  47. <p>Police and prosecutors are seeking sweeping changes to the state&#8217;s six-month-old bail reform law, but the new Senate majority leader said any problems with the law aren&#8217;t the Legislature&#8217;s fault.</p>
  48. <p>New Hampshire lawmakers approved a <a title="Bail Reform Misinformation" href="https://www.slybailbonds.com/bail-reform-misinformation/" target="_blank" rel="noopener nofollow noreferrer">bail-reform law</a> last session. Law enforcement officials said the case of Mark Dennis in Keene shows the problems they say the law introduced.</p>
  49. <p>In November, when Dennis was out on personal recognizance bail from a previous arrest, he stabbed a man, police said. Even though he was charged with being a felon in possession of a deadly weapon and second-degree assault &#8212; and had clearly violated his original bail conditions &#8212; he was once again released under the new law 12 hours later.   50. <p>&#8220;People just seem to be revolving right in and out,&#8221; said Chief Andrew Shagoury of the New Hampshire Association of Chiefs of Police. &#8220;Bedford&#8217;s chief talked about cases where people assaulted police officers, and they&#8217;re released on personal recognizance bail before the officer can change their uniform from the one that got ruined in the fight.&#8221;</p>

  72. <p>Please accept this letter in opposition to the proposed changes in Criminal Rule 46 ORC.</p>
  73. <p>The proposal has an ill-conceived language which will hamper the bail process, increase costs to defendants and local courts. Additionally, the processes laid out may endanger victims. Clearly, the intent of the proposed changes is to assist all citizens with a fair, easy to understand and cost-effective system. Currently, the Legislature has a bill under consideration which will address a number of the issues related to Criminal Rule 46. is not in the Courts best interest to interfere and create confusion with rule changes when legislative changes are in process.</p>
  74. <p>It is my contention that the proposed changes are costly, complicated and wholly unnecessary at this time. To support the claim, consider the following:</p>
  75. <p>The first and second sentences in the proposed change may be in opposition to one another. A long-standing common law is the “least restrictive conditions are always applied”. The court has choices on how to reasonably ensure appearance, safety, and justice. In sentence two there the phrase “least costly to the defendant” is not necessary if the rule in sentence one is followed. It appears thw sentence was added to provide clarity but in reality, it would be more ambiguous and could lead the situations where individual jurisdictions would create rules, fees, and requirements that could be in conflict in sentence one and be found unconstitutional.</p>
  76. <p>As currently proposed, ambiguity could result in delays for the release of defendants, not speed up the process nor reduce costs as one would hope is the goal.</p>
  77. <p>The rule change is not necessary as the Legislature revised the rules a few years ago and judicial intervention now when updated legislation is being considered, would create ambiguity and unnecessary expense.</p>
  78. <p>Improving technology and improved software capabilities should streamline implementation and lower cost options for monitoring defendants prior to trial. However, the practical reality is that the software algorithms will not always address unique community realities. Current ankle bracelets and GPS monitoring are still a work in progress. Recent high-profile cases such as the Brian Goolsby case in Columbus point out these systems can fail with horrific consequences.</p>
  79. <p>The Legislature defines parameters and implementation in law. Money, bail and other forms of encumberments are tried and true ways to ensure appearance and should not be replaced by a single “risk management software” approach. Research from other states who have moved from practical cash in hand bail to a software risk management process has not seen good results. Luckily in Ohio, we can look to outcomes and data from other states and see implementation difficulties that the risk management software never took into consideration.</p>
