In the debut episode of his new podcast, This is Gavin Newsom, the California governor hosted conservative activist Charlie Kirk for a nearly 70-minute conversation. At one point, Kirk challenged Newsom to speak out against AB Hernandez, a biological male high school athlete who competed in the women’s triple jump and won by over 8 feet.

“I think it’s an issue of fairness. I completely agree with you on that. It is an issue of fairness — it’s deeply unfair,” Newsom said when asked if he was against biological men participating in women’s sports.

After Kirk suggested that Newsom appeared to be “wrestling” with the problem, the governor responded definitively on his stance.

“I am not wrestling with the fairness issue. I totally agree with you,” Newsom said, adding that he had a personal stake in the matter as someone with two daughters.

“I revere sports, so the issue of fairness is completely legit,” he added. “And I saw that — the last couple years, boy did I [see] how you guys were able to weaponize that issue at another level.”

After Kirk challenged his use of “weaponize,” Newsom backtracked to replace the word with “highlight.”

The governor concluded that Democrats should take a stand on the problem but that it should be handled with “decency” and compassion.

Despite his overtures, not everyone was won over.

“Wow. This is the first time I’ve seen Newsom directly asked this question. As you’d expect, he continues to sit on the fence,” former student-athlete Riley Gaines said in a post on X. “He admits the unfairness is a problem but won’t take meaningful action out of fear of being perceived as unkind.”

Wow. This is the first time I’ve seen Newsom directly asked this question.
Newsom also agreed with conservatives on several other concerns, calling defunding the police “lunacy,” decrying “cancel culture,” taking issue with the term “Latinx,” and criticizing the Black Lives Matter organization.

DEMOCRATS WEIGH CHANGE IN STRATEGY TO AVOID MIDTERM AND 2028 DEFEATS

The conversation may be part of a wider posturing from Newsom, who will term out of the California governorship in 2026. He has been floated as a possible 2028 Democratic presidential contender.

While Newsom runs one of the most liberal states in the union, he has been no stranger to bipartisan moves in the past. Before the 2024 election cycle, when President Donald Trump debuted the nickname “Gavin Newscum,” the president and the governor were open about the friendly relationship they enjoyed during Trump’s first term.

Media conglomerate Disney has quietly pulled back on its previous diversity, equity, and inclusion initiatives.

Disney is one of the largest media companies in the world approaching 800 film productions. Over the last five years, its projects have floundered at the box office and in Hollywood accolades.

The company’s latest filing to regulators did not mention its controversial “Reimagine Tomorrow” program, which began in 2021 and committed to a minimum of 50% of characters being LGBTQIA and racial minorities.

Training materials at the time included concepts such as “white privilege,” “white fragility,” “white saviors,” “microaggressions,” and “antiracism.” Disney encouraged its white employees to complete a “white privilege checklist” during their employment.

Additionally, chief human resources officer Sonia Coleman sent out a note advising staff on the company’s new “talent strategy.” Coleman explained that hiring practices will “uphold our company values, incorporate different perspectives to drive business success, cultivate an environment where all employees can thrive, and sustain a robust pipeline to ensure long-term organizational strength.”

The changes come as President Donald Trump has worked during his first few weeks back in office to end DEI on the federal level and discourage companies from maintaining those practices.

Disney joins Target, Meta, McDonald’s, Walmart, Lowe’s, Toyota, Ford, and others that have rolled back DEI practices. These companies will no longer make hiring and firing decisions based on race or any other identity while phasing out the phrase “DEI.”

Meanwhile, Disney finished award season without a single win at the Golden Globes or the Oscars. Inside Out: 2 stood a chance as it was the highest-grossing film in June, earning $155 million during its North American opening weekend. This made it the second highest-grossing animated film of all time behind another company sequel, Incredibles 2, which raked in over $182 million in 2018.

HYUNDAI EXECUTIVE SAYS DEI ‘DRIVES THE BOTTOM LINE’ AS OTHER COMPANIES DITCH IT

Disney, Pixar, and ESPN, staff have faced round after round of layoffs. All three production companies have films, series, and live events that stream on Disney+. Pixar, in particular, has had three theatrical releases since the coronavirus pandemic, and from 2020 to 2022, three of its films went straight to the streaming service.

