41.
Case Background:

42.
43.
44.
45.
We were recently retained for a case at the Westminster Courthouse where a person decided to handle his own case without a lawyer. The case was a first-time DUI. This DUI did not involve an accident, and the person had a clean criminal record. On the surface, it should have been okay for him to go to court, take a guilty plea, and expect no jail time. That was his goal. However, things took a turn when he initially went to court on his first day, which was supposed to be his arraignment date. His case was not filed. He received a piece of paper indicating that his case was still under review. He was then told to check back. This is where the problems began. Eventually, he ended up with a dui warrant for his arrest for failure to appear.

49.
Client Profile:

50.
51.
52.
53.
Our client was a professional in his thirties working a white-collar job.

56.
57.
Charges or Allegations:

58.
59.
60.
61.
The legal issue here was not the initial DUI, but our client’s failure to appear and the resulting arrest or bench warrant. Because of the warrant, if he had any law enforcement contact, they would have to take him into custody and hold him until his court date. Additionally, he faced a potential new charge of failure to appear.

69.
Legal Challenges:

70.
71.
72.
73.
The specific legal hurdle was to get rid of the arrest warrant or bench warrant before our client had any law enforcement contact. If he did, it would mean he would be taken to jail for a few days.

76.
77.
Defense Strategy and Case Proceedings:

78.
79.
80.
81.
We had to get into the courthouse, put the case on the calendar, and make a motion to quash the bench warrant, all before he had any contact with the police. Initially, our client was given a court appearance date by the arresting officer. However, these dates are only estimations. In this case, the Orange County District Attorney’s Office was not on time in reviewing the case. When our client went to court on his first date, he found out his case was not filed. Eventually, his case was filed, but the prosecutor’s notification may have been lost in the mail. Because of this, he received no notice, and a bench warrant was issued when he was not present in court.

89.
Outcome:

90.
91.
92.
93.
Ultimately, we were able to quash or recall the warrant for our client. This meant that he would not be arrested if he had any law enforcement contact. We achieved this without needing him present in court.

94.
95.
96.
97.
Role of Your Firm:

98.
99.
100.
101.
We went to the Westminster courthouse and first put the case on the calendar. We went through the clerk’s office before seeing the judge and had our file walked over to the courtroom. Once our case was called, we requested to quash the bench warrants. After quashing the bench warrant, we proceeded with the client’s DUI case.

102.
103.
104.
105.
Client Impact:

106.
107.
108.
109.
By recalling our client’s bench warrants, we alleviated a lot of stress. Our average client does not break the law and has a clean criminal record. However, being labeled a fugitive and ordered to be taken in upon contact by any law officer is substantially stressful. We were able to alleviate this stress for our client, all without needing him to come to court, under Penal Code 977A.

112.
113.
Lessons Learned:

114.
115.
116.
117.
The insights and lessons from this case emphasize the importance of keeping track of dates and not solely relying on the District Attorney’s office to send a piece of mail. If your case is not filed, take responsibility and continue to check the court system or the District Attorney’s Office to learn the status of your case.

124.

125.
126.
There are many risks associated with self-representation. These risks often involve dealing with various bureaucracies at the court. One such risk is missing potential court dates, as mentioned above. Additionally, there may be unequal negotiation power between the District Attorney and someone not aware of a baseline for the offer.

131.
How common is it for DUI cases to not be filed by the arraignment date, and what should one do in such a scenario?

132.

133.
134.
It is very common for DUI cases not to be filed by the arraignment date. The Orange County District Attorney’s Office frequently gives out a standard piece of paper informing people about the status of their case. If a person shows up to court and their case is not on the calendar, they need to visit the prosecuting agency. In 95% of cases, this will be the Orange County District Attorney’s Office, where they can obtain a piece of paper with instructions on how to follow up with their case. This percentage accounts for the fact that there are different agencies prosecuting cases, including the Anaheim City Attorney or municipal cases.

139.
If an arrest or bench warrant is issued due to a misunderstanding or administrative error, what are the steps to rectify this situation?

140.

141.
142.
If an arrest or bench warrant is issued due to a misunderstanding, it is important to go to court, see a clerk, add the case back to the calendar, and see a judge about your case.