  80. <p>New Mexico and California have seen costs skyrocket as the court (the state treasury) are bearing the costs for indigent defendants. What sounds like a great idea just is not quite there yet.</p>
  81. <p>In an attempt to help people with the least resources, rule 46 sounds great but can have dire consequences for defendants, who cannot pay the fees, or run into availability issues for the technology A defendant may sit in jail while monitoring devices or other technologies become available. The Bail system may need improvement but to discard the entire system in hope that technology will save the day is problematic. Is a government managed system being better than outsourcing it to businesses who have a proven record meeting the needs of society? The system may need reform, but to remove the livelihood of businesses with a long track record of increasing the probability of court appearances and replacing it with a government-mandated system with proven flaws is not in the best interest of the citizens of the State of Ohio.</p>
  82. <p>It all comes down to “skin in the game”, financial or possibly personal debt motivates defendants to appear. To rely solely on a new technology which is still a work in progress seems to be a risk that the Supreme Court would not want to undertake.</p>
  83. <p>To illustrate the point please consider the following scenario</p>
  84. <p>A defendant is arrested on a low-level felony assault is brought to a bail or risk assessment hearing. The defendant is employed so determined to be able to pay and is found to be a small risk and ordered an ankle bracelet for tracking. To secure release the Jail levies a fee for the bracelet, installation, and monitoring; the defendant gives up right to a speedy trial, but no bracelets are available. The defendant could have posted the $1000 bond but must be incarcerated in a local jail until a device becomes available. The defendant loses their job and incurs the massive expenses of jail time, installation of the bracelet and the monitoring fee. The new risk management process causes the defendant to lose their job, now is unemployed and unable to pay the fees so they leave the jurisdiction. The bracelet is removed and destroyed so the defendant is now free to go anywhere as the original jurisdiction law enforcement is not able to trace the defendant. The local jurisdiction issues warrant. Had the bail/bond system been in place the defendant would have kept their job, appeared in court and be adjudicated. Others entities have provided side-by-side comparisons for costs so that is not necessary to be included here. When comparing differing scenarios to remove the bail bond option is not in the best interest of the defendant, the victim, or the governmental entity</p>
  85. <p>All the platitudes in the world about helping the least among us do not hold up in this case. Courts are not receiving enough funding, so levy fees; the State is taking over what has been a functioning system and will now collect a risk assessment fee. Businesses who offer the needed bail/bond service are going to be put out of business. Having a government entity replace a functioning, if flawed system brings into question why the Supreme Court is entering a process with an overriding desire to impose more government. Historically has shown government taking over where a business be can do the job, is not be incredibly effective. No one is saying that the system does not need reform, but it is the job of the Legislature to enable the courts to do their job. The Supreme Court should not create rules which may cause more hardships to all involved for the sake of trying a new technology that may not the panacea hoped for in this situation.</p>