Costco, Apple, and Delta Airlines are among the companies keeping DEI policies and have gone public in defense of DEI.

A new major study suggested that the yearslong decline of Christianity in the United States has ended.

Since Pew Research Center began conducting its religious landscape study in 2007, Christianity in the U.S. has faced a steady and precipitous decline, with those identifying as Christian decreasing from 78% in 2007 to 62% in 2024. However, this hemorrhaging appears to have halted, as indicated by Pew polls over the past few years, culminating in a seven-month study of 36,908 U.S. adults from 2023 to 2024.

Pew surveys since 2020 have found that the percentage of U.S. adults identifying as Christian hovers around 60%-64%. The most recent Religious Landscape Study, the third since 2007, placed the share of U.S. Christians at 62%.

The regular annual religious surveys, which are smaller in sample size, found a slight increase in Christians over the past two years, from a low of 60% in 2022 to 63% in 2024.

Of the 62%, 40% are Protestant, 19% are Catholic, and the remaining 3% are “other.” Orthodox Christians’ share of the population breached 1%.

Those belonging to religions that aren’t Christianity now lie at 7.1%. Notably, Muslims and Buddhists earned a share of the population greater than 1% for the first time, at 1.2% and 1.1%, respectively. Hindus are close behind at 0.9%, while Jews make up the largest non-Christian religion at 1.7%.

The rise of “nones,” the religiously unaffiliated, appears to have ended at 29%. Those firmly identifying as atheists are vanishing low at 5%, while agnostics are at 6%. The largest share is those identifying as “nothing in particular,” at 19%.

“Jesus” is displayed on a large monitor and worship songs are played on stage as people gather for the “Easter Sunrise Service” at the Lincoln Memorial, Sunday, April 9, 2023, in Washington, hosted by the National Community Church.
Religious affiliation is increasingly heavily polarized along religious lines. Roughly 82% of self-described conservatives identify as Christian, a slight decline from 89% in 2007. Christianity’s hold on self-described liberals has collapsed completely, from 62% in 2007 to just 37% in 2024. Over half of liberals say they have no religion.

Researchers identified a key factor showing the stabilization of Christianity’s decline in the two youngest cohorts. The pattern of every cohort becoming steadily less religious, as seen in the previous six cohorts, halted with the seventh, with the 1990s and 2000-2006 cohorts being roughly the same level of Christian at 46%.

The 2000-2006 cohort (ages 18-24) is also notable for being the first cohort in which men are more religious than women. David Campbell, a political scientist at the University of Notre Dame, told the New York Times that the switch could be part of the increasing polarization of religion along political lines, as young men are much more conservative than young women.

While the lower levels of religiosity among younger generations could drag the share of Christians down over time, some speculate the current results show the natural ceiling of “nones.”

AMERICAN FREED FROM DAMASCUS PRISON SAYS HE’S A CHRISTIAN PILGRIM MISSING FOR MONTHS

“The ‘nones’ have run through the easy parts of the market, and now they’re hitting the bedrock of committed evangelicals” and theological traditionalists in other faiths, Eastern Illinois University political scientist Ryan Burge said. Going forward, “if you’re going to make advances, you have to make advances with conservatives.”

Though the overall percentage of those identifying with a religion has declined, the survey showed Americans are still highly spiritual, especially compared to Europe. Of those surveyed, 86% believe in having a soul or spirit, 83% believe in God or a universal spirit, 79% believe in something spiritual beyond the physical world, and 70% believe in heaven, hell, or both.

President Donald Trump imposed tariffs on the United States’s neighbors along with one of its top adversaries and has teased additional tariffs on other countries in a bid to push for action on the fentanyl crisis.

On Saturday, Trump announced his administration would enact 25% tariffs on all products imported from Canada and Mexico — with the exception of Canadian oil, which received a 10% tariff — along with a 10% tariff on imports from China, as the president followed through on months of threats.

The White House said the tariffs would remain until each of the countries addresses the “crisis” of fentanyl and illegal immigration coming into the U.S. Here is what to know about the tariffs imposed on the countries and the places being threatened with tariffs.

