  78. <content:encoded><![CDATA[<p> U.S. Public Sector Labor PolicyThe public sector comprises the largest section of organized labor in America and continues to grow. Educators, nurses, police officers, and government employees have become heavily unionized or involved in other professional organizations. Although most of the major pieces of labor legislation exclude public employees, they will be increasingly important to understand them as governments continue to outsource administrative, strategic, and other professional work.[1]Employees who engage in collective bargaining use a variety tactics causing slowdown, shutdown, or sick-ins. While the private sector can absorb these tactics, the public sector cannot. Often, key employees such as police or firefighters will strike at critical times, putting the public at a severe detriment for their own greed. Millions of dollars and lives are in the hands of Americas civil servants, thus effective public policy affecting collective bargaining is important to the success of the nation. The largest public sector union is organization is the American Federation of State, County, and Municipal Employees (AFSCME) which covers employees of local and state governments, has a membership of 1.3 million and dates back to 1936.[2] Unionization is strong at this level with some 60 percent of eligible public employees belonging to a union or other professional organization. [3].Putting U.S. Public Sector Labor Policy on the AgendaThe issue has been put on the national agenda because of the ability for public sector unions to mobilize a bloc vote and the threat of a strike should they become unhappy with using political conditions. Public employees have bolstered their organization for both reasons involving pay and working conditions. Safety has always been a key bargaining point for many unions, especially those in hazardous occupations. Strikes are very dangerous to the public sector because they often involve first responders or employees in key positions.For example, in 1981 13,000 professional air craft controllers belonging to PATCO went on strike attempting to leave planes to their own devices and guidance causing what could have been a national emergency, simply because they wanted better wages. President Ronald Reagan quickly fired over 70 percent of them sending a clear warning that a strike of this magnitude would not and could not be tolerated by the American Public.[4]Key Actors Shaping U.S. Public Sector Labor PolicySince the early 1960&#8242;s federal employees have been able to organize and engage in collective bargaining through an executive order issued by President Kennedy which granted federal employees the right to unionize and engage in collective bargaining. [5] This is a statement that while congress is not a key actor in shaping labor policy for the public sector, the executive branch is. However, the Presidents role in shaping labor policy changes whenever the turnover in the office occurs. Different Presidents simply have different policy prescriptions to unionization problems.Individual states are largely responsible for state, county and municipal employee union policy and here, the state legislature does have considerable power in shaping public policy regarding unions. Many states have rejected the rights unions under what is called the privilege doctrine, it states that: employment in government is not a right but rather a privilege.[6]  This is legally defensible and rooted in common law.[7]<br />

Under the Minnesota Labor Relations Act, employers cannot intimidate or discourage union activity employees have a limited right to strike, an employer cannot institute a lockout which involves locking employees out from work,  or take action against an employee for being involved in a union or other collective bargaining agency.[8]The Future of Public Sector Labor Policy in the U.S.Certain government employees are very difficult to replace while others can be outsourced. For example, should all the firefighters strike during a crop burning that leads to massive damage, perhaps they should be held liable for damages. In the private sector, unions and management act in an adversarial system, but in the public sector this is not so. This could mean that a manager is less likely to fire an employee simply because he is a member of the union. This leads to retention of incompetent employees and government ineffectiveness.This is a crisis that many future administrators will face and learn to deal with. As the public sector unionization rate continues to increase even while its private counterpart decreases, key actors in public policy must began to look at how to best shape U.S. public policy to deal with public sector unionization.Current labor policy is likely to continue at the federal level, at least until a President with an active interest in changing it emerges. However at the state level, change happens all the time. States are laboratories of democracy and can shape policies affecting those in their employ. One thing to bear in mind is that there is not a substantial labor party in the United States and this will always hinder union activity as it has less of a voice at the table.French Public Sector Labor Policy The French public sector is alive and very strong, with a threat of a strike looming from many areas of the public sector at all times. It is the largest sector of labor in France and unlike America; government is considered an honorable and coveted profession. In the face of recent threats of public sector work stoppages and possible violence, French President Nicolas Sarkozy has tried to keep the nation calm. &#8220;I say to everyone-be very responsible, be very calm and show a great deal of composure&#8230;This country does not need violence, manipulation on top of all the other problems it has.However, his speeches will not make transportation systems run when they are thrown into &#8220;nationwide chaos&#8221; by disgruntled unions this fall.