148.

149.
150.
Potential employers can see bench warrants for failure to appear during background checks, as well as any convictions. Many people misunderstand that if a case is pending without a conviction, it should not appear on a background check. However, this is not the case.

155.
How can one ensure effective communication with the District Attorney’s office to avoid missed notifications, as mentioned in the case?

156.

157.
158.
The process is straightforward. When given the piece of paper, it includes a phone number to call and check. Additionally, one can check the court case status. It’s important to check both systems because your case may not be handled by the District Attorney’s Office; it could be a municipal or city attorney’s case. Therefore, it’s important to check both the court and the prosecuting agency.

190.
In this post, we’re excited to share an incredible success story from our legal files, showcasing how tactical thinking and a deep understanding of the law can lead to favorable outcomes for our clients at the Newport Beach Courthouse.

191.

193.
194.
The Incident

195.
196.
197.
198.
Our client, a senior citizen, found herself in a challenging situation after dining at a well-known restaurant. Following her meal, where she consumed a modest amount of alcohol, she made her way to her vehicle and started the engine in the area of Five Crowns and directly in front of the Lovely Nail Salon on 3801 East Coast Hwy. This action, observed by a concerned bystander, led to the involvement of the Newport Beach Police Department.

199.
200.
201.
202.
Upon arrival, the officers, noting signs of potential intoxication, proceeded with a DUI investigation. Our client, seated in her vehicle, cooperated fully with the officers. Despite the seeming straightforwardness of the situation, the case presented unique complexities. This resulted in the officers arresting her for a DUI.

203.
204.
205.
206.

207.
208.
209.
210.
Our Legal Approach

211.
212.
213.
214.
Recognizing the potential impact of a DUI charge on our client’s life, we immediately began crafting a nuanced defense strategy. Key to our approach was the fact that our client had not actually driven her vehicle. She was preparing to drive but had not moved the car. The facts of this case did not involve a car moving. The defenses which would have come into play was similar with DUI sleeping in a car.

215.
216.
217.
218.
The Courtroom Strategy

219.
220.
221.
222.
Our team focused on this critical detail in court. We argued that while our client was in her vehicle with the engine running, there was no actual driving or attempt to drive. This distinction is crucial in DUI cases and can significantly influence the outcome because in order to prove a DUI the prosecution would have to show that there was driving and not just attempted driving.

223.
224.
225.
226.
Negotiating with the District Attorney

227.
228.
229.
230.
Our efforts were directed towards discussions with the Orange County District Attorney. By highlighting the specific circumstances of the case and our client’s lack of actual driving, we negotiated a significant reduction in charges. The initial DUI charge was amended to an attempted wet reckless , which carried far fewer legal repercussions, including no impact on our client’s driving license and reduced fines and penalties.

231.
232.
233.
234.
The Outcome

235.
236.
237.
238.
The result was a remarkable success for our client, who was immensely relieved and grateful. The reduced charge meant she could move forward without the severe consequences that a full DUI charge would have entailed.

239.
240.
241.
242.
The Impact

243.
244.
245.
246.
This case is a testament to the importance of understanding every facet of a legal situation and knowing which one of the successful DUI defenses to utilize. It underscores our firm’s commitment to providing tailored, strategic legal representation that acknowledges the individual circumstances of each client.

247.
248.
249.

250.

251.

252.
What are the different legal implications between a DUI and an attempted DUI charge?

253.

254.
255.
A DUI charge, when convicted, carries with it a full suspension from the DMV, in addition to fines, penalties, and a mandatory three-year probation. On the other hand, an attempted DUI charge or attempted reckless driving only carries one year of probation, and the classes can be negotiated. Moreover, an attempted charge does not trigger any type of mandatory DMV suspension.

256.
257.

258.

259.

260.
How can I determine if my situation qualifies for a charge reduction similar to the one in this case?

261.

262.
263.
It’s important to have an attorney review your case. Usually, there’s a checklist in our office that we use to assess the chances of reduction in a case. Some factors may include checkpoints, breath machines, or sleeping in the car defenses. Ultimately, a seasoned attorney should be able to tell you whether or not your case can be reduced.

