138.
139.
140.
During a press conference Tuesday afternoon, Montgomery County Sheriff Rob Streck said that Melissa Hutchins, 50, of Dayton, will face a long list of charges.

141.
142.
143.
144.
Pending further investigation, Hutchins could face charges of aggravated vehicular homicide, felony drug and paraphernalia possession, felony failure to comply and driving with a suspended license, among other crimes.

147.
148.
Streck released dashcam video of Monday evening's pursuit, though ending it prior to the collision that was responsible for the death of Colby Ross, 35.

149.
150.
151.
152.
According to Streck, a white SUV allegedly driven by Hutchins though not believed to be hers fled law enforcement in Butler Township around 4:40 p.m. A Butler Township police officer broadcast to nearby officers that the driver of the vehicle was wanted on a felony charge of "failure to comply."

153.

155.
156.
Hours later, after being spotted by a plain-clothes detective, the driver of the vehicle made numerous attempts to flee pursuing law enforcement.

157.
158.

162.
163.
164.
When the BMW crashed into the pickup truck, Ross was ejected from the vehicle. He was taken to a local hospital, where he was pronounced dead.

499.
Do you know the best place to be when a tornado is in the area?

500.

501.
(NEXSTAR) — With parts of the U.S. facing a risk of severe weather and tornadoes — including some still trying to recover from other recent storms — it's a good time to revisit storm safety.

502.
503.
504.
505.
If you live in an area known to have tornadoes, knowing your safe spot may be common sense, whether it's a basement, an interior room on the lowest level of the building, a tornado shelter, or, if those are unavailable, "the nearest ditch, ravine, or culvert."

506.
507.
508.
509.
But what about when you're driving, and aren't near any buildings to hide in?

510.
511.
512.
513.
Your first instinct, especially on a highway, may be to find a bridge or overpass to park under as the storm moves through. While that may sound like a safe space to protect yourself and your car from a storm, experts warn against it for a number of reasons.

514.
515.
516.
517.
Parking there can block traffic, potentially putting yourself and others at risk of collision.

518.
519.
520.
521.
Should a tornado move through the area, parking under an underpass can create an even more serious situation.

532.

533.
534.
535.
As meteorologist Aaron Brackett of Nexstar's KFOR explains, when winds encounter an overpass, they increase.

536.
537.
538.
539.
“So even if you have a wind in a weaker tornado of 100, 150 miles per hour, you can add 40, 50, 60 miles per hour to that just from being underneath the underpass. So, it's actually making the tornado you’re in worse," he says.

540.
541.
542.
543.
In May 1999, many people took cover under an overpass during the deadly F5 Bridge Creek-Moore Tornado — with wind speeds reaching over 300 miles per hour, the highest ever recorded — as it moved through Moore, Oklahoma. Among those was Stuart Earnest, who told KFOR in 2012 that when the tornado hit, "people started getting sucked out from under the bridge."

544.
545.
546.
547.
He recounted coming down the embankment to help the injured, first encountering a man whose wife had been killed in the tornado. Her body was found days later. Other survivors suffered horrific injuries, according to the National Weather Service.

548.
549.
550.
551.
In addition to vehicles and people being caught up in the wind, parking under an overpass puts you at risk of being hit by flying debris. The bridge may also fail, causing more debris and even the possibility of collapse.

561.

562.

563.
564.
565.
Instead of parking beneath an overpass, experts recommend exiting the highway to find more suitable shelter close by.

566.
567.
568.
569.
"When the traffic is jammed or the tornado is bearing down on you at close range, your only option may be to park safely off the traffic lanes, get out and find a sturdy building for shelter, if possible," NOAA writes. "If not, lie flat in a low spot, as far from the road as possible (to avoid flying vehicles)."

570.
571.
572.
573.
You cannot outrun a tornado with your vehicle, but you can try to get out of its path if it is far enough away. As NOAA explains, if the tornado is moving to your right, you should move to your left and vice versa "to put more distance between you and its path."

574.
575.
576.
577.
If the tornado begins to impact your car and you're unable to escape, experts say to keep your seatbelt on and get as low as possible away from windows and the windshield.

578.
579.
580.
581.
Speaking of windows, if you're able to shelter in a building, do not open the windows. While it is commonly believed that opening windows during a tornado will reduce damage and "equalize pressure," NOAA notes doing so is "absolutely useless, a waste of precious time, and can be very dangerous."

582.
583.
584.
585.
Officials go on to explain that you may be injured while trying to open the windows, and that tornadoes are capable of blasting them open anyway.

600.
MINNEAPOLIS (AP) — A former employee sued the city of Minneapolis on Tuesday, alleging ex-police Officer Derek Chauvin hauled her from her minivan and pinned her to the ground with his knee in January 2020, just as he did four months later when he killed George Floyd.

601.
602.
603.
Patty Day, then employed by the Public Works Department, wants over $9 million in damages for her injuries, which included a broken tooth, a deep cut that left a scar on her hand, persistent arm and shoulder pain, and psychological issues including anxiety, depression and flashbacks.