[9] Unionization is 5.2 million strong in France but is comprised of trade unions that are aligned under loosely under a variety of different political terms.[10] The public sector has a sense of elitism that separates it from its would be comrades in the other trade unions, however, certain events or disturbances will cause the unions to form temporary alliances and fight a common cause.Putting French Public Sector Labor Policy on the AgendaPart of the reason that unions are reacting so severely to is the recent public policy announcement from President Sarkozy to cut 22,000 jobs in the public sector.[11]The French economy simply cannot afford to support needless jobs and over-inflated unionization of public sector. President Sarkozy stated that he does not want to eliminate the bureaucracy; rather he wants to make it better and sharper. &#8220;I want a public service that is smaller, better paid and with better career prospects&#8221;, he said.[12]The political movement in France has been a conservative one for some time. It has taken over what was a socialist regime and has made strides against a resistant public sector that is use to bloated salaries and comfortable benefits.[13]Key Actors Shaping French Public Sector Labor PolicyThe key actors shaping French labor policy in the public sector are clearly the public sector, the Executive branch and to some extent the news media. Depending on how closely the unions choose to unite, they can be quite a formidable force, they have been in the past and will probably continue to be in the future. However, the Executive also sets the policy of for the nation and under former liberal and socialist regimes, policies were much more union friendly then they are now.[14]The media chooses which side to take on the issue and while it seems that the mainstream media sources, such as the BBC, have become turned off by unionism and complaining of public servants, there seems to be a strong underground current of socialist literature that floods the web tends to defend unions and civil servants. This could also mean that the socialist party is a key actor in shaping French labor policy in the public sector as it was for some time.The Future of Public Sector Labor Policy in the France France is headed for a number of years that will be riddled with strikes and economic uncertainties. There exists a strong socialist culture in the public sector of France, yet there is currently a conservative administration, these two actors are clearly at odds with each other.The outcome of the policies of the Executive will depend on whether or not the unions can build coalitions, remain strong through considerable economic strife, and regain the news media on their side. If they fail, then the executive will be successful in breaking them and the strategy of not caving in to demands will work, if they are successful, then the Executive strategy of non-cooperation will fail.One of the two sides must break and whoever has the news media on theirs will be better suited to win this battle. Thus the policy could either remain very conservative or gradually move back towards socialist ideas. In a state on its fourth constitution, anything could happen!Similarities Between U.S. &#038; French Public Policy Both France and the United States had strong Executive control over labor policy in the public sector. It seems strange the Legislative branch has very little say in the arena of the public sector in either nation. While Congress has had a large impact on unions in the private sector, it has had almost none in the public sector and is rarely even cited, the same applies for France as their private sector unions are fairly weak.Historically, both countries have had strong public sector unions however; the massive backlash that the unions in France are facing now, already hit the American public sector in the 1980s. This has allowed for the French public sector to continue union militancy through strike and shut down, but forced U.S. civil servants to learn political tactics of achieving their goals and surviving.U.S. Presidents and French Presidents have handled the situation much the same way, but as said, the U.S. went through it in the 1980s and France did not really start going through it until the mid 1990s. The tactics are basically the same, both countries have taken a zero tolerance policy to striking and stuck with it, and it seems to be working. Eventually, Unions in both counties will have to find new ways to survive in increasingly conservative administrations and less public support for their causes. </p>