While it was true that in most cases the minority report division was correct in predicting events, there was a percentage where the psychics in the movie simply got it wrong. There was a cover-up by the government because the decision was made to sacrifice the individuals right on the altar of judicial economy.</p>

The is clear in the fact that in most cases the formula doesn&#8217;t even bother to factor in the crime of which the person stands accused, merely other factors about their present lifestyle and past criminal history. This movement is gaining traction both as a means to determine pretrial detention status, but also to hand out sentences and determine who qualifies for early reentry after incarceration.</p>

What the state of NJ was essentially said to its citizens is: &#8220;Close enough, we&#8217;ll get it right most of the time&#8221;. This plan of crime control on a budget runs contrary to the very fabric of our core beliefs. No longer is each man judged on their merits or lack thereof. Instead, they are thrown into the pot with every other offender in the state and they are shaken out into layers based on the law of averages. Mitigating circumstances or outside variables are of no concern to the equation, the calculations take place in a vacuum absent of any factors but the ones preprogrammed into the formula. I don&#8217;t know about you but I don&#8217;t want to be evaluated by my government with the same basic formula that the Cleveland Browns used to build their organization. You&#8217;re going to end up with the same result in both cases, disappointing to horrible.</p>

In Civil litigation there exist a concept known as &#8220;summary judgment&#8221; whereby a court rules that no factual issues remain to be tried and therefore a cause of action in a complaint can be decided upon certain facts without trial. Also known as judgment as a matter of law, simply put this practice is used to circumvent a trial because it is determined that there are no issues on the merits of the case worth litigating. Sound familiar? It&#8217;s more or less the idea that a case is so weak on its face that it cannot prevail and therefore isn&#8217;t worth wasting the resources of a trial on. In civil litigation that is acceptable because no one&#8217;s freedom is at stake and the appeals process is used to judge the merits of any such judgment. However, in the criminal justice system, the burden is on the state to prove their case &#8220;beyond a reasonable doubt&#8221; not by &#8220;preponderance of the evidence&#8221; that the civil system uses.</p>

If the computer starts doing all the heavy lifting in bail decisions and sentencing recommendations, it will become the norm. Everytime the computer gets it wrong it will be chalked up to the greater good. It is at this point that the fatal flaw of summary justice is exposed, it&#8217;s not about equality of rights or equity of access to said rights; it&#8217;s about equity of outcome. Those that advocate for so-called &#8220;bail reform&#8221; or &#8220;criminal justice reform&#8221; are more concerned with making sure that everyone receives the same result that they forget that no two cases are alike and that each case deserves individual attention and individual solutions, not cookie-cutter results that make no sense in the bigger or smaller picture. It is at the very essence of our basic American rights that we not be painted with the brush of others and that we be able to assert our rights as individuals, requiring individual focus be given to all the nuisances of each case. No two cases should be the same because no two <strong>defendants</strong> are the same. To try to make them the same or treats then alike based on a misguided desire for equality is a violation of their rights. To simply &#8220;play the odds&#8221; on all of Americas criminal defendants might be the most American thing we have seen since the McCarthy hearings.</p>

  373. <p>contempt of failing to appear so you</p>
  374. <p>know as long as they could look at a</p>
  375. <p>picture and go that&#8217;s him you claim your</p>
  376. <p>award the case would end whatever</p>
  377. <p>obviously they would want you to bring</p>
  378. <p>them back alive more than dead but what</p>

  407. <p>extradition so if we&#8217;ve law enforcement</p>
  408. <p>fines in California they put him in jail</p>

  410. <p>extradition hearing and they bring them</p>
  411. <p>back okay we can still grab them and</p>
  412. <p>just take the bounty hunters ability to</p>
  413. <p>go anywhere in the USA to grab their</p>

  415. <p>authorities is a powerful tool for the</p>

  429. <p>of his prior behavior it&#8217;s just now he&#8217;s</p>
  430. <p>in the adult so I DS this east hundred</p>
  431. <p>twelve which we&#8217;re going to Cleveland</p>
  432. <p>next anyway so this might lead us back</p>

  451. <p>on the toilet there&#8217;s a real threat he</p>
  452. <p>can go right back to jail yeah he&#8217;s on a</p>
  453. <p>20-thousand trafficking charge and she&#8217;s</p>
  454. <p>just some girl well-wisher you know</p>
  455. <p>so we&#8217;d start with her next and then</p>
  456. <p>find him and snatch him up and see you</p>
  457. <p>can go to jail or you can tell us proper</p>
  458. <p>research and planning is a critical task</p>
  459. <p>for the bounty hunter to effectively</p>

  469. <p>he was going after Lawrence as a bond</p>
  470. <p>Frank rode out of a creaminess of the</p>
  471. <p>court for a permitting drug abuse Frank</p>
  472. <p>looked into his history it&#8217;s on the</p>
  473. <p>violent history he didn&#8217;t see much any</p>
  474. <p>history the indemnitor was his mother</p>
  475. <p>essentially knowing a cure municipal</p>
  476. <p>court the way we do if it is not a</p>
  477. <p>felony or violent offense they will not</p>
  478. <p>keep them so we knew it was summons a</p>
  479. <p>bull so based on that information we</p>
  480. <p>decided to approach it with a more</p>
  481. <p>community policing approach that&#8217;s not</p>
  482. <p>the right word but it is the theory</p>
  483. <p>behind it there was no need to get</p>
  484. <p>dressed up in the tactical gear and be</p>
  485. <p>heavily armed and attacked that house</p>
  486. <p>when we knew the end result was he was</p>
  487. <p>not going to jail nor was he going to</p>
  488. <p>spend one minute to sell be relentless</p>