604.
605.
606.
“Chauvin is the most infamous police officer in Minnesota (if not United States) history," according to the complaint filed in federal court. “This exacerbates Patty’s emotional suffering and increases the frequency of her flashbacks, as Chauvin’s name is repeatedly in the news.”

607.
608.
609.
Day's attorneys acknowledge she was drunk on the evening of Jan. 17, 2020, and depressed over her impending divorce and other difficulties, according to the complaint. Her minivan had been stuck in the snow for several hours when Chauvin and Officer Ellen Jensen arrived on the scene.

610.
611.
612.
“Chauvin and Jensen violently yanked Patty from her vehicle and, without justification, threw her to the ground in the middle of a street, fracturing her tooth, injuring her arm and shoulder, and causing other significant injuries before handcuffing her," the complaint says. "Chauvin then assumed his signature pose, pressing his knee into the subdued and handcuffed Patty’s back — just as he would later do to snuff the life out of George Floyd — and remaining that way well after Patty was controlled.”

613.
614.
615.
Saturday will mark the fourth anniversary of Floyd's murder. Chauvin, who is white, kneeled on Floyd's neck for 9 1/2 minutes outside a convenience store where the Black man had tried to pass a counterfeit $20 bill. Bystander video captured Floyd’s fading cries of “I can’t breathe.”

616.
617.
618.
Floyd’s death touched off protests worldwide, some violent, and forced a national reckoning with police brutality and racism. Chauvin was convicted of murder in 2011.

619.
620.
621.
City spokespeople and an attorney who has represented Chauvin in unsuccessful appeals did not respond to requests for comment on the lawsuit.

622.
623.
624.
Day was charged with drunken driving. A judge ruled that the officers lacked probable cause to arrest her and granted her motion to suppress the evidence. The city attorney's office then dropped the changes, partly because of the way the officers treated her, the lawsuit says.

625.
626.
627.
According to the lawsuit, Assistant City Attorney Annalise Backstrom told the court then: “I just want to make clear that my office and myself don't condone the way that the interaction went down in this particular case.”

628.
629.
630.
Body camera video of the incident was admitted during Day’s evidentiary hearing, but her defense attorney at the time did not keep copies. Day's lawyers say they've been trying for over a year to get the city to release the videos, and accused the city of “intentionally dragging its feet because it would prefer that video of the encounter remain out of public view.”

631.
632.
633.
The lawsuit says Chauvin and his partner filed misleading reports that omitted the true extent of the force they used, did not note her injuries, and did not document Chauvin pinning Day to the ground with his knee. It accuses them of covering for each other, and says there's no evidence that either officer was disciplined.

634.
635.
636.
If Chauvin had been disciplined for that arrest or other excessive force cases, it says, “history could have been stopped from repeating itself with George Floyd.”

637.
638.
639.
The city has already paid out nearly $36 million to settle lawsuits involving civil rights violations by Chauvin, including $27 million to Floyd’s family.

654.
CAIRO (AP) — The United Nations suspended food distribution in the southern Gaza city of Rafah on Tuesday due to a lack of supplies and an untenable security situation caused by Israel’s expanding military operation. The U.N. warned that humanitarian operations across the territory were nearing collapse.

655.
656.
657.
A senior United States official said Israel has addressed many of the Biden administration's concerns about a full-scale ground invasion of Rafah aimed at rooting out Hamas fighters there. U.S. President Joe Biden had previously opposed a total military assault on a city filled with displaced civilians if plans did not prioritize the safety of innocent Palestinians. The U.S. official spoke on condition of anonymity because they were not authorized to comment publicly.

658.
659.
660.
The official said the administration stopped short of greenlighting the Israeli invasion plan, but said Israeli officials’ changes to the planning suggested they were taking the American administration’s concerns seriously.

661.
662.
663.
In the past two weeks, hundreds of thousands of people have fled Rafah in a chaotic exodus, seeking shelter in new tent camps or crowding into areas already devastated by previous Israeli offensives. Some 400,000 people are believed to still be in Rafah after around 900,000 rushed to escape, according to COGAT, the Israeli military office in charge of Palestinian civilian affairs.

664.
665.
666.
Getting aid to displaced civilians has been hampered by closed and chaotic land crossings, as well as problems plaguing the U.S. military’s new floating pier meant to provide an alternative sea route for aid into Gaza. Over the weekend, hungry Palestinians took aid from a U.N. vehicle convoy coming from the pier, and the U.N. said since then it had been unable to receive trucks there.

667.
668.
669.
Pentagon press secretary Maj. Gen. Pat Ryder told reporters in Washington that for the past few days, forward movement of aid from the pier was paused but it resumed Tuesday. There was no confirmation from the U.N.

670.
671.
672.
The U.N.'s World Food Program said it was running out of food for central Gaza, where hundreds of thousands of people are now living.

673.
674.
675.
“Humanitarian operations in Gaza are near collapse,” said Abeer Etefa, a WFP spokesperson. If food and other supplies don’t resume entering Gaza “in massive quantities, famine-like conditions will spread,” she said.