You are probably not going to try to risk drunk driving, which is a good thing, and now you are willing to wear a seat belt because those tickets are getting quite expensive. You also realize that many of the signals now have cameras on them in case you try to run a long yellow light, as you know they will catch your license plate on camera.But did you know that traffic laws also have to do with noise, and one modification of your exhaust system could get you a $10,000 fine because you are modifying a part of your car that has to do with the emissions. In places such as California we have smog tests, and your car must pass, but if you take off the catalytic converter, drill out holes in the center, or modify the exhaust to give you increased efficiency, or a louder sound you could find yourself in a heap of trouble.If your car is louder than the allowable decibel rating, you could get a ticket for noise. And if you get a ticket for noise, the officer can check to see if you&#8217;ve made any modifications, and if they find any modifications have been made, you could get a $10,000 fine for modifying your exhaust system, and on a second offense they can impound and take your car. So much for trying to keep up with the &#8220;Fast and Furious 5&#8243; Hollywood movie, yes, that was a great movie, but you know what they say; &#8220;don&#8217;t try this at home!&#8221;The same thing goes for motorcycles, and whereas many motorcycle riders like loud exhaust pipes, because it alerts drivers who have their air conditioning, and radio blasting, and/or are distracted by their text messaging, or iPhone &#8211; that those loud pipes will make so much noise they will wake the drivers out of their trance so they don&#8217;t pull out front of you. No longer can you get away with loud exhaust pipes, because there are now sensors that some cities are buying which will take a picture of your license plate if your exhaust is too loud or your car is too noisy, just as the signal cameras do.Is this legal? Can the cities and the state actually do this, and send you a ticket in the mail? Yes absolutely, and if you get a fix-it ticket for loud exhaust, you must bring your car in, and you better make sure that you&#8217;ve had it modified back to original, or you could get that $10,000 fine I keep telling you about, even if it&#8217;s quiet now, simply because they will check to see if you&#8217;ve made illegal modifications at that point. In other words you could easily take your car in to get the fix-it ticket checked off, and leave walking back home because they&#8217;ve impounded and taken your car. And yes it is all legal, because that&#8217;s the law. </p>

  127. <content:encoded><![CDATA[<p> AbstractLeadership and management have been the focus of study and attention since the dawn of time.  Over time leadership and management have been seen as separate entities, but those times have past.  It is this paper&#8217;s intent to prove that good management is incumbent upon the success and quality of the leadership that drives it, and by proxy, so too will poor leadership bring poor management that will lead to poor results, and decreased levels of success.From the great minds in management theory: Fayol, Taylor, and Weber; homage being paid to Barnard and Mayo, as well as Maslow, Mintzberg, Drucker and Porter; to the great minds in leadership development: Jung, McClelland and Burnham, this paper intends to examine them all and bring them together as is required in this economy and these times.Much time, effort, and money has been placed into the study of both management and leadership successes.  Mintzberg and Drucker have done some of the best and most informative work at bringing management and leadership together; now, with the rising costs of overhead and decreasing profit margins, now is the time to connect the dots, once and for all.Leadership and management have been the focus of study and attention since the dawn of time.  Reference biblical scripture that questions the leadership decisions of King David and the managerial prowess of Moses and his exodus to the &#8220;Promised Lands&#8221; (Cohen, 2007); Plato helped us to manage the Republic while Machiavelli helped us to formulate our idea of what a Prince should represent (Klosko, 1995); Shakespeare questioned Hamlet&#8217;s decision making (Augustine &#038; Adelman, 1999) and trumpeted Henry IV&#8217;s managerial effectiveness (Corrigan, 1999).  John Stuart Mill gave us the &#8220;shining city upon a hill&#8221;, while Hegel taught us the &#8220;elements of the philosophy of right&#8221; and Marx taught us how to manage a people in his overly popularized (and oft misunderstood) manifestos (Klosko, 1995).  Thomas Payne rewrote leadership to the basic levels of Common Sense, while Thomas Jefferson acknowledged that in the management of a people, you must remember that &#8220;all men are created equal&#8221; and that they maintain certain degree of&#8221;unalienable Rights&#8221;.  Countless others have come to the surface over the span of time, all promoting a new or improved way to both manage and lead their people. (And hopefully yours, too, if you&#8217;re willing to pay for it.)  However, through it all, one thing has remained constant; people are not autonomous entities that will respond the same to every situation.  People are evolving, thinking, emotionally and socially aware of all that is around them; they are motivated through different methods and they are driven by differing levels of success (McClelland &#038; Burnham, 1995).  Over time, leadership and management have been seen as separate entities, but no more: it is, therefore, this paper&#8217;s intent to prove that good management is incumbent upon the success and quality of the leadership that drives it, and by proxy, so too will poor leadership bring poor management that will lead to poor results, and decreased levels of success.  