264.
265.

266.

267.

268.
What evidence is typically required to prove that someone intended to drive under the influence, but didn’t actually drive?

269.

270.
271.
The evidence required to prove intent to drive under the influence, but without actual driving, is circumstantial. The prosecution cannot make a DUI charge if the person did not drive. So, the prosecutor will have to ask the jury to speculate whether the person was driving or did drive. In this case, it was tough for the prosecution to prove.

272.
273.

274.

275.

276.
Are there specific legal defenses that are more effective in cases where the vehicle was running but not moving?

277.

278.
279.
In cases where a vehicle was running but not moving, a legal defense called the ‘No Drive Defense’ can be argued. It states that the person was sitting inside the car but never drove. Even if the car was on, it can still be argued that nobody knew how long the person was sitting in the car for; it could have been hours. Therefore, there was no driving, or it’s unclear when the person was driving, putting the prosecution in a difficult position.

280.
281.

282.

283.

284.
How does the presence of a witness, like the concerned bystander in this case, affect the outcome of a DUI-related charge?

285.

286.
287.
The presence of witnesses is probative in cases like this because it shows whether or not a person was driving. For example, in this case, the witness’s observation was helpful for our client because it showed that she only got into the car and sat there. Their observations can be helpful in proving that there was no driving involved. Alternatively, a witness can also testify that there was driving involved.

295.
The long-term consequences of an attempted DUI on your personal and professional record depend on the type of job you have. 302.
303.
A person found sitting inside a parked car under the influence can still face a license suspension. The Orange Driver Safety Office is inconsistent with its opinions and hearing officers, often not following the law, and more often than not, suspends a person’s driver’s license. The suspensions handed out by the Orange Driver Safety Office are 120 days or four months. However, these can be avoided with the right advocacy and by meeting the 10-day deadline for your DMV hearing to preserve your hearing rights.”

339.
We represented a client who had her teaching credentials. She completed all the classes and obtained her credentials; however, she was encountering problems in the job market. She has a clean criminal record, except for one incident while bartending at a bar during school. When she was bartending, minors entered the establishment and ordered alcohol. Due to being busy that night, she failed to check their IDs and subsequently got into trouble for serving alcohol to a minor. Although this is a relatively minor charge, it significantly impacted her job prospects in the school districts and needed an expungement to make her more competitive.

344.
345.
346.
347.
Our client is an Asian female in her 20s who had just completed her schooling and licensing. She worked as a substitute teacher, living day by day while applying for jobs in various schools and districts.

351.
Charges or Allegations:

352.
353.
354.
355.
The legal issue our client faced was a conviction for serving alcohol to minors. This hindered her competitiveness in job applications, as she was compared to other applicants with similar backgrounds but without the misdemeanor charge.

363.
364.
Legal Challenges:

365.
366.
367.
368.
The legal hurdles in this case involved the Long Beach courthouse, known for its slow processing. Files often got lost there, leading to delays of several months.

369.
370.
371.
372.
Defense Strategy:

373.
374.
375.
376.
The expungement process for this case was challenging. The case was misplaced at the courthouse and took months to process. We had to personally visit the courtroom and interact with the District Attorney, educating them about the case. We managed to get the District Attorney to waive notice, and eventually, the case was expunged.

377.
378.
379.
380.
Case Proceedings:

381.
382.
383.
384.
The case progressed slowly through the legal system. Initially, we prepared the petition and compiled a mitigation package for our client. We served the prosecuting agency and filed the paperwork at the court. However, the case was delayed, and despite frequent follow-ups, we were advised to keep checking back. It was only after we aggressively pursued the matter in person in the courtroom, confronting the deputy District Attorney, that we achieved results.

385.
386.
387.
388.
Outcome:

389.
390.
391.
392.
The case concluded with an expungement for our client, enhancing her competitiveness in the teaching market. Following the expungement, she quickly secured a job, allowing her to declare that she has not been convicted of any misdemeanor, preventing potential employers from considering this charge.

393.
394.
395.
396.
Role of Your Firm:

397.
398.
399.
400.
Our firm’s decisive actions, specifically our presence in the courtroom and direct approach with the prosecutor, were instrumental in achieving the desired outcome. Without our advocacy, the file might have remained unresolved. Our efforts led to a successful outcome for our client, enabling her to continue her job search and ultimately become a full-time teacher.