676.
677.
678.
The warning came as Israel seeks to contain the international fallout from a request at the world’s top war crimes court for arrest warrants targeting both Israeli and Hamas leaders. The move garnered support from three European countries, including Israel's key ally France.

679.
680.
681.
The chief prosecutor at the International Criminal Court cited Israeli Prime Minister Benjamin Netanyahu and Defense Minister Yoav Gallant for alleged “use of starvation as a method of warfare,” a charge they and other Israeli officials angrily deny. The prosecutor accused three Hamas leaders of war crimes over killings of civilians in the group's Oct. 7 attack.

682.
683.
684.
The U.N says some 1.1 million people in Gaza — nearly half the population — face catastrophic levels of hunger and that the territory is on the brink of famine. The humanitarian crisis deepened after Israeli forces pushed into Rafah on May 6, vowing to root out Hamas fighters. Tanks and troops seized the Rafah crossing into Egypt, closing it ever since. After May 10, only about three dozen trucks made it into Gaza via the nearby Kerem Shalom crossing from Israel because fighting makes it dangerous for aid workers to reach it, the U.N. says.

685.
686.
687.
Israel insists it puts no restriction on the number of trucks entering Gaza. COGAT said 450 trucks entered Tuesday from its side to Kerem Shalom and a small crossing in northern Gaza. It said more than 650 trucks are waiting on the Gaza side of Kerem Shalom to be retrieved, blaming “lack of logistical capabilities and manpower gaps” among aid groups.

688.
689.
690.
For months, the U.N. has warned that an Israeli assault on Rafah could wreck the effort to get food, medicine and other supplies to Palestinians across Gaza. Throughout the war, Rafah has been filled with scenes of hungry children holding out pots and plastic containers at makeshift soup kitchens, with many families reduced to eating only one meal a day. The city's population had swelled at one point to some 1.3 million people, most of whom fled fighting elsewhere.

691.
692.
693.
The main agency for Palestinian refugees, UNRWA, announced the suspension of distribution in Rafah in a post on X, without elaborating beyond citing the lack of supplies. U.N. spokesman Stephane Dujarric said the UNRWA distribution center and the WFP's warehouses in Rafah were "inaccessible due to ongoing military operations.”

694.
695.
696.
Asked about the ramifications of suspending aid, Dujarric said simply: “People don’t eat.”

697.
698.
699.
Etefa said the WFP had also stopped distribution in Rafah after exhausting its stocks. It is still passing out hot meals and “limited distributions” of reduced food packages in central Gaza, but “food parcel stocks will run out within days,” she said.

700.
701.
702.
The U.S. depicted the floating aid pier as a potential route for accelerated deliveries. The first 10 trucks rolled off a ship onto the pier on Friday and were taken to a WFP warehouse. But a second shipment of 11 trucks on Saturday was met by Palestinian crowds who took supplies, and only five trucks made it to the warehouse, Etefa said.

703.
704.
705.
No further deliveries came from the pier on Sunday or Monday, she said.

706.
707.
708.
“The responsibility of ensuring aid reaches those in need does not end at the crossings and other points of entry into Gaza — it extends throughout Gaza itself,” she said.

709.
710.
711.
At the same time, battles have escalated in northern Gaza as Israeli troops conduct operations against Hamas fighters, who the military says regrouped in areas already targeted in offensives months ago.

712.
713.
714.
One of the main hospitals still operating in the north, Kamal Adwan, was forced to evacuate after it was “targeted” by Israeli troops, the Gaza Health Ministry said. Around 150 staff and dozens of patients fled the facility, including intensive care patients and infants in incubators “under fire from shelling,” it said. The Israeli military did not immediately reply to requests for comment.

715.
716.
717.
The nearby Awda hospital has been surrounded by troops the past three days, and an artillery shell hit its fifth floor, the hospital administration said Tuesday. A day earlier, the international medical aid group Doctors Without Borders said Awda had run out of drinking water.

718.
719.
720.
The war between began on Oct. 7, when Hamas-led militants crossed into Israel and killed some 1,200 people, mostly civilians, and took 250 hostage. ICC prosecutor Karim Khan accused Hamas leaders Yahya Sinwar, Mohammed Deif and Ismail Haniyeh of crimes against humanity, including extermination, murder and sexual violence.

721.
722.
723.
Israel responded to the Oct. 7 with an offensive that has laid waste to Gaza and killed more than 35,000 Palestinians, according to Gaza’s Health Ministry, which does not distinguish between noncombatants and fighters in its count.

724.
725.
726.
Monday's call by Khan for arrest warrants deepens Israel’s global isolation at a time when it is facing growing criticism from even its closest allies over the war. France, Belgium, and Slovenia each said they backed Khan' decision.

727.
728.
729.
Israeli Foreign Minister Israel Katz headed to France on Tuesday in response, urging it to “declare loud and clear” that the request for warrants against Netanyahu and Gallant "is unacceptable to you and to the French government.”

730.
731.
732.
His meetings there could set the tone for how countries navigate the warrants — if they are eventually issued — and whether they could pose a threat to Israeli leaders. A panel of three ICC judges will decide whether to issue the arrest warrants and allow a case to proceed. The judges typically take two months to make such decisions.