In today&#8217;s fast paced environments, management requires leadership; you cannot have one without the other and still attain the success that you desire.Reference any management text or publication and you will inevitably come across the obligatory references to the great minds in management theory: Fayol &#8211; the first to recognize management as a &#8220;discipline&#8221; to be studied (Brunsson, 2008), Taylor&#8217;s scientific management of industrial work and workers (Safferstone, 2006), and Weber&#8217;s bureaucracy; homage must also be paid to Barnard, Kotter, Bennis, and Mayo, as well as Maslow, Mintzberg, Drucker, and Porter (Lamond, 2005).  These great minds have helped to forge the way for the management field and helped to better management teams across the world.  The world of &#8220;leadership study&#8221; carries quite the similar pedigree; ironically, it also carries many of the same names.  It is, however, this author&#8217;s opinion that many of the additions to the pool of knowledge on leadership were not made known until the study of psychology was made more fashionable by the likes of Freud and Jung.  Management, it appears, is a tool to better the bottom line and productivity, whereas leadership is one of those studies that is to be improved through the person&#8217;s ability to be in touch with their personality, traits, motives and effects on the human elements of productivity.There appears be some coincidence in the timing of the juxtaposition of the terms &#8220;management&#8221; and &#8220;leadership&#8221; and the correlation to the fact that most literature post 1950 seems to cross pollinate the two phrases.  It is quite possible that this, the historical time for post war boom, is where production was at record highs and management of production was not as key as the management of people  Possibly drawn from a social recognition that people were not to be managed, but rather, they were to be valued members of the team, and therefore, to be led &#8211; it is speculative, but it appears evident that entering the 1960&#8242;s, most literature intertwines the &#8220;leaders&#8221; and the &#8220;managers&#8221; into the same professional classification.Carl Jung (1923) posits that people carry specific traits and that those traits cannot be altered. However, much time effort and money has been placed into the study of both management and leadership traits, tendencies, styles, and successes.  Why is this?  One belief is that Jung only half analyzes the person and that more than your traits influence your leadership potential (de Charon, 2003).  This affords the opportunity for you to learn skills necessary to become a better leader, even if that means understanding who you are and what your tendencies are, in order to counteract them.  Jung&#8217;s work with personality traits has become the hallmark to virtually every professional development and personal development course on the market.  Jung stipulates that every person has any combination of sixteen different personality types. By definition, knowing these personality types helps you to better negotiate your way through the situation in order to attain the maximum output desired (Anastasi, 1998).Running in concert to Jung&#8217;s ideas are those of Henry Mintzberg.  Mintzberg stipulates that much has changed since Fayol&#8217;s assessment in 1916; gone are the days when the &#8220;picture of a manager was a reflective planner, organizer, leader, and controller&#8221; (Pavett &#038; Lau, 1983). Mintzberg breaks the manager&#8217;s job into ten roles, divided into three areas: interpersonal, informational, and decisional (2004):Interpersonal Roles<br />

(Lussier &#038; Achua, 2007).Ironically, in today&#8217;s interpretation of a leader, one would be hard pressed to find a leader whom is unable to do all of the above, and then some.  Mintzberg, in later publications, however, goes much further in his assessment of managers and their roles in the organization.  In a collaborative effort with Jonathon Gosling, the two determine the five mindsets of a manager (2003).  They break the five mindsets into:1.    Managing self: the reflective mindset; where the effective manager is able to reflect upon the history (current and aged) to create a better future moving forward.2.    Managing the organization: the analytical mindset; here referencing a tennis match, where the manager must be cognizant of the crowd and their reaction, but also focusing on the ball itself.3.    Managing context: the worldly mindset; thinking globally and looking for the unorthodox solution.4.    Managing relationships: the collaborative mindset; where the manager is able to engage the employees and moves beyond empowerment [which "implies that people who know the work best somehow receive the blessing of their managers to do it (Kibort, 2004)] into commitment.5.    Managing change: the action mindset; &#8220;imagine your organization as a chariot pulled by wild horses.  These horses represent the emotions, aspirations, and motives of all the people in the organization.  Holding a steady course requires just as much skill in steering around to a new direction&#8221; (Gosling &#038; Mintzberg, 2003, p. 54-63).Gosling and Mintzberg conclude with one very interesting point.  They stipulate that, unlike Pavett &#038; Lau (1983) that good managers are able to look beyond the desire to fix problems with simple reorganizations.  In fact, they argue that hierarchy plays a very small role in the actual completion of tasks on the unit level and can only lead to more bureaucracy.  Which leads one to ask the question: who is to complete those unit level tasks and solve those problems associated with people?There is no definitive definition of what leadership is, as it appears to change form and focus for each individual study.  