Canada

The Great White North has been one of the closest allies to the U.S., but now, the country faces 10% tariffs on energy imports into the U.S. and 25% tariffs on all other goods.

The White House said Canada has played a “central role” in the threat of the illegal flow of drugs and fentanyl into the U.S. and that the blanket tariffs will remain until “compliance and cooperation of Canada is assured” in ending the crisis.

PRICES ON THESE ITEMS COULD BE AFFECTED BY TRUMP TARIFFS ON MEXICO, CANADA

“We pay hundreds of Billions of Dollars to SUBSIDIZE Canada. Why? There is no reason. We don’t need anything they have. We have unlimited Energy, should make our own Cars, and have more Lumber than we can ever use. Without this massive subsidy, Canada ceases to exist as a viable Country. Harsh but true! Therefore, Canada should become our Cherished 51st State. Much lower taxes, and far better military protection for the people of Canada — AND NO TARIFFS!” Trump said in a post on Truth Social Sunday.

Canada has vowed to issue its own retaliatory tariffs, beginning with 25% tariffs on roughly $20 billion in products imported into Canada from the U.S. The products affected by the initial set of tariffs include cosmetics, appliances, dairy, sugar, and orange juice, among other products.

Canadian officials have said there will be additional tariffs in the coming days if the U.S.’s tariffs are not revoked.

When Trump announced his plans to slap sweeping tariffs on Canada last year, Prime Minister Justin Trudeau responded by suggesting millions of dollars in spending to shore up security at the border. There were reported plans to spend as much as $1 billion, investing in new drones and changing the countries’ immigration policies.

Trump and Trudeau spoke Monday, and the president said he would speak with him again at 3 p.m.

Mexico

Trump announced a blanket 25% tariff on imports coming into the U.S. from Mexico on Saturday, while Mexico promised unspecified retaliatory measures. On Monday, Mexican President Claudia Sheinbaum and Trump said they had agreed to several measures, including a one-month pause on the tariffs.

In the declaration over the weekend, the White House said the tariffs would remain “until Mexico cooperates with the United States in the fight against drug trafficking and on border security.”

Both Sheinbaum and Trump said Mexico agreed to send 10,000 soldiers to the U.S.-Mexico border to stop the flow of illegal immigrants and drugs, while the U.S. had agreed to work on preventing weapons from being trafficked into Mexico. The agreement meant the tariffs by the U.S. would be delayed for at least a month as negotiations on additional items continue between the two countries.

As of Monday morning, the tariffs against Mexico are the only ones that have been halted.

China

Trump imposed a 10% blanket tariff on China, also taking issue with the country’s role in the fentanyl crisis, adding to previous tariffs imposed by the U.S. on imports from China.

In the president’s proclamation of the tariffs on Saturday, he said China “plays a central role in this challenge, not merely by failing to stem the ultimate source of many illicit drugs distributed in the United States, but by actively sustaining and expanding the business of poisoning our citizens.”

Trump also said Chinese officials have refused to follow through with actions to combat the flow of fentanyl. The White House said the additional tariff would remain until “the full compliance and cooperation of the [Chinese] government is assured.”

A spokesperson for the Chinese foreign ministry blasted the tariffs, saying on Sunday that “China firmly deplores and opposes this move and will take necessary countermeasures to defend its legitimate rights and interests.”

The Chinese spokesperson also said the tariffs “severely violate” World Trade Organization rules.

European Union

Trump has not imposed any tariffs on the European Union, but he has warned he will place tariffs on its products “pretty soon.”

Speaking to reporters Sunday night, Trump said tariffs would “definitely happen with the European Union,” claiming that it has taken advantage of the U.S. regarding trade.

Someone close to the Trump administration told the Telegraph the president is considering 10% tariffs on all imports from the EU and that the sparring with Canada and Mexico is an exploratory mission to see “what he can get away with.”

Unlike with Canada and Mexico, Trump isn’t worried about the EU’s borders. Rather, his gripe is that Brussels runs a large trade surplus with the U.S.

“They don’t take our cars, they don’t take our farm products,” Trump said. “They take almost nothing, and we take everything: from the millions of cars, tremendous amounts of food and farm products.”