733.
734.
735.
Israel still has the support of its top ally, the United States, as well as other Western countries that spoke out against the decision. But if the warrants are issued, they could complicate international travel for Netanyahu and his defense minister, even if they do not face any immediate risk of prosecution because Israel itself is not a member of the court.

756.
SAN DIEGO (AP) — A federal judge on Tuesday dismissed the felony convictions of five retired military officers who had admitted to accepting bribes from a Malaysian contractor nicknamed “Fat Leonard” in one of the Navy’s biggest corruption cases.

757.
758.
759.
The dismissals came at the request of the government — not the defense — citing prosecutorial errors.

760.
761.
762.
Retired U.S. Navy officers Donald Hornbeck, Robert Gorsuch and Jose Luis Sanchez, and U.S. Marine Corps Col. Enrico DeGuzman had all admitted to accepting bribes from defense contractor Leonard Francis, nicknamed " Fat Leonard."

763.
764.
765.
The enigmatic figure — who was 6-foot-3 and weighed 350 pounds at one time — is at the center of the Navy’s most extensive corruption cases in recent history.

766.
767.
768.
The three pleaded guilty to a misdemeanor charge of disclosing information on Tuesday. The judge also dismissed the entire case against U.S. Navy officer Stephen Shedd. Their defense lawyers could not be immediately reached for comment.

769.
770.
771.
It marked the latest setback to the government’s yearslong efforts in going after dozens of military officials tied to Francis, who pleaded guilty to offering more than $500,000 in cash bribes, along with other gifts and wild sex parties in Southeast Asia, to Navy officials, defense contractors and others. The scheme allowed him to bilk the maritime service out of at least $35 million by getting commanders to redirect ships to ports he controlled and overcharging for services, according to the prosecution.

772.
773.
774.
Francis owned and operated Singapore-based Glenn Defense Marine Asia Ltd., which supplied food, water and fuel to U.S. Navy vessels. He was arrested in 2013 in a sting operation in San Diego.

775.
776.
777.
Prosecutors said in legal filings outlining their request for Tuesday’s dismissals that the action does not mean the defendants did not commit the charged crimes but because information was withheld from the defense and other mistakes were made, they wanted to ensure justice was served fairly.

778.
779.
780.
In 2022, Judge Janis Sammartino had ruled the former lead federal prosecutor committed “flagrant misconduct” by withholding information from defense lawyers. In September, the felony convictions of four former Navy officers were also vacated. The four men pleaded guilty to a misdemeanor and agreed to pay a $100 fine each.

781.
782.
783.
The dismissals come weeks before Francis is due back in court to set a date for his sentencing.

784.
785.
786.
Francis returned to the U.S. late last year after a daring escape from his house arrest in San Diego in 2022. He fled to South America weeks before he was scheduled to be sentenced last year, and was later captured in Venezuela, which extradited him to the U.S. as part of a prisoner exchange.

787.
788.
789.
The escape was also seen by some as a misstep by the prosecution for allowing him to not be held behind bars.

803.
NEW YORK (AP) — Donald Trump's hush money trial moved into a new phase Tuesday, drawing closer to the moment when the jury will begin deciding his fate after testimony concluded without the former president taking the stand in his own defense.

804.
805.
806.
“Your honor, the defense rests,” Trump lawyer Todd Blanche told the judge. Trump's team ended with a former federal prosecutor who was called to attack the credibility of the prosecution’s key witness, one of two people summoned to the stand by the defense. The Manhattan district attorney's office called 20 witnesses over 15 days of testimony before resting its case Monday.

807.
808.
809.
The jury was sent home for a week, until May 28, when closing arguments are expected, but the attorneys returned to the courtroom to debate how the judge will instruct jurors on deliberations, a sort of road map meant to help them apply the law to the evidence and testimony. The two sides haggled over word choices, legal phrases and how to describe various campaign-related issues.

810.
811.
812.
Trump, the first former American president to be tried criminally, did not answer questions about why he did not testify.

813.
814.
815.
Trump had previously said he wanted to take the witness stand in his own defense, but there was no requirement or even expectation that he do so. Defendants routinely decline to testify. His attorneys, instead of mounting an effort to demonstrate Trump’s innocence to jurors, focused on attacking the credibility of the prosecution witnesses. That’s a routine defense strategy; the burden of proof in a criminal case lies with the prosecution. The defense doesn’t have to prove a thing.

816.
817.
818.
Yet even as Trump denounces the trial as a politically motivated travesty of justice, he has been working to turn the proceedings into an offshoot of his presidential campaign. He's capitalized on the trial as a fundraising pitch, used his time in front of the cameras to criticize President Joe Biden and showcased a parade of his own political supporters.

819.
820.
821.
Prosecutors have accused the presumptive Republican presidential nominee of a scheme to scoop up and bury negative stories in an illegal effort to influence the 2016 presidential election. Trump has pleaded not guilty to falsifying business records to conceal the alleged scheme and denied any wrongdoing. It’s the first of Trump’s four criminal cases to go to trial, and quite possibly the only one before the 2024 presidential election.