401.
402.
403.
404.
Client Impact:

405.
406.
407.
408.
Our client is now a full-time teacher in a Southern California school district. Without our intervention, she might have remained a substitute teacher. Thanks to our help, she now enjoys the salary and benefits of a full-time teacher, along with job stability, avoiding the uncertainties of substitute teaching.

415.

416.
417.
The specific criteria for qualifying for expungement, particularly in a case such as this one, involve completing your probation without any incidents. If there is a probation violation, then it will make obtaining your expungement more difficult. It’s also important that you have not committed any new crimes and that you have no pending cases within the Criminal Court system. In addition, the courts will check whether there is any money outstanding. In other words, they want to know if you have paid your fines. This is assuming that you are able to navigate the bureaucracy.

422.
How long does the expungement process typically take, and what factors can affect its duration?

423.

424.
425.
Many factors can affect the length of an expungement process. The biggest factor is the court’s caseload and the prosecutor’s caseload. Often, these two do not align, so one may be ready to proceed while the other is not. If there is a mismatch, it can delay the process by additional months. However, expungements at the Long Beach Courthouse generally take about four to six months.

430.
Are there any specific challenges or obstacles to expect when dealing with courthouses known for slow processing, like the Long Beach courthouse?

431.

432.
433.
Yes, when dealing with specific challenges such as those at the Long Beach courthouse or other courthouses known for slow processing, such as the Glendale courthouse, it’s important to be proactive. Being proactive means contacting the courts and the prosecuting agency. It’s crucial that your attorney checks up on the case to ensure it doesn’t get lost in the system.

438.
How does a misdemeanor conviction, especially for a minor offense like serving alcohol to minors, typically impact job prospects in various fields?

439.

440.
441.
A misdemeanor conviction, even for minor offenses like serving alcohol to minors, can impact job prospects in fields like teaching, where dealing with children is involved. It’s not so much about the seriousness of the crime as it is about the relationship of the crime to the job. For example, a CPA might not face much trouble for domestic violence, but a less significant crime, such as petty theft, would cause more issues. This also applies to nurses; domestic violence may not be as detrimental for a nurse, but a DUI, drug addiction, or drug possession can be catastrophic.

446.
What kind of evidence or documentation is needed to support an expungement petition effectively?

447.

448.
449.
To effectively support an expungement, helpful documentation includes letters from therapists, a letter from the defendant, reference letters, and community service paperwork.

456.
457.
Typically, our cost to expunge a case ranges from $950 to $1,500. It is on the lower end for cases without any probation violations and on the higher end for cases with probation violations and a complicated history.

The legal challenges included his inability to attend DUI court due to his demanding work schedule, necessitating a solution like home confinement. This was a challenging option to secure, as home confinements are more common for second DUIs than for third ones.

512.
513.

527.
The case progressed through the legal system, from arraignments and pretrial for the second DUI to negotiations for a disposition allowing house arrest or home confinement. The third DUI complicated matters further, requiring a similar approach with the arraignment and pretrial, and posed challenges with the judge and prosecutor.

In many of our cases, we have successfully managed them discreetly, often resolving the cases without our clients needing to appear in court.

559.
560.
In cases with complex job-related constraints, such as those involving travel in the medical field, we meticulously gather and inventory all details of our clients’ responsibilities before starting negotiations. This approach differs from other attorneys who may initially agree to certain terms and then add the client’s specific requirements later.

566.

567.
568.
For third DUI cases, several alternative sentencing options are available to avoid jail time. One common option is the DUI court program, an intensive outpatient program requiring regular check-ins. Another option is house arrest, where a person pleads guilty and then applies for it, as was the case in this scenario. Additionally, there is an option where a person completes their sentencing before the plea to obtain pre-credits, often used when a person has a challenging past and might struggle with securing or completing house arrest.

581.
How do you negotiate with judges and prosecutors in cases with multiple DUI charges?

582.

