;).Skype. If you don&#8217;t already have a Skype account, set one up now. This is your best bet for calling home or anywhere else. Not only can you talk for free with your friends who have Skype, you can also call anywhere you want to for pennies through the computer. You can get a local Skype number that for just a few dollars a month that you have forwarded to you wherever you are (watch out, though; with this option, YOU pay to receive calls). Most internet cafes now have Skype-ready machines. If it&#8217;s the middle of the night or you can&#8217;t find an internet cafe (they do seem much less plentiful, what with every cafe, hotel and even hostel offering wi-fi these days), an international calling card is a good idea. Even the worst ones will give you far better rates than your mobile carrier from home will give you for international calls.Bills. If you are going away for a month or more, make sure to pay any monthly bills that will come due while you are gone. Even better, set up online banking so that you pay all of your bills with a few clicks of a mouse. It&#8217;s free, provided by your bank (if not, you need to find a bank that has entered the 21st century! Hello!), your payments arrive faster because they are sent electronically, and you don&#8217;t have to find envelopes or lick stamps. Done.First night accommodations. It&#8217;s a good idea to make a room or bed reservation for your first night. Write down their address, phone number and directions.Know how to get out of the airport. If you plan to navigate yourself with public transportation, write down specific directions, and don&#8217;t be shy about double checking with the bus driver to make sure you&#8217;re going the right way. If you plan to take a taxi, find out what the distance is and/or what the taxi fare should be, and don&#8217;t be shy about disputing the fare if the driver tries to charge you three times what you expected. Unscrupulous taxi drivers routinely rip off tourists in every city in the world, but when you call them out on it, you usually end up paying a more fair price. </p>

  154. <content:encoded><![CDATA[<p> Ford has set its sights to be on the Technology Road as the number of vehicles on the roads is forecast to grow from today&#8217;s 1 billion to up to 4 billion by mid-century.Earlier this year, Ford Motor Company Executive Chairman Bill Ford told an audience of the Mobile World Congress that Ford is outlining the company&#8217;s &#8220;Blueprint for Mobility&#8221; to address future vehicle gridlock by creating a global transportation network that utilizes communication between vehicles, transport infrastructure and individual mobile devices.Ford explained that no one company or industry would be able to solve the mobility issue alone. And, the effectiveness of any plan would be contingent on customer acceptance of new technologies.Ford predicted, &#8220;If we do nothing, we face the prospect of &#8216;global gridlock&#8217;, a never-ending traffic jam that wastes time, energy and resources and even compromises the flow of commerce and healthcare.&#8221; He continued, &#8220;The cooperation needed between the automotive and telecommunications industries will be greater than ever as we prepare for and manage the future. We will need to develop new technologies, as well as new ways of looking at the world.&#8221;With the fast-paced increase in in-vehicle technologies, we can see that the telecommunications industry is critical in the creation of an inter-connected transportation system where cars are intelligent and can talk to one another as well as the infrastructure around them. For example, it is estimated that the cost of congestion to the economy in England through lost time will rise to around $35 billion annually by 2025. In Germany, sustaining a town of 300,000 people is estimated to require 1,000 truck deliveries daily.Solving the issue of urban mobility is a huge challenge that will only be successful if government collaboration, infrastructure development and industry come together globally.Ford said with the company&#8217;s blueprint will set near, mid- and long-term goals for significant reductions in the company&#8217;s global environmental footprint.In the next 5 to 7 years, Ford plans to be at the forefront of developing increasingly intuitive in-car mobile communications options and driver interfaces that proactively alert drivers to traffic jams and accidents. They have already successfully experimented with this technology in England and in Germany.Another near term plan is to deliver a better-connected, safer and more efficient driving experience with limited autonomous functions for parking and driving in slow-moving traffic &#8211; building on existing Ford features including Active Park Assist, Adaptive Cruise Control and Active City Stop. Many Ford vehicle&#8217;s already have the foundation of this technology and some can even be &#8220;upgraded&#8221; to offer ways to let a driver move through traffic jams in a more efficient and safe manner with the car essentially driving on auto pilot.Within the next five to ten years, Ford will introduce semi-autonomous driving technology including driver-initiated &#8220;auto pilot&#8221; capabilities and vehicle platooning in limited situations &#8211; technologies that will provide improved safety and driver assistance