822.
823.
824.
“They have no case,” Trump said outside court. “There’s no crime.”

825.
826.
827.
He also again attacked the prosecutor, despite repeated warnings from Judge Juan M. Merchan not to violate a gag order that bars him from publicly commenting on witnesses, prosecutors, court staff or the judge's family.

828.
829.
830.
Jurors have been given a lesson on the underbelly of the tabloid business world, where Trump allies at the National Enquirer launched a plan to keep seamy, sometimes outrageous stories about Trump out of the public eye by paying tens of thousands of dollars to “catch and kill” them. They watched as a porn actress, Stormy Daniels, recounted in discomfiting detail an alleged sexual encounter with Trump in a hotel room. Trump says nothing sexual happened between them.

831.
832.
833.
And they sat intently in the jury box as Trump's former-lawyer-turned-foe Michel Cohen placed Trump in the middle of the scheme to buy Daniels' story to keep it from going public in the waning weeks before the 2016 presidential election. During that time, Republicans were wringing their hands in distress over the potential political fallout from the infamous “Access Hollywood" tape, where Trump bragged about grabbing women sexually without asking permission.

834.
835.
836.
But the crux of the prosecution's case centers not on the spectacle but on business transactions, including internal Trump Organization records in which payments to Cohen were labeled legal expenses. Prosecutors argued that those payments were really reimbursements to Cohen, doled out in chunks, for a $130,000 payment he made on Trump's behalf to keep Daniels quiet.

837.
838.
839.
Trump has been charged with 34 counts of falsifying business records. The offense is in the lowest tier of felony charges in New York state, and it is punishable by up to four years in prison, though there is no guarantee that a conviction would result in prison time.

840.
841.
842.
Trump’s son Donald Trump Jr. defended his father’s decision not to testify.

843.
844.
845.
“There’d be absolutely no reason, no justification to do that whatsoever. Everyone sees it for the sham that it is,” the younger Trump said as he left a news conference with supporters of the former president outside the courthouse.

846.
847.
848.
The judge has yet to rule on a defense request to throw out the charges, before jurors even begin deliberating, based on the argument that prosecutors have failed to prove their case. Such long-shot requests are often made in criminal cases but are rarely granted.

849.
850.
851.
The final witness was Robert Costello, a former federal prosecutor, who was first called Monday afternoon and who angered the judge by rolling his eyes and talking under his breath. The judge cleared the courtroom and threatened to remove Costello if he didn’t show more respect.

852.
853.
854.
Tuesday's testimony was absent the same kind of drama as Trump's lawyers sought to use Costello to undermine Cohen's credibility. The two had a professional relationship that splintered in spectacular fashion. Costello had offered to represent Cohen soon after the lawyer’s hotel room, office and home were raided and as Cohen faced a decision about whether to remain defiant in the face of a criminal investigation or to cooperate with authorities in hopes of securing more lenient treatment.

855.
856.
857.
Costello bristled as he insisted to prosecutors that he did not feel animosity toward Cohen and did not try to intimidate him. “Ridiculous. No,” he said to the latter.

858.
859.
860.
But Costello has repeatedly maligned Cohen’s credibility and was even a witness before last year’s grand jury that indicted Trump, offering testimony designed to undermine Cohen’s account. In a Fox News Channel interview last week, Costello accused Cohen of lying to the jury and using the case to “monetize” himself.

861.
862.
863.
Prosecutors sought to show that Costello was part of a pressure campaign to manipulate and arm-twist Cohen in order to keep him in Trump’s corner once he came under federal investigation. Prosecutor Susan Hoffinger asked Costello about a 2018 email in which he assured Cohen that he was “loved” by Trump’s camp, “they are in our corner” and “you have friends in high places.”

864.
865.
866.
Asked who those “friends in high places” were, Costello said he was talking about Trump, then the president.

867.
868.
869.
Trump lawyer Emil Bove tried to undo that portrayal.

870.
871.
872.
“Did you ever pressure Michael Cohen to do anything?” Bove asked.

873.
874.
875.
“No,” Costello replied.

876.
877.
878.
After the defense rested, the judge dismissed the jurors and looked ahead to closing arguments — the last time the jury will hear from either side. Deliberations could begin as early as next Wednesday, giving the panel their first chance to talk about the case. Until then, they're barred from discussing it.

879.
880.
881.
“I’ll see you in a week,” Merchan told the jury.

902.
DES MOINES, Iowa (AP) — Storms that pummeled much of Nebraska with torrential rain, high winds and large hail spun up fierce tornados Tuesday that took down several 250-foot (76 meters) wind turbines in Iowa and causing extensive damage in at least one rural town.

903.
904.
905.
Des Moines, Iowa, television station KCCI-TV showed at least three wind turbines that were toppled by an apparent tornado in southwest Iowa, and at least one was in flames with black smoke pluming from the bent structure.

906.
907.
908.
Other images posted on social media showed extensive damage in Greenfield, a town of about 2,000 around 55 miles (88.51 kilometers) southwest of Des Moines.