583.
584.
Negotiating with judges and prosecutors in multiple DUI cases is complex. Prosecutors often seek jail time, while judges aim to facilitate the justice system, balancing deterrence, punitive measures, and rehabilitation. It’s crucial to understand the tendencies of each judge and prosecutor in the room for effective negotiation, knowing when to discuss certain issues like presets and credits.

627.
In a recent case that our firm took to court multiple times, we achieved a remarkable success by getting the case dismissed for our client, a massage therapist, who was wrongfully accused of solicitation for sex or what is otherwise known as a 647(b)(1) charge.

628.
629.
630.
631.
Case Overview: The accusation stemmed from an undercover operation conducted by Buena Park law enforcement officers at a massage parlor. Our client, working as a massage therapist, was alleged to have offered a sex act for money to an undercover officer. This sex act wasa happy ending.

632.
633.
634.
635.
Incident Details: The operation involved several officers, some in plain clothes and others in uniform, conducting surveillance at the massage parlor. The undercover officer, posing as a client, received a massage from our client. During the session, it was alleged that our client made gestures and comments implying an offer of sexual services for additional payment. However, as it came down to money, our client did not say anything. The officer tried to enlist it a price for the happy ending however. She remained silent and finished off the massage.

636.
637.
638.
639.

640.
641.
642.
643.
Evidence and Proceedings: Despite the allegations, the case against our client was weak. The police wanted to go forward with it. And the Orange County district attorneys also wanted to go forward with it. The evidence relied heavily on the subjective interpretation of the undercover officer’s experience and lacked concrete proof of solicitation. All they had was. Offering a sex act, but it was not an exchange for money.

644.
645.
646.
647.
Defense Strategy: Our defense was aggressive and fact-based, challenging the reliability and interpretation of the undercover officerâ€s narrative. We scrutinized every detail of the officerâ€s report and highlighted the lack of definitive evidence to support the charges of solicitation.

648.
649.
650.
651.
Outcome: Our persistent efforts in court, backed by a strong defense strategy, led to the case being dismissed. This was a significant victory for our client, who faced serious allegations that could have impacted her professional and personal life.

652.
653.
654.
655.
Impact on Client: The dismissal of the case allowed our client to continue her profession without the burden of these allegations. This outcome underscores our firm’s commitment to defending the rights of our clients and our ability to handle even the most complex cases effectively.

656.
657.
658.
659.
Conclusion: This case is a testament to the importance of a thorough and aggressive defense in cases where the evidence is questionable. If you are facing similar charges or any criminal accusations, our experienced team is here to provide the expert defense you deserve. Contact us for a consultation and let us guide you through the legal process with confidence and expertise.

740.

741.
742.
consequences and long-term impact on the driver’s license record is twofold. The first is that the criminal aspect involves three years of probation for a DUI charge, whereas a Wet Reckless is only one year of probation. On top of that, the fines for a DUI charge in the criminal courts are double that of a Wet Reckless. In addition, a DUI conviction in court triggers an additional suspension and can result in more time being spent on either a suspended or restricted license, whereas a Wet Reckless does not trigger any additional DMV suspension.

743.
On the second fold, a Wet Reckless conviction stays on for the purpose of insurance assessments and affects your premium for three years. This is different from a DUI charge that stays on your record for insurance assessments for 10 years.

749.

750.
751.
The rising blood alcohol defense is a successful DUI defense that has been around for a long time. It is based on well-grounded science. The rising blood alcohol defense played a part in this case because the blood alcohol or evidential test was 0.09. In addition to that, the preliminary alcohol screening test was at 0.08 in this case. This painted a picture that our client had recently stopped drinking and the alcohol was still absorbing. In other words, the argument that we were prepared to make was that our client was below 0.08 at the time of driving and it was not until the test, which was 20 to 30 minutes later, that his alcohol level went up. Therefore, he was below 0.08 at the time of driving. In addition to that, because this was a DUI checkpoint case, there was no officer observation as far as them observing him drive. In other words, his driving was perfect, and he drove into the checkpoint.

779.
Case Background:

780.
781.
782.
783.
We represented a client at the Fullerton courthouse who received a DUI in 2020. Her situation was unique because she had a DUI but decided not to drive anymore. Consequently, she chose not to participate in the AB 541 or first offender DUI class. Additionally, she had multiple delays in completing her community service. We took on this case after she failed to pay and faced multiple probation violations. The client eventually reached out to us.