  526. <p>it&#8217;s alright if you&#8217;re 10 or 15 minutes</p>

  555. <p>when someone gets arrested generally if</p>
  556. <p>it&#8217;s determined by the court that they</p>
  557. <p>need incentive to get back they&#8217;re given</p>
  558. <p>a bail in non-capital cases at that</p>
  559. <p>point they set a bond and you usually</p>
  560. <p>it&#8217;s cash sometimes they allowed to</p>
  561. <p>pause to the court varying by state and</p>
  562. <p>jurisdiction and the seriousness of the</p>
  563. <p>offense</p>
  564. <p>I got a black daughter but you thought</p>
  565. <p>you were</p>
  566. <p>basically if like something like</p>
  567. <p>freelance police with less regulation</p>
  568. <p>that is really the 10% of the time the</p>
  569. <p>things go sideways that is the end</p>
  570. <p>result of a lot of other systems and</p>
  571. <p>events that have led you to that point</p>
  572. <p>that went wrong yeah here I&#8217;ve got</p>
  573. <p>stacks in his hand singing he&#8217;s singing</p>

  575. <p>you got to spit this is being in the</p>

  597. <p>that through a system of checks and</p>
  598. <p>balances a lot of times the bond agent</p>
  599. <p>is able to get the the family the</p>
  600. <p>accused whoever the indemnitor czar in</p>
  601. <p>the principle to fulfill the contract</p>
  602. <p>without resorting to that now that&#8217;s</p>
  603. <p>what&#8217;s fun us two general public that is</p>
  604. <p>what probably sells the best from an</p>
  605. <p>action perspective but it&#8217;s actually the</p>
  606. <p>exception as opposed to the rule because</p>
  607. <p>not everybody requires corralled in a</p>
  608. <p>violent fashion I mean it I&#8217;m not gonna</p>
  609. <p>say doesn&#8217;t happen I mean because it</p>
  610. <p>does and that&#8217;s our importance is it&#8217;s</p>
  611. <p>you know if we can&#8217;t do it by other</p>
  612. <p>means and we move to the enforcement and</p>
  613. <p>where we actually you know act upon that</p>
  614. <p>warrant as their jailer and return them</p>
  615. <p>back to the jurisdiction and you know we</p>
  616. <p>are a privately funded business you know</p>
  617. <p>it is for-profit but we work to the</p>
  618. <p>benefit of the system we work with the</p>
  619. <p>system at no cost to the taxpayer the</p>
  620. <p>bonding company generally bears the</p>
  621. <p>rifts there is a cosign of the bonding</p>
  622. <p>companies the first line of defense and</p>
  623. <p>getting that done and that is a service</p>
  624. <p>that completely absolves the taxpayer of</p>
  625. <p>any obligation because either we bring</p>
  626. <p>back the individual we pay the face</p>
  627. <p>amount of the bond which that money is</p>
  628. <p>then used to fund municipal services</p>
  629. <p>police courts fire whatever general fund</p>
  630. <p>that the city uses to spend that money</p>
  631. <p>on them and they can throw a Christmas</p>
  632. <p>party for the judge if they so chose</p>
  633. <p>that&#8217;s it&#8217;s civic funds at that point so</p>
  634. <p>that is really the day-to-day operation</p>
  635. <p>of the business be enforcement while it</p>
  636. <p>is vital it is necessary it does public</p>
  637. <p>good it is only a consequence of</p>
  638. <p>something else not happening first</p>
  639. <p>nobody is running in and kicking in</p>
  640. <p>people&#8217;s doors and throwing guns around</p>
  641. <p>as a first line of defense I mean that&#8217;s</p>
  642. <p>just it may be sensational it may be</p>