909.
910.
911.
In far southwestern Iowa, video posted to social media showed a tornado just northwest of Red Oak. Further east and north, the National Weather Service issued multiple tornado warnings for areas near the towns of Griswold, Corning, Fontanelle and Guthrie Center, among others.

912.
913.
914.
Camille Blair said the Greenfield Chamber of Commerce office where she works closed around 2 p.m. ahead of the storm. She emerged from her home to describe widespread damage and scattered debris.

915.
916.
917.
“There’s a pretty significant roof damage to several houses that I know will need whole new roofs," she said. "And I can see from my house it kind of went in a straight line down the road.”

918.
919.
920.
In far southwestern Iowa, video posted to social media showed a tornado just northwest of Red Oak. Further east and north, the National Weather Service issued multiple tornado warnings for areas near the towns of Griswold, Corning, Fontanelle and Guthrie Center, among others.

921.
922.
923.
Iowa was already braced for severe weather after the National Weather Service’s Storm Prediction Center gave most of the state a high chance of seeing severe thunderstorms with the potential for strong tornadoes. Des Moines public schools ended classes two hours early and canceled all evening activities ahead of the storms.

924.
925.
926.
Earlier in the day, residents to the west in Omaha, Nebraska, awoke to weather sirens blaring and widespread power outages as torrential rain, high winds and large hail pummeled the area. Thousands of customers lost power and the deluge of more than 5 inches (12.7 centimeters) of rain in less than two hours flooded basements and submerged cars. Television station KETV showed firefighters arriving to rescue people from vehicles.

927.
928.
929.
In Illinois, dust storms forced authorities to shut down stretches of two interstates due to low visibility. Winds gusts of between 35 mph (56 kph) and 45 mph (74 kph) hit the McLean area, according to National Weather Service meteorologist Chuck Schaffer.

930.
931.
932.
“There is no visibility at times,” state police posted on X, formerly Twitter.

933.
934.
935.
The storms follow days of extreme weather that have ravaged much of the middle section of the country. Strong winds, large hail and tornadoes swept parts of Oklahoma and Kansas late Sunday, damaging homes and injuring two in Oklahoma.

936.
937.
938.
Another round of storms Monday night raked Colorado and western Nebraska and saw the city of Yuma, Colorado, blanketed in hail the size of baseballs and golf balls, turning streets into rivers of water and ice. Residents cleaned up Tuesday using heavy construction equipment and snow shovels to clear ice that had piled up knee-deep.

939.
940.
941.
The storm in Yuma shattered vehicle windshields, pounded the siding off buildings and broke many windows. lt also brought heavy rain to the city of about 3,500 people about 40 miles (64 kilometers) west of Nebraska, stranding some cars in the streets. The hail was still about a half-foot deep (1.83 meters deep) on Tuesday morning and front-end loaders were used to move it, said Curtis Glenn, a trustee at Yuma Methodist Church, which had flooding and hail damage.

942.
943.
944.
Glenn, an insurance claims adjuster, said the combined sounds of the hail, rain and wind sounded like “a gun going off while you’re on a train.”

945.
946.
947.
“It’s not something you ever want to see or ever want to see again,” he said of the storm, the worst he has seen in his years working in the insurance industry.

948.
949.
950.
Last week, deadly storms hit the Houston area in Texas, killing at least seven. Those storms Thursday knocked out power to hundreds of thousands for days, leaving those Texans in the dark and without air conditioning during hot and humid weather. Hurricane-force winds reduced businesses and other structures to debris and shattered glass in downtown skyscrapers.

951.
952.
953.
Tuesday's storms were expected to bring much of the same high winds, heavy rain and large hail to Minnesota, Illinois and part of northern Missouri, said Bob Oravec, lead forecaster with the National Weather Service.

954.
955.
956.
He said the system is expected to turn south on Wednesday, bring more severe weather to parts of Texas, Oklahoma, Arkansas and southern Missouri.

977.
LONDON (AP) — A man charged with assisting Hong Kong authorities with gathering intelligence in the United Kingdom has died in unexplained circumstances, British police said Tuesday.

978.
979.
980.
Matthew Trickett, 37, was one of three men charged earlier this month with agreeing to engage in information gathering, surveillance and acts of deception that were likely to materially assist the Hong Kong intelligence service from late 2023 to May 2. Prosecutors also alleged that the men forced entry into a U.K. residential address on May 1.

981.
982.
983.
The men had all been bailed and were next due to appear at London's Central Criminal Court for a hearing on Friday. They haven't yet entered pleas.

984.
985.
986.
Thames Valley Police said Trickett was found dead in a park in Maidenhead, west of London, on Sunday afternoon after a report from a member of the public.

987.
988.
989.
Police said that an investigation is ongoing into the death, which is being treated as unexplained.

990.
991.
992.
British media reports said Trickett was formerly a Royal Marine who recently worked as a Home Office immigration enforcement officer. He was also reportedly the director of a security consultancy.