784.
785.
786.
787.
Client Profile:

788.
789.
790.
791.
Our client was a Korean female professional with her first DUI.

792.
793.
794.
795.
Charges or Allegations:

796.
797.
798.
799.
The legal issue in this case was whether the client could skip the DUI classes altogether. Normally, people take these classes as a prerequisite for regaining their license. However, our client, not concerned about getting her driver’s license back, decided to skip them. This created problems with the court, which was unsure of its authority to overlook the classes. Additionally, the client’s follow-up on her obligations was unsatisfactory; she failed to complete her classes.

800.
801.
802.
803.
Legal Challenges:

804.
805.
806.
807.
The legal challenges in this case involved convincing the judge to allow our client to forego her DUI classes. Moreover, our client had multiple opportunities to complete her community service hours but faced significant follow-up issues. An arrest warrant had also been issued for her, complicating the situation when she approached us.

812.
813.
814.
815.
Defense Strategy:

816.
817.
818.
819.
Our primary goal was to clear the arrest warrant for our client, allowing her to move freely in public without fear of arrest. Regarding community service, we had our client start before the court hearing, giving the judge confidence to give her another chance. We successfully convinced the judge to overlook the DUI classes, acknowledging on record that these were mandatory for regaining a driver’s license. We also aimed to terminate her probation, though she is still on probation, with a goal to end it at three years.

820.
821.
822.
823.
Case Proceedings:

824.
825.
826.
827.
The case lasted two years until the client sought our help to remove the warrant, give her additional chances, and terminate probation. The key hearings involved recalling the bench warrants and addressing the probation violation.

828.
829.
830.
831.
Outcome:

832.
833.
834.
835.
Ultimately, our client was given another chance to complete her community service, and she was not required to attend the classes. Upon completion of her community service, the judge will consider terminating her probation. This consideration comes despite the challenges because the client has been on probation for a substantial period.

836.
837.
838.
839.
Role of Your Firm:

840.
841.
842.
843.
Our firm made a significant difference in convincing the judge to give our client another chance, despite her past mistakes. Due to our advocacy, the judge was willing to overlook these mistakes, give her another chance, and consider a motion to terminate probation after completing her community service hours.

844.
845.
846.
847.
Client Impact:

848.
849.
850.
851.
As a result, our client can move on with her life with another chance. We understand that everyone makes mistakes, and at our office, we empathize with those who err and do not judge them, unlike other firms.

867.
We’re excited to share a recent triumph at the Westminster Courthouse where we achieved a dismissal for a client charged with public intoxication. This outcome was the result of persistent efforts and multiple court appearances in the pretrial process, culminating in an agreement with the prosecutor for charge dismissal in exchange for attending classes.

871.
Our client, a dedicated college student with a promising future and no prior criminal record, found themselves in a challenging situation. According to the police report (below), officers were called to a location due to a report of a suspicious individual attempting to enter a vehicle. The individual, believed to be under the influence, was mistakenly trying to access a vehicle that was not theirs.

872.
873.
874.
875.
Upon arrival, officers noted the individual’s impaired condition, evidenced by slurred speech, difficulty maintaining balance, and a strong odor of alcohol. Despite the circumstances, the vehicle’s owner did not wish to press charges, acknowledging the individual’s intoxicated state.

883.
In court, we emphasized our client’s clean history and the isolated nature of this incident. Our arguments, coupled with a proactive approach in negotiating with the prosecution, led to a favorable decision. The court agreed to dismiss the charges, allowing our client to participate in educational classes instead.

887.
This case highlights the importance of thorough legal representation and the potential for rehabilitative measures over punitive actions, especially for young individuals with their whole future ahead.

973.
974.
At the Orange County Superior Court, a first court appearance in a criminal case is known as an arraignment. This applies to both misdemeanor and felony cases, regardless of the specific courthouse location. An arraignment is your first formal interaction with the criminal justice system, where you’ll have the opportunity to admit or deny the allegations against you.