“The European Union has treated us so terribly,” Trump said.

EU foreign policy chief Kaja Kallas told reporters Monday that the EU is “listening carefully” to Trump but warned against a trade war.

“We were listening carefully to those words, and of course, we are preparing also on our side. But what is clear is that there are no winners in trade wars. If the United States starts the trade war, then the one laughing on the side is China. We are very interlinked,” Kallas said.

“We need America, and America needs us as well. The tariffs increased costs. They are not good for the jobs, not good for the customers, either. That is clear,” she added.

EU policymakers have suggested levying up to 50% tariffs on select U.S. imports if Trump carries through on his threat.

Trump, in the Sunday remarks to reporters, said the United Kingdom was also “out of line” but expressed confidence that it could be worked out.

The Costco board of directors unanimously voiced its support for the retailer to keep its diversity, equity, and inclusion practices without further evaluation.

The National Center for Public Policy Research think tank proposed that the company evaluate the “financial risks to shareholders” that DEI poses. In response, the board of directors called on investors to vote against it. Costco’s next shareholders’ meeting will be held Thursday.

The Washington Examiner reached out to Costco for comment.

Meanwhile, Meta, Walmart, Lowe’s, Toyota, Ford, and others rolled back their diversity, equity, and inclusion practices. These companies will no longer make hiring and firing decisions based on race or any other identity while phasing out the phrase “DEI.”

Costco’s most recent negotiation came Wednesday when it met with the International Brotherhood of Teamsters, which represents the company’s unionized workers.

CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER

An impending strike slated to begin Jan. 31 would affect more than 600 locations nationwide. About 18,000 unionized workers voted in favor of the move to negotiate pay increases, more retirement benefits, updated bereavement policies, and provisions for holidays and inclement weather.

The Teamsters told the Washington Examiner that some of its members will be demonstrating outside of the annual shareholders’ meeting at Costco headquarters.

GOP lawmakers are laying the groundwork for the return of signature Trump-era immigration policies, paving the way for sweeping changes at the southern border as the president-elect prepares for his return to the White House next week.

Republicans in both the House and Senate will introduce legislation Thursday that would reinstate the Migrant Protection Protocols, otherwise known as the Remain in Mexico program implemented in 2017 under then-President Donald Trump. The program was later dismantled by the Biden administration shortly after President Joe Biden took office in 2021 despite pushback from Republicans, particularly those in border states.

“Biden’s first action upon taking office four years ago was to reverse President Trump’s ‘Remain in Mexico’ policy,” Rep. Roger Williams (R-TX), who introduced the legislation in the House, said in a statement. “The consequences have proven deadly. My bill lays the groundwork to restore law and order and secure our nation by federally mandating that those awaiting a court date do so from their country of origin. We are a land of laws, it’s time we act like it and put the safety of Americans first.”

The bill would direct illegal immigrants seeking asylum at the southern border or who lack proper documentation to return to Mexico as they await immigration proceedings.

The Department of Homeland Security implemented the Migrant Protection Protocols in January 2019, seeking to end the “catch and release” policies previously in place. Under the policy, immigrants received notices to appear in immigration court at a later date and were returned to Mexico until that date.

While immigrants were instructed to wait, Mexican officials agreed to provide humanitarian aid under the U.S.-Mexico Joint Declaration and Supplementary Agreement.

However, Republicans accused Biden of backtracking on that agreement when he ended Remain in Mexico, which lawmakers say helped contribute to historic numbers of illegal immigration during his administration.

“For too long, dangerous criminals have been set free in the United States while waiting for their day in court,” Williams said. “Bad actors exploit the system and disappear, never to be seen again. With violence, murder, drug smuggling, and cartel activity terrorizing our communities, now more than ever we must be aware of who is in our country.”

Other lawmakers have also advocated the reinstatement of Remain in Mexico policies, including freshman Rep. Brandon Gill (R-TX) who introduced a bill last week that would implement the Migrant Protection Protocols from Trump’s first term. That bill, along with Williams and Sen. Marsha Blackburn’s (R-TN) proposal, indicates a larger push among Republicans to usher in sweeping policy changes along the southern border after Trump returns to the White House.