993.
994.
995.
He was charged along with Chi Leung (Peter) Wai, 38, and Chung Biu Yuen, 63. The men appeared at a brief court hearing to confirm their identities on May 13.

996.
997.
998.
Hong Kong authorities have confirmed that Yuen was the office manager of the Hong Kong Economic and Trade Office in London.

999.
1000.
1001.
Trickett’s lawyer, Julian Hayes, said he was “shocked” at Tuesday's news and was supporting Trickett's family. He declined to comment, because investigations were ongoing.

1002.
1003.
1004.
A police cordon remained in place in Grenfell Park in Maidenhead late Tuesday, with several officers stationed next to a black forensics tent located close to a children’s playground.

1005.
1006.
1007.
Chinese authorities in both the U.K. and Hong Kong have decried the charges, saying they were the latest in a series of “groundless and slanderous” accusations that the U.K. government has leveled against China.

1008.
1009.
1010.
Hong Kong's government demanded that the U.K. provide full details on the allegations and protect the rights of the office manager of the trade office.

1011.
1012.
1013.
The spying charges came amid simmering tensions between Britain and China. U.K. officials have been increasingly vocal in warning about security threats from Beijing, and recently accused China of being behind a string of cyberespionage operations targeting politicians and Britain's election watchdog.

1014.
1015.
1016.
Prime Minister Rishi Sunak has said Britain is facing an increasingly dangerous future because of threats from an “axis of authoritarian states,” including Russia, China, Iran and North Korea.

1017.
1018.
1019.
In a separate and ongoing court case, two men, including a parliamentary researcher, were recently charged with spying for China. Christopher Cash and Christopher Berry were charged with violating the Official Secrets Act by providing information or documents that could be “useful to an enemy” — China — and “prejudicial to the safety or interests” of the U.K. between late 2021 and February 2023.

1020.
1021.
1022.
Hong Kong, a former British colony, returned to Chinese control as a semiautonomous territory in 1997.

1023.
1024.
1025.
More than 100,000 Hong Kongers have moved to the U.K. since Beijing imposed a sweeping national security law triggered by the huge anti-government protests in the city in 2019. Britain’s government has established a fast-track immigration route for the migrants, many of whom want to settle in the U.K. because of dwindling civil liberties in their home city.

1026.
1027.
1028.
Rights groups have warned that Hong Kongers who have moved to Britain continue to face “transnational repression” by supporters of the Chinese government.

1042.
JERUSALEM (AP) — The Israeli government will return a camera and broadcasting equipment it had seized from The Associated Press on Tuesday, reversing course hours after it blocked the news organization's live video of Gaza and faced mounting criticism for interfering with independent journalism.

1043.
1044.
1045.
The AP’s live video of Gaza was back up early Wednesday in Israel.

1046.
1047.
1048.
The government seized the AP equipment positioned in southern Israel after accusing it of violating a new media law by providing images to the satellite channel Al Jazeera.

1049.
1050.
1051.
Israeli officials used the new law on May 5 to close down Qatar-based Al Jazeera within Israel, confiscating its equipment, banning its broadcasts and blocking its websites.

1052.
1053.
1054.
After Israel seized the AP equipment, the Biden administration, journalism organizations and an Israeli opposition leader condemned the government of Prime Minister Benjamin Netanyahu and pressured it to reverse the decision.

1055.
1056.
1057.
Israel's communications minister, Shlomo Karhi, said late Tuesday on the social platform X: “I have now ordered to cancel the action and return the equipment to the AP.”

1058.
1059.
1060.
Karhi said the defense ministry will undertake a review of news outlets' positioning of live video of Gaza. Officials hadn't previously told AP the positioning of its live camera was an issue. Instead, they repeatedly noted that the images appeared in real-time on Al Jazeera.

1061.
1062.
1063.
Al Jazeera is one of thousands of AP customers, and it receives live video from AP and other news organizations.

1064.
1065.
1066.
“While we are pleased with this development, we remain concerned about the Israeli government’s use of the foreign broadcaster law and the ability of independent journalists to operate freely in Israel," said Lauren Easton, AP's vice president of corporate communications.

1067.
1068.
1069.
Officials from the Communications Ministry arrived at the AP location in the southern town of Sderot on Tuesday afternoon and seized the equipment. They handed the AP a piece of paper, signed by Karhi, alleging it was violating the country’s foreign broadcaster law.

1070.
1071.
1072.
Shortly beforehand, AP was broadcasting a general view of northern Gaza. The AP complies with Israel’s military censorship rules, which prohibit broadcasts of details like troop movements that could endanger soldiers. The live video has generally shown smoke rising over the territory.

1073.
1074.
1075.
The AP had been ordered verbally last Thursday to cease the live transmission, which it refused to do.

1076.
1077.
1078.
Israel’s opposition leader Yair Lapid called the government's move against AP “an act of madness.”

1079.
1080.
1081.
Karhi responded to Lapid that the law passed unanimously by the government states that any device used to deliver Al Jazeera content could be seized.

1082.
1083.
1084.
Journalism organizations condemned Israel's seizure of AP equipment, and the Biden administration also applied pressure.