features, but allow the driver to take control, if needed.They also plan to increase interaction between individual cars on the road through utilization of ever-increasing computing power and numbers of sensors in vehicles, helping reduce the number of accidents at intersections and enabling limited semi-autonomous and autonomous highway lane changing and exiting.And, the arrival of vehicle-to-cloud and vehicle-to infrastructure communication that contributes to greater time and energy efficiency by enabling vehicles to recommend alternative transport options when congestion is unavoidable and to pre-reserve parking at destinations.Ford told the mobility conference, &#8220;Cars are becoming mobile communications platforms and as such, they are a great untapped opportunity for the telecommunications industry. Right now, there are a billion computing devices in the form of individual vehicles out on our roads. They&#8217;re largely unconnected from one another and the network.&#8221;He continued, &#8220;We&#8217;ll increasingly take advantage of the car as a rolling collection of sensors to reduce congestion and help prevent accidents. Nature persists because of its closed-loop biological cycles involving growth, the food chain, and decomposition. Earth has been operating this way for millions of years without depleting its own resources.We can (and should) design our goods following nature&#8217;s examples. The Cradle to Cradle approach challenges us to design products to fit in either a technical or biological closed-loop cycle. Technical nutrients are reclaimed and reused or recycled. Biological nutrients are consumed or composted. In both circumstances, waste from one application provides food for another within their respective cycles. Mixing of technical and biological nutrients in such a way that they cannot be easily separated from one another creates the &#8220;monstrous hybrid&#8221;, as described by William McDonough and Michael Braungart in their book Cradle to Cradle: Remaking the Way We Make Things. Bound to each other, the nutrients are no longer eligible for recycling or composting and the monster is bound for its grave (landfill).A trip to the mall or any conventional store will yield mostly monstrous hybrids. Let&#8217;s take, for example, your average cotton T-shirt. It sounds quite simple, but a closer look reveals why it is usually ultimately bound for the landfill. The cotton used to make the shirt is a biologic nutrient, capable of being composted with the resulting compost supporting plant growth. If the cotton is not organic, it is likely that large amounts of pesticides were used, so much so that one can hardly consider conventional cotton a true biologic material. Fortunately, people are requesting and farmers are growing organic cotton.There are numerous advantages to the organic cotton shirt over your average cotton T, most notably the absence of pesticide in the environment and reduced human exposure to pesticide and residues. It is a huge step forward. But consider what else might be part of this T-shirt that prevents it from existing as a pure biologic nutrient even if it is organic. Here&#8217;s where the details of the organic standards and textile labeling laws come in.Even the certified organic cotton T-shirt can be partially synthetic. It can, for example, be sewn with thread containing polyester. Stronger than cotton, polyester is preferred for sewing but it doesn&#8217;t work for composters. (By the way, you can tell if thread is cotton or polyester by taking a match to it; if it burns it is cotton while polyester shrivels like a plastic.) Organic textile standards also allow for small amounts (5-10%) of synthetic fibers in the fabric. Similarly, the textile labeling laws indicate that small amounts of synthetics need not be disclosed on labels. So your 100% organic cotton shirt might be a little bit polyester or spandex. Sadly, product disposal is not being fully considered and the composter is left not knowing.Most tags are made from nylon or some other durable synthetic fabric to withstand washing, so they aren&#8217;t candidates for the compost either. Tags can be removed, but typically tags are sewn in so you&#8217;ll need to tear open the seams to fully remove it. Even if you are willing to cut open seams and tear out thread in order to compost your shirt, consider the dyes, decals, and finishes that can also preclude an item from the compost pile. Those used for non-organic textiles may contain heavy metals, azo compounds, or formaldehyde. The myriad of non-biologic nutrients mixed in with our biological nutrient (cotton) make the compostable T-shirt hard to come by.During the mid-20th century there was an explosion in the development of synthetic materials. While the added convenience is undeniable, so is the added trash and health burden. The resulting polymers (e.g., plastics) are here for the long haul since microbes have yet to evolve to break them down. For the long term it just makes sense to use more of the biological cycles that have been at work for millions of years; and when they don&#8217;t meet our modern needs, let&#8217;s create synthetic cycles that function in the same way. If we reject the monstrous hybrid, we&#8217;ll need fewer graves leaving more space to observe nature&#8217;s fine examples.Copyright 2009 Compostable Goods. </p>