This preparation is essential as cases may not always be filed by the arraignment date. Note that items like belts, watches, lighters, or sharp objects are typically not allowed. Dressing appropriately and adhering to courtroom behavior standards, like timely arrival and maintaining silence, are also vital. 1033.

1034.
1035.
The implications of not having an attorney present during your first court appearance include the challenges of navigating the process and the uncertainty of whether the offer to resolve your case is fair. An attorney can often attend court on your behalf and advocate for you, determining whether the District Attorney’s offer is genuine or if something is being left on the table.

1041.

1042.
1043.
When called to court, you can request a public defender if you cannot afford a private attorney. To qualify, you must fill out a Statement of Assets form. If the judge determines that you can afford a public defender based on your assets, they will give you about 45 to 60 days to find an attorney.

1049.

1050.
1051.
You are free to ask the judge or prosecutor any questions you want. However, it’s important to note that the judge does not practice law, and the prosecutor advocates against you. It’s not advisable to seek legal advice from them, though you are free to talk with the prosecutor, and there are no rules against it.

1056.
How does the bail process work, and what factors might influence my eligibility for bail or the amount set?

1057.

1058.
1059.
The bail process involves a bond company putting down money on your behalf, for which you pay a premium, usually 10%. This rate can be reduced to 8% if you have an attorney. Factors affecting bail include flight risk and danger to the public. Judges are particularly concerned about public safety in cases like DUIs. Once in custody, you can post bond, which is why having a bondsman ready for second or third DUIs is important.

1065.

1066.
1067.
You can change your plea from not guilty to guilty later, but not the other way around. The exception is if you pursue an expungement after completing your probation and all court-ordered requirements. Then, you can change your guilty plea to not guilty and have your case dismissed.

1073.

1074.
1075.
Failing to appear in court can lead to an arrest warrant. Additionally, non-attendance can prolong your probation if it was set to start on the court date, and delay resolving your case, potentially resulting in a longer suspension of your driver’s license in DUI cases. These are important considerations when planning to attend your court case.

1080.
Can charges be dropped at an arraignment hearing?

1081.

1082.
1083.
There is a potential for your charges to be dropped at an arraignment date. However, the chances are very unlikely. That does not mean the case will not be dropped, however. There is a chance for your case to enter into some type of agreement which will result in it being dropped in the future. In other words, your case can be agreed on to be dropped on the first day of that agreement. In instances where you have an attorney who knows the market rate of the case, he may have you registered for classes or make donations to the victim-witness before the case actually goes to court, which can facilitate having it dropped on that first day.

1089.

1090.
1091.
After arraignment on a misdemeanor, the next thing that happens will be a pretrial court date. A pretrial court date is a way to say negotiations. It is a date where the prosecutor and defense attorney sit down and go over the police report and talk about the proof of the case and the mitigation. Both sides try to arrive at a destination that’s livable for everybody.

1097.

1098.
1099.
Trial typically happens 45 days after an arraignment. If you are in custody, then it’s 30 days. This is your statutory deadline for a trial. In other words, if you do not get your trial within 45 days, then the case can be dismissed. This is assuming that you do not waive time.

1105.

1106.
1107.
The possibility of going to jail on a first court date is real. This is especially true if you have a second or third DUI pending. If you have a second or third DUI, then the court will consider you a danger to the public and want to remand you into custody. When this happens, the only way to get out is to post a bond. This is why it is important to have a bondsman ready at your side on your second or third DUI.

1115.
Yes, there is a potential for you to go to jail on your first court date. If you resolve a case and decide to surrender on the spot, then they will take you into custody and then you will start doing your time. In other cases where you are deemed a danger to the public, the judge will take you into custody, and then you will have to bail out. This was talked about above in second and third DUIs.

1170.
Several services are available at the Harbor Justice Center. The Orange County Superior Court provides criminal clerks for service at the courthouse. With the criminal clerks, you can ask questions about your case, inquire about arrest warrants, DUI probation violations, and look up any upcoming cases you have. Moreover, they also have computer terminals for case lookups and for logging in for your traffic court appearance. Other services available are TV screens that display your case information on the date of court and they also provide spaces for county agencies such as One OC and Victim Witness, so that you can check in and get information about arranging for community service and restitution for your case.