For the purposes of this paper, however, the definition set forth by Lussier &#038; Achua (2007) seems to fit best:  &#8220;Leadership is the influencing process of leaders and followers to achieve organizational objectives through change&#8221; (p.6).  How do we compare leadership and management?  The common misconception is that it is something that should be compared &#8220;straight up&#8221;, or &#8220;even Steven&#8221;.  Obviously, there are natural leaders and persons in positions of social authority throughout every facility, and yes, it is incumbent upon the managers and leaders to empower those people to support the overall mission. Admittedly, some of these people may never become managers, but their role in the facility is of the utmost importance.However, as managers are an industry specific entity, it is ridiculous to try and compare leadership to management outside of the constraint of the management role.  Recognizing and accepting the constraint of the comparison, it must be acknowledged that in industry, you cannot have good leadership without good management; and in obvious juxtaposition, poor leadership leads to poor success rates for the management.  It seems apparent that our management staffs should concentrate on growing employees into leaders, to eventually become managers; but if the managers themselves are not leaders yet, then much difficulties will soon befall upon that company.  As Peter Drucker will tell you, it is imperative to build a strong management team, centered around strong leadership.  In thinner times, gone are the days of two people for every position.  Here are the days when a successful company is able to package good managerial skills into every leader, and good leadership skills into every manager.  Failure to do so will result in failure to succeed.&#8221;Drucker devotes considerable effort and space to defining the nature and role of management. This discussion also focuses on the nature and value of leadership in the organization. According to Drucker, leadership gives the organization meaning, defines and nurtures its central values, creates a sense of mission, and builds the systems and processes that lead to successful performance&#8221; (Wittmeyer, 2003).References<br />

Let us just declare it is not an &#8220;achievable&#8221; state of being, as it is always there, and cannot be gained or lost. Love is us, what we are made of. But i do not want to get to deep into this subject now, as nutrition, or actually a vegetables based diet, is the real subject in hand.A very important fact we need to remember about food is that while being so available in such vast quantities, we actually need very little of it. If we have some breathing issue for example, it is usually very difficult to leave everything and move to a different city or region where the air suits our needs, whether it has more or less moist in it, less pollution, and so on and so forth.Changing our drink is also usually hard, as we call many things &#8220;drinks&#8221;, and there are pretty addictive, while the only real drink we have is water, which is the most addictive of them all, due to the reason our body recognizes itself in the water we drink, as we are almost completely made out of water. All the soft &#8220;drinks&#8221; are hard to quit, and i am not even mentioning coffee or tea.Shelter is also a tough one to change. Moving into a new home is not easy, and not always an available option, and many times we end up in a building where the neighbors are not exactly our cup of tea, or the surroundings are not the right type for our character.All these issues effects our mind-body-spirit connection and arrest our development. Eating a lot, more then we need, will consume our energy. Eating the wrong food, in the wrong combination will do just the same. The same result will come from eating at the wrong time and the wrong state of mind, using food to sooth our painful souls.While a simple change in our diet will allow our body to have the energy it needs to deal with the rest of the issues of life. The focus can be then taken out from the very demanding digestion and put to the right use. The change can be felt within a couple of days, and sometimes, for the more aware people, within one meal. Try it, and make a change to a diet consisting of mostly grain, fruits and fresh vegetables.Nutrition is a tool in our hands to be harnessed the right way for the best benefits. Let us use our toolbox wisely, taking out the right tool for the job. </p>

(a simple interest rate of 12% &#8211; 22%) The payback term is typically two to four weeks and the payments are automatically debited from the same consumer bank account that the funds were deposited into at the time of the loan. Opponents of payday loans argue that if the percentage rate on one of these loans is amortized over a full one year period, the annual percentage rate (APR) can reach or exceed 200%. Certainly an APR of 200% does seem outrageous, but that also begs the question of, &#8220;Why would opponents of payday loans- or anyone for that matter, attach an annual percentage rate to a loan that only covers a two to four week period?