Republicans are hoping now to enshrine the program in federal law rather than as an executive order so that it cannot be easily undone by a future president who disagrees with the policy.

Republicans introduced the legislation in the last Congress, but the bill was never considered by the Democratic-led Senate.

CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER

The same bill was introduced in the Senate by Blackburn, who paired it with another bill to streamline enforcement of immigration laws for apprehending, detaining, and transferring illegal immigrants to federal custody. That bill, the CLEAR Act, would also require states and localities to provide the Department of Homeland Security with certain information about immigrants who are apprehended, including their names and addresses, as well as the date, time, and location of arrest.

“During his time in office, President Biden rolled back the successful Remain in Mexico program, invited millions of illegal immigrants to flood our southern border, and refused to enforce the laws on the books,” Blackburn said in a statement. “President Biden’s failure to lead permitted lawlessness across the country and resulted in the murder of innocent Americans like Laken Riley. Both the CLEAR Act and the Make MPP Mandatory Act would strengthen border security and crack down on those who break our laws.”

President-elect Donald Trump’s selections to fill out his national security team have emphasized the threat posed by the Chinese Communist Party during their confirmation hearings this week on Capitol Hill.

Pete Hegseth, who was tapped to serve as defense secretary, Sen. Marco Rubio (R-FL), Trump’s selection for secretary of state, and John Ratcliffe, the president-elect’s nominee for CIA director, all sat down with the relevant Senate committees on Tuesday and Wednesday. Other Trump national security nominees have yet to sit for their public committee hearings.

Rubio told lawmakers on the Senate Foreign Relations Committee on Wednesday that the CCP “is the most potent and dangerous near-peer adversary this country has ever confronted,” and the outgoing Florida senator warned that if “we don’t change course, we are going to live in the world where much of what matters to us on a daily basis from our security to our health will be dependent on whether the Chinese allow us to have it or not.”

At the same time, Ratcliffe told the Senate Intelligence Committee that confronting China would be “our once-in-a-generation challenge.”

Hegseth, who faced the most opposition of the three from Democrats, said in written responses to questions that he would review the Defense Department’s posture in the Indo-Pacific and “identify ways to prioritize such efforts.”

“We need to accelerate efforts to strengthen our force posture and increase operational capabilities in the Indo-Pacific, given China’s historic and rapid military buildup and the urgent need to reestablish deterrence,” he added.

Trump has picked Rep. Mike Waltz (R-FL) to serve as his national security adviser, a role that does not require Senate confirmation, and he, too, is known as a China hawk. Earlier this week, Waltz praised the Biden administration’s efforts to boost the United States’s alliances in the region to counter Beijing.

“Where I certainly give this administration some credit is the trilateral dialogue between South Korea, the United States, and Japan, and then also between the United States, Japan, and the Philippines,” Waltz said Tuesday at a “Passing the Baton” event alongside his predecessor, Jake Sullivan, at the U.S. Institute of Peace.

These initiatives were “really helping those countries and those governments overcome historic animosities with a shared vision of a free and open Indo-Pacific,” Waltz added. “So I think all of those things will continue.”

The whole of Trump’s national security picks indicates that he will be focused on competition with Beijing. The incoming president has said he wants the two major conflicts in the world, in the Middle East and Russia-Ukraine, to end as quickly as possible, which would allow his administration to focus on China.

The U.S.-CCP competition takes several forms, including the stealing of intellectual property, cyberattacks, the expansion of both countries’ nuclear arsenals, and increasing consternation from U.S. allies in the Pacific region about Beijing’s expanding influence.

CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER

U.S. officials reported a significant breach into several large U.S. telecommunication companies last fall, which Rubio previously called “the most disturbing and widespread incursion into our telecommunications systems in the history of the world.”

Outgoing FBI Director Christopher Wray told 60 Minutes that the Chinese government is “prepositioning on American civil critical infrastructure, to lie in wait on those networks, to be in a position to wreak havoc and inflict a real-world harm at a time and place of their choosing.”

Send a clear message that this is not a time for equity.”