1175.
1176.
1177.
1178.
If you are looking for directions to the Harbor Justice Center, the easiest way is to look for the 405 and exit at Jamboree. Once you are on the 405 and you exit at Jamboree, then head south towards Birch. Make a right on Birch and the courthouse will be on your right-hand side.

1182.
Visitor Tips When visiting the Harbor Justice Center, ensure you have the necessary paperwork. This may include your bail paperwork if it’s a felony, or your citation to appear if it’s a misdemeanor. If you have an attorney, they will advise you on which courtroom to appear in for a felony. For a misdemeanor, due to Penal Code 977 A, they will be able to appear for you so you don’t have to go to court.

1187.
1188.
1189.
1190.
As you prepare for your court visit, it’s important to have your paperwork and know what you are there for. If this is your first court date and you do not have an attorney, then you are likely looking at an arraignment. An arraignment is a court date where you can admit or deny the charges against you. If facing a felony charge, you will have a public defender appointed. For a misdemeanor charge, you will need to fill out a financial disclosure form to determine if you qualify for a public defender. Be punctual, arriving at the Harbor Justice Center by 8:30 AM, and check the TV screen to confirm which courtroom your case is in.

1195.
1196.
1197.
1198.
In many courtrooms, it is standard protocol to play a video advising you of your rights before the judge arrives, especially in department H8. This video discusses your constitutional rights, DA and judge offers, and is important to watch if you are not represented by an attorney.

1203.
1204.
1205.
1206.
The most important advice for your first court appearance is to look at the TV screen to find out where your case is. Once you find your case and the courtroom it’s in, go there and check in with the bailiff. Failing to check in with the bailiff may result in a bench warrant being issued for your arrest. When called up, listen carefully to the judge for any offers or future court dates for your case.

1211.
1212.
1213.
1214.
If you are representing yourself in court ie: going to court for a DUI without a lawyer , the procedure for pleading guilty is straightforward, and the judge will guide you. However, watch the video and listen for any offers that come your way from the Orange County District Attorney or the judge. Be aware that you might not fully understand the implications of these offers and the consequences of different pleas. If you decide to accept an offer, you can enter a plea of guilty or no contest, if appropriate. Remember, there are consequences to guilty pleas, including a criminal record, driver license suspensions for DUIs, or losing your gun rights in domestic violence cases.

1219.
1220.
1221.
1222.
The progression of a criminal case at the Harbor Justice Center varies. For traffic cases, there are two proceedings: the arraignment and the court trial. The arraignment is where you enter a plea of guilty or not guilty, and the court trial phase is where you can resolve your case or fight it based on its merits. For a misdemeanor case, it starts with an arraignment in department H8 for first-time DUIs or H2 for repeat DUIs. After the arraignment or entering a plea of not guilty, the pretrial process begins within 30 to 45 days. During the pretrial, you negotiate your case and potentially obtain any relevant video or audio. If you cannot resolve your case at this stage, you may have a 1538.5 hearing or a jury trial. A 1538.5 hearing examines any violations in your case, while a trial involves 12 jurors deciding whether the District Attorney has proven their case in court.

1243.
1244.
1245.
1246.
The Harbor Justice Center’s court hours are from 8:00 AM to 5:00 PM, Monday through Friday. Most court operations start at 8:30 AM and end at 4:30 PM. As for security procedures, there is one main entrance with security checks. Do not bring lighters, weapons, drugs, or any illicit items into the courthouse for safety reasons. For information on arraignments or to check hearing dates, visit occourts.org. If you are facing a felony or a second or third DUI, be prepared to post bail, as repeat DUIs often raise public safety concerns. The court may remand you into custody if you’re considered a danger to society. Consult an attorney to ensure you can stay out of custody.

1249.
1250.
Conclusion

1251.
1252.
1253.
1254.
Facing criminal charges can be life-changing and may result in jail time. It’s important to take the right steps and consult an attorney about your options. Seek legal assistance and support as you navigate your criminal journey. While many cases may end with probation, it’s crucial to understand the severity of your charges, particularly those with potential jail time exposure, versus probation and a conviction on your record.