&#8221; We begin to see the self-serving purposes of the real villain when this question is answered.Most groups that are vehemently opposed to short term personal loans and the payday lenders who offer them are made up of large banks and other traditional lenders. They claim that they oppose payday loans in the interest of protecting American consumers. In reality, if we look at a typical scenario involving these so called &#8220;protectors&#8221; a different story takes shape.Let&#8217;s say for example that a consumer who has the average bank checking account runs short on cash and needs an extra $200 until the next payday in order to pay a couple of small bills or buy groceries for their family.The odds of getting a loan from the bank in less than 24 hours for even a small amount are slim to none, especially if the consumer in need has anything less than perfect credit. Without the option of getting a fast payday loan, the consumer may be forced to go ahead and write checks for those bills knowing that there won&#8217;t be enough money in the bank to cover them. Overdraft fees at most banks come in at around $35 per bad check and are automatically debited from the consumers account as soon as the next deposit is made. If that deposit is made after the end of the billing month, additional late fees may be added &#8211; further increasing the amount owed to the bank!Now let&#8217;s say the consumer had to write 3 small overdraft checks that total $100 to pay those bills, the $35 fee is a per check fee so if the consumer writes three overdraft checks that total $100, the fees the bank charges to the consumer would be $105 or $35 for each bad check written. (a simple interest rate of 105%) If we amortize that amount into an annual percentage rate &#8211; as the banks do &#8211; when they argue against payday lenders, the bank interest rate on overdrafts exceeds 1,000% annually before late fees are added.To make matters worse in this hypothetical bank account overdraft situation, the consumer will most likely be charged between $20 &#8211; $45 by the three vendors to whom the bad checks were written, therefore the cost for NOT having access to a payday loan climbs even higher. Additionally, knowingly writing a bad check is against the law and punishable by jail time in most states. Despite what the big corporate banks and their lobbyists might wish for you to believe, when we take an objective look at the real world it starts to become very clear that payday lenders actually offer a valuable service to middle and low-income consumers who otherwise have limited options with a standard bank account.American consumers need payday lenders. If there wasn&#8217;t a need for payday loans and it wasn&#8217;t a viable solution to an existing problem, the business would not be flourishing throughout the country. &#8220;Traditional banking institutions just don&#8217;t offer the flexibility and distribution of short-term cash loans the way payday lenders do&#8230; so it is an industry that has actually filled a void for many Americans &#8211; most of whom use the service wisely and effectively.&#8221; says William Janus, owner of three payday loan stores in Missouri.The argument for and against payday loans promises to continue and grow throughout the coming year and at the head of the pack opposing payday loans will most likely be those villains disguised as bank presidents who view the payday loan industry as encroaching upon their gluttonous profit margins that are conveniently hidden in overdraft and late fees. All the while they charge these outrageous fees in the name of &#8220;protecting&#8221; the American consumer.To protect yourself, make sure you are aware of any and all bank fees that you may be subjected to and if those fees are subject to being compounded or augmented by late fees and added interest.   246. <content:encoded><![CDATA[<p> Garden design is not just the ability to create a beautifully illustrated plan, although this is one of the many outputs of the garden design process and arguably the most exciting. A garden designer&#8217;s role is to find creative, practical solutions to the many technical challenges presented by an outdoor space. A good garden designer can make a garden that is useable and suitable for a specific set of requirements as well as being beautiful and a pleasure to spend time in.It would not be possible to describe fully how to design a garden in a single article. A great deal of training and experience is required to understand how to obtain the correct ratio of mass to void in a garden design scheme, or how to create rhythm in a garden design, or working with shapes to ensure the garden flows and feels comfortable to use. So, the following paragraphs outline major steps in the garden design process and I will go into more detail about each phase in separate articles.1. Decide on the requirements for the gardenBefore considering aesthetics it is necessary to understand the practical requirements for the garden such as how it will be used, by whom and who will look after it. Answering a series of questions is the best way to arrive at the requirements. These are the kind of questions that need to be answered to arrive at the requirements:-• How much time is available to look after the garden?• Will a professional maintenance company/garden be looking after the garden?• Will the garden be used by pets or children?• Does the garden need to cater for elderly or disabled visitors?• Will the garden need to cater for users with mobility problems?• Will the garden be used for eating and entertaining?• How many people will want to use the garden at one time?