  643. <p>something that is enjoyable to watch and</p>
  644. <p>it&#8217;s it is thrilling but it is not what</p>
  645. <p>we do every day our primary focus is on</p>
  646. <p>helping people getting them out of jail</p>
  647. <p>keeping them out of jail keeping them</p>
  648. <p>out of trouble</p>
  649. <p>I mean we try to do want someone&#8217;s in my</p>
  650. <p>custody</p>
  651. <p>I can&#8217;t tell them what to do beyond stay</p>
  652. <p>out of trouble don&#8217;t hurt anybody</p>
  653. <p>get to court I mean my mandates are</p>
  654. <p>pretty simple and those are usually the</p>
  655. <p>restrictions of bail hang up down by the</p>
  656. <p>court but while I have your attention</p>
  657. <p>there are times when I try to get on my</p>
  658. <p>soapbox a little bit give a little bit</p>
  659. <p>of ice nudge in the way of a social</p>
  660. <p>program if there&#8217;s a drug or alcohol</p>
  661. <p>issue there&#8217;s an anger issue you know at</p>
  662. <p>least try to keep the victim separated I</p>
  663. <p>mean we do what good we can and while i</p>
  664. <p>have somebody&#8217;s undivided attention</p>
  665. <p>because i&#8217;m there essentially their</p>
  666. <p>jailer you know you save who you can</p>
  667. <p>along the way and it&#8217;s a decent pulpit</p>
  668. <p>when you&#8217;ve bought someone&#8217;s freedom</p>
  669. <p>that they kind of a little bit more apt</p>
  670. <p>to listen to you and it also a lot of</p>
  671. <p>times on driving or drunk issue or</p>
  672. <p>something where there&#8217;s maybe a chronic</p>
  673. <p>problem the family is forced to confront</p>
  674. <p>the issue because once they have to call</p>
  675. <p>a bail bondsman and they&#8217;ve got to see</p>
  676. <p>this ugly mug 3:00 in the morning at the</p>
  677. <p>county jail staring at them securing</p>
  678. <p>their loved ones release kind of drives</p>
  679. <p>home the point that there&#8217;s something</p>
  680. <p>underlying even if it&#8217;s a minor</p>
  681. <p>situation that needs addressed recently</p>
  682. <p>I&#8217;ve been doing a lot of work with sly</p>
  683. <p>bail bonds they are very reputable as a</p>
  684. <p>matter of fact if I have a client that</p>
  685. <p>is in jail that needs to get out and is</p>
  686. <p>is in need of a bail bondsman sly is the</p>
  687. <p>is the call that I make for that client</p>
  688. <p>it&#8217;s the call that I tell them the</p>
  689. <p>clients family to make it assures</p>
  690. <p>everyone that if sly bails bail somebody</p>
  691. <p>out that they&#8217;re gonna show up for their</p>
  692. <p>court appearances which makes it nice</p>
  693. <p>for a criminal defense attorney to make</p>
  694. <p>sure that their clients are there prompt</p>
  695. <p>they keep track of where everything is</p>
  696. <p>during the course of the case and quite</p>
  697. <p>honestly a lot of bail bondsman out</p>
  698. <p>there do not do that</p>
  699. <p>don&#8217;t offer the same types of services</p>
  700. <p>I&#8217;ve never had a complaint from one of</p>
  701. <p>my clients who says that the slide</p>
  702. <p>wasn&#8217;t right out of jail when they</p>
  703. <p>needed to be there to get him out and</p>
  704. <p>made arrangements for whatever kind of</p>
  705. <p>financing they needed to be done we</p>
  706. <p>wanted to give you a view of our lives</p>

  709. <p>the typical which is what you&#8217;re used to</p>
  710. <p>saying we&#8217;re not going to people&#8217;s</p>