Republicans have largely been critical of the Biden administration’s promotion of diversity and equity broadly, including in the service branches and service institutions. Hegseth, especially during his time as a Fox News commentator, has long railed against the same policies.

“DEI is not about giving everybody opportunity,” Sen. Eric Schmitt (R-MO) said. “It is rooted in cultural Marxism, the idea that gets the room, any room with oppressor versus oppressed. It’s race essentialism, and it is poison.”

Sen. Jim Banks (R-IN) followed up on the line of conversation during his allotted questioning time.

HEGSETH CLARIFIES STANCE ON WOMEN IN MILITARY IN COMBATIVE CONFIRMATION HEARING

“That’s a lot of service members sitting in a lot of briefs, hearing about a lot of threats or political perspectives that might be dangerous, that do not comport to threats that actually exist inside the force, or ideas that introduce critical race theory or DEI or climate change initiatives that they and their commands have to conform to,” Hegseth told Banks.

Prior to being nominated by President-elect Donald Trump, Hegseth said Gen. Charles Q. Brown, the chairman of the Joint Chiefs of Staff, should be fired.

“First of all, you got to fire the chairman of the Joint Chiefs,” Hegseth said on the Shawn Ryan Show in early November 2024. “Any general that was involved, general, admiral, whatever, that was involved in any of the DEI woke s*** has got to go.”

GOP senators on the committee supported Hegseth’s nomination throughout the hearing as Democrats grilled him on allegations that he committed sexual assault in 2017, which Hegseth was not charged for and has claimed was a consensual encounter; claims of financial mismanagement at previous positions; and sentiments he has shared about women in combat roles in the military.

Hegseth, a veteran and former Fox News host, pushed back on allegations that he disparaged women serving in the military under tough questioning from women on the Senate Armed Services Committee.

“My critiques, senator, recently and in the past and from personal experience, have been instances where I’ve seen standards lowered,” Hegseth said.

The role of women, who account for nearly 18% of the armed forces, in the military was a prominent theme throughout the hearing as Hegseth had previously said that women should not be allowed in combat and has argued against diversity and inclusion efforts. Hegseth has since appeared to shift his views.

“Yes, women will have access to ground combat roles given the standards remain high and we’ll have a review to ensure the standards have not been eroded,” Hegseth told senators Tuesday.

Sen.
“You will have to change the way you see women to do this job well, and I don’t know if you are capable of that,” Gillibrand said.

“You cannot denigrate women in general, and your statements do that,” Gillibrand said, raising her voice. “’We don’t want women in the military, especially in combat’ — what a terrible statement.”

She stressed that the nominee to lead the Pentagon said in his opening statement that he did not want to inject politics into the military but claimed that everything Hegseth said in prior statements was political.

“You said in your statement — you don’t want politics in the DOD, everything you’ve said in these public statements is politics, ‘I don’t want women, I don’t want moms,’” Gillibrand said. “What’s wrong with a mom by the way? Once you have babies, you’re no longer able to be lethal? I mean, you’re basically saying women, after they have children, basically can’t ever serve in the military in a combat role. It’s a silly thing to say.”

The New York senator, a champion for preventing military sexual assault who has sponsored bipartisan legislation to hold perpetrators accountable, told Hegseth that his statements about women in combat roles are “brutal, and they’re mean, and they disrespect men and women who are willing to die for this country.”

Gillibrand pushed the nominee to give examples of how the standards were lowered, instead of making “generalized statements.”

“Commanders need quotas to have a certain number of female infantry officers or infantry listed — that disparages those women,” Hegseth said, before Gillibrand interrupted him.

“Commanders do not have to have a quota for women in the infantry, that does not exist,” she said. “Your statements are creating the impressions that these exist, because they do not.”

Throughout the hearing, Hegseth reiterated he now believes women “make amazing contributions across all aspects of our battlefield.”

In later questioning with Sen. Joni Ernst (R-IA), a veteran, the nominee committed to conducting a gender-neutral review of the military.

The New York senator also pressed Hegseth on prior comments that allowing gay people to serve in the military is “social engineering.”

“As the president has stated, I don’t disagree with the overturn of ‘Don’t Ask, Don’t Tell,” Hegseth said.