• Is the garden owned by a keen, knowledgeable gardener?The aim is to arrive at a list of requirements which forms the basis of the design process.2. Get inspiredExperienced garden designers know the value of regularly looking at all forms of art and architecture in order to keep their &#8216;visual vocabulary&#8217; up to date and get inspiration for their designs. Inspiration can come from a shape in nature like an old, gnarled tree, an architectural detail on a building, a combination of shapes and colours in a painting, almost anywhere if you are looking with a creative eye.Look at materials, interior and exterior. Textures and patterns in wall and floor tiles, stone cladding, marble mosaics, etc are a great source of inspiration and can result in a piece of detailing that lifts the garden design scheme out of the mundane. Visit landscaping supply yards, reclamation yards and interior design suppliers like the Design Centre in Chelsea Harbour in London.Visit some gardens, look in gardening books and magazines, go to some garden shows like the RHS (Royal Horticultural Society) Chelsea Flower Show and Hampton Court Flower Show and look at the show gardens.3. Take the site surveyTake a thorough site survey and analysis. Measure the house including the position and height of all doors and windows. The survey should show steps, drains, manhole covers, chimney breasts, and anything else that will affect the final garden design.A garden is rarely square or flat. Use triangulation and offsetting to plot in the garden boundaries, and the location of all plants, garden features and buildings. Make a note of things outside the garden like overhanging trees or a fabulous view as they will affect the eventual design of the garden. Survey any level changes in the garden and mark these clearly on the survey.Take a soil sample for analysis. It&#8217;s important when planting to know what the ph level (acidity or alkalinity) of the soil in order to choose the correct plants. Some plants prefer a soil that is more acidic and others will only grow in a more alkaline soil. It is also necessary to identify boggy places, shaded areas and other potentially troublesome parts of the garden.A note must be made of what lies beyond the garden boundaries. If the garden overlooks a great view this can be used as part of the new design &#8211; this is called &#8216;borrowing&#8217; the view. However, if there is something ugly outside the garden like a derelict building, or the garden is overlooked by neighbouring properties these will need to be screened out as part of the garden design.The site survey must be drawn up to scale, in ink on a piece of tracing paper large enough to show clearly the new design and put in labels &#8211; most gardens will fit onto an A1 sheet.4. Create the new designUsing the requirements and site survey the new design is created using a series of interconnected geometric shapes. The final design should create a pleasing picture on paper and each element that comprises the design should be the correct size for its intended purpose. For example, if the terrace needs to seat 6 people for dinner it must be large enough to hold a table of the correct size with room to pull out chairs so that people can sit down and stand up comfortably.The design must addresses any sloping parts of the garden. If flat spaces are required for lawns, seating areas, etc and the site is sloping retaining walls will be required -these should be shown clearly on the plan.The new design should be drawn to scale in ink on a piece of tracing paper. Everything must be labelled clearly including wall heights, paved areas, lawn, edgings, pergolas, planted areas, walls with their heights, water features.5. Choose construction materialsSelect materials for constructing each area and make sure these are labelled on the plan. There are many different construction materials available and these vary greatly in price and quality. Research DIY stores, garden centres, and landscape and building suppliers to find materials that suit the intended purpose, and fit the budget.6. Create the planting planA planting plan is required that shows the location, type and numbers of plants clearly labelled with their Latin names for each planted area of the garden. Planting should comprise a mixture of evergreen and deciduous shrubs, herbaceous plants and bulbs that will give a year-round display of colour and scent. The plants give the garden structure and that important quality of seasonal change.7. Create the construction planThe construction plan helps remove margin for error and ensure the garden is constructed correctly to a high standard. The construction plan is a technical drawing that shows contractors how to construct specific features in the garden such as steps, pergolas, fences and retaining walls. It should contain details of required paving patterns and sections showing how paving is to be laid, how footings for walls are to be constructed, how edgings are to be laid.8. Create the setting out planThe setting out plan is another technical drawing that enables landscape contractors to construct the garden accurately. This plan shows the dimensions and location of all features in the garden. The central point of any circular features such as seating areas and lawns will be shown as a measurement from a fixed, measureable point such as the corner of the house. This plan will also show angular dimensions, wall heights relative to finished paving height, and the finished ground level of any terraced areas.The setting out plan enables landscape contractors to quickly mark out the garden before they start building the garden. This allows them to check there are no errors in the design or survey and that the design will fit correctly into the space. It enables adjustments to the plan, if necessary, before construction work starts, thereby avoiding expensive mistakes further down the line. </p>