  779. <p>The apex court, three-judge bench, headed by Chief Justice of India (CJI) Dipak Misra, Justices A. M. Khanwilkar and D. Y Chandrachud also directed the real estate company to file a detailed list of homebuyers who want possession of flats in Unitech group projects and those seeking a refund of their money.</p>
  780. <p>The next hearing on the matter will take place on September 21.</p>
  781. <p>Several homebuyers had knocked the doors of the apex court seeking a direction to the real estate for getting timely possession and compensation of their flats.</p>
  782. <p>The top court is hearing various project-related matters involving Unitech.</p>
  783. <p>Unitech and its promoters have been in news for the wrong reasons.</p>
  784. <p>In February, the Supreme Court asked Unitech to pay interest to 39 flat buyers who chose to withdraw after the builder&#8217;s failure to deliver flats as promised.</p>
  785. <p>The matter concerned the owners who booked flats in Unitech&#8217;s Vistas project in Gurugram in Haryana.</p>
  786. <p>In April, a Delhi court granted a three-month interim bail to Ajay Chandra and Sanjay Chandra who was arrested in a fraud case relating to a Gurugram-based real estate project. Additional Sessions Judge Raj Kapoor granted the relief to the Chandras on a personal bond of Rs 70 lakh each and one surety of like amount.</p>
  787. <p>However, hours after the bail bond, Sanjay Chandra and Ajay Chandra were taken into custody by Gurgaon Police in connection with other cases registered against them.</p>
  788. <p>Sanjay Chandra is accused of duping buyers who had booked flats in his real-estate project in Greater Noida.</p>
  789. <p>Home buyers had accused Unitech of not completing the project and non-payment of their money along with interest.</p>
  790. <p>Allegations are also that Sanjay Chandra fraudulently took money from his clients and parked it in a shell company, thereby laundering it abroad.</p>
  791. <p>Earlier, Sanjay Chandra was arrested by the Central Bureau of Investigation (CBI) in the 2G trial.</p>

  1483. <p>You&#8217;re not paid by the hour, you&#8217;re paid based on how many cans you drop at the dump and return the cans back to the residence. Some cans are light and some are heavy,<br />
  1484. Some contain paper and some contain medical waste. Whatever is in the can, you charged based on the size and weight of the can.</p>
  1485. <p>To complicate matters sometimes after you take the can to the dump, the guys there will hide the cans. Now you have to search for the cans because if you don&#8217;t return the can to the residence by the next day, you not only have to pay to replace the can but replace the contents as well.</p>

After a time you get so good at it that you hire a couple people to help you cover a wider area. All of this is paid for by the owners of the cans at no expense to the city.</p>
  1487. <p>Then one day someone at the <a href="http://_wp_link_placeholder" target="_blank" rel="noopener">city</a> has the bright idea that they could make a few bucks by taking control of the pickup and drop of cans by having city seize control of garbage pick up. They force residents to purchase and use their cans.</p>
  1488. <p>They come when they want and only when they want. If they don&#8217;t want to come collect your cans because they&#8217;re too heavy or contain material they consider hazardous, your cans are not picked up and your trash is allowed to pile up. You&#8217;re not allowed to hire the private service you used for years with great results, they&#8217;re no longer allowed to operate.</p>
  1489. <p>They work their hours running their routes and if your cans are lost, they make you pay for a new can and no one looks for the lost cans. Trash is allowed to lie in the streets and cans are strewn about the city. Worst of all, each citizen is forced to pay for the service no matter how many cans they have or what&#8217;s in them. In many cases, residents don&#8217;t even have cans but they are still subject to the same bill as those who have the biggest, heaviest cans.</p>

In addition the new &#8220;city garbage department&#8221; doesn&#8217;t check on the cans and even if they did they were powerless to find and Or return the cans if they were hidden or dumped over.</p>
  1491. <p>Does this sound like a system anyone in their right mind would vote for? Only those that consistently have the largest, heaviest cans could possibly benefit from the system. Everyone else is paying for their service, including those that don&#8217;t even use the service. Worse yet it&#8217;s creating a public health hazard that both the department and the residents are powerless to clean up.</p>