The nominee previously said the policy was part of a “Marxist” agenda that hurt military readiness at the price of prioritizing social justice.

Packaged foods may soon have warning labels about how much sodium, saturated fats, and added sugars they contain in an effort to curb the chronic disease epidemic, which in large part is due to diet.

On Tuesday, the Food and Drug Administration announced a new proposed rule that would require companies to place a “Nutrition Info Box” on the front of food and beverage packages with the intention of reducing diet-driven diseases, including obesity, Type 2 diabetes, and certain cancers.

“The science on saturated fat, sodium and added sugars is clear,” FDA Commissioner Robert Califf said in a statement. “Nearly everyone knows or cares for someone with a chronic disease that is due, in part, to the food we eat. It is time we make it easier for consumers to glance, grab and go. Adding front-of-package nutrition labeling to most packaged foods would do that.”

RFK JR. ON ULTRAPROCESSED FOOD: THE SCIENCE ON FOOD DYES, GLYPHOSPHATE, AND SEED OILS

The new front-of-package label would not replace the “Nutrition Facts” labeling found on the back of packaged foods in the United States. Rather, it would be a new label only indicating the amount of the three nutrients the package contains by percentage of daily value and a “Low,” “Medium,” or “High” designation.

The FDA has designed five different types of labeling, each presenting the same information but with different specifications based on the size of the packaging.

Example of a “Nutrition Info” front-of-package label proposed by the FDA on Jan. 14, 2025.

If finalized, the rule would mandate that food manufacturers add some sort of front-of-package nutrition info label to their products within three years after the effective date for businesses with $10 million or more in annual food sales, with all other companies required to comply within four years of the rule’s adoption.

Jim Jones, the FDA deputy commissioner for the Human Foods Program, said in the Tuesday press release that the agency also hoped to “see manufacturers reformulate products to be healthier in response to front-of-package labeling.”

Approximately 75% of adults living in the U.S. are obese or overweight, according to a study published in the medical journal Lancet in November 2024.

WHAT TO KNOW ABOUT THE DEBATE OVER FLUORIDE IN DRINKING WATER AND WHY RFK JR IS SO SET ON REMOVING IT

“Together, we hope the FDA’s efforts, alongside those of our federal partners, will start stemming the tide of the chronic disease crisis in our country,” Jones said in the press release.

A spokesperson for the FDA told the Washington Examiner that the agency conducted “extensive engagement” with interested parties to hear feedback about front-of-package nutrition labeling, including nine community listening sessions and multiple coalition meetings.

Robert F. Kennedy Jr., President-elect Donald Trump’s nominee for health and human services secretary, based his 2024 independent presidential campaign on the need to address the chronic disease epidemic, particularly obesity and neurological disorders.

After dropping his presidential campaign, he supported Trump with a “Make America Healthy Again” agenda, and Trump said that he would let Kennedy “go wild” on public health.

The public comment period on the proposed rule does not close until May 16, well into the Trump administration.

The Trump transition team did not respond to the Washington Examiner’s request for comment as to whether Kennedy or Dr. Marty Makary, Trump’s FDA commissioner nominee, would pick up where Califf left off.

The FDA spokesperson also refused a request for comment on an update regarding what details of the planning for the proposed rule were shared with the Trump transition team.

Improving the American diet by reducing consumption of saturated fats, added sugars, and sodium, as well as reducing artificial food additives, has increasingly had bipartisan support.

Sen. Bernie Sanders (I-VT) proposed in February 2024 that the FDA place warning labels about the risk of developing Type 2 diabetes or obesity on foods with high saturated fat, added sugar, and sodium content. At the time, Sanders was chairman of the Senate Health Education, Labor, and Pensions Committee.

In December 2024, the HELP Committee held a hearing about unhealthy foods, with both Califf and Jones testifying. Republicans and Democrats on the panel grilled the bureaucrats about how the agency has a tight working relationship with the food industry corporations it is charged with overseeing.

Although it is unclear whether the proposed rule will survive into the Trump administration, Califf said in the Tuesday press release that his team is “fully committed to pulling all the levers available to the FDA to make nutrition information readily accessible.”