1085.
1086.
1087.
“As soon as we learned about the reports, the White House and the State Department immediately engaged with the government of Israel at high levels to express our serious concern and ask them to reverse this action," said Adrienne Watson, a spokesperson for the National Security Council. "The free press is an essential pillar of democracy and members of the media, including AP, do vital work that must be respected.”

1088.
1089.
1090.
When Israel closed down Al Jazeera's offices earlier this month, media groups warned of the serious implications for press freedom in the country.

1091.
1092.
1093.
“Israel's record on press freedom already has been dismal throughout the war,” the Foreign Press Association said in a statement on Tuesday. “It has prevented independent access to Gaza for foreign journalists.”

1094.
1095.
1096.
The AP live video shot from Sderot has provided a rare independent glimpse of the situation in Gaza.

1097.
1098.
1099.
Israel has long had a rocky relationship with Al Jazeera, accusing it of bias against the country. Netanyahu has called it a “terror channel” that spreads incitement.

1100.
1101.
1102.
Al Jazeera is one of the few international news outlets that has remained in Gaza throughout the war, broadcasting scenes of airstrikes and overcrowded hospitals and accusing Israel of massacres. AP is also in Gaza.

1103.
1104.
1105.
During the previous Israel-Hamas war in 2021, the army destroyed the building housing AP’s Gaza office, claiming Hamas had used the building for military purposes. The AP denied any knowledge of a Hamas presence, and the army never provided any evidence to back up its claim.

1106.
1107.
1108.
The war in Gaza began with a Hamas attack in Israel that killed 1,200 people and saw 250 others taken hostage. More than 35,000 Palestinians have been killed since then, according to Gaza’s Health Ministry, which doesn’t distinguish between civilians and combatants in its count.

1135.
WASHINGTON (AP) — An appeals court refused Tuesday to halt Hunter Biden's federal gun trial set to begin in two weeks, during his father’s reelection campaign.

1136.
1137.
1138.
The full 3rd U.S. Circuit Court of Appeals refused to pause the case against the president's son while his challenges to the prosecution on multiple fronts play out. His bid to dismiss the case had previously been rejected by a three-judge panel.

1139.
1140.
1141.
Defense attorneys for the president’s son had argued there was no urgent need to start the trial on June 3. They also cited the short time between the Delaware trial and the start of another trial on tax charges in California tentatively set to begin the same month.

1142.
1143.
1144.
Hunter Biden has pleaded not guilty to lying about his drug use in October 2018 on a form to buy a gun that he kept for about 11 days in Delaware. He has acknowledged an addiction to crack cocaine during that period, but his lawyers have said he didn’t break the law.

1145.
1146.
1147.
Defense attorneys are also appealing a separate decision from U.S. District Judge Maryellen Noreika rejecting a claim that the case violates the Constitution’s Second Amendment on firearm ownership.

1148.
1149.
1150.
The investigation had looked ready to wrap up with a plea deal last year, but the agreement imploded after a judge raised questions about it. Biden was subsequently indicted by Justice Department special counsel David Weiss in both Delaware and California, where he's accused of failing to pay at least $1.4 million in taxes over three years while living an “extravagant lifestyle,” during his days of using drugs. He is separately challenging rulings rejecting his motions to dismiss those charges.

1165.
NEW YORK (AP) — The defense rested its case in Donald Trump's hush money trial on Tuesday morning without the former president taking the witness stand to testify, bringing proceedings one step closer to closing arguments.

1166.
1167.
1168.
After more than four weeks of testimony, jurors were sent home with Judge Juan M. Merchan telling them they wouldn’t be needed in court until closing arguments next Tuesday. Merchan suggested the court session may run late that day to accommodate summations from both sides — the defense and prosecution. Merchan told jurors he then expects his instructions to them will take about an hour.

1169.
1170.
1171.
Jurors could begin deliberating as soon as next week to decide whether Trump is guilty of 34 felony counts of falsifying business records.

1172.
1173.
1174.
Prosecutors have accused Trump of a scheme to bury negative and often salacious stories that might have torpedoed his 2016 presidential campaign and then falsifying internal business records to cover up hush money payments associated with the alleged scheme. He has denied the allegations.

1175.
1176.
1177.
Prosecutors rested their case Monday after star witness Michael Cohen concluded his testimony. Cohen spent nearly four full days on the witness stand, placing the former president directly at the center of the alleged scheme. The defense called just two witnesses following the conclusion of Cohen's testimony — paralegal Daniel Sitko and attorney Robert Costello.

1178.
1179.
1180.
The trial is in its 20th day.

1181.
1182.
1183.
Trump has pleaded not guilty to 34 felony counts.

1184.
1185.
1186.
The case is the first-ever criminal trial of a former U.S. president and the first of four prosecutions of Trump to reach a jury.

1210.
TRUMP SPEAKS AFTER COURT, APPEARS TO CRITICIZE PROSECUTOR

1211.
1212.
1213.
In remarks to reporters after court wrapped in his hush money trial on Tuesday, Donald Trump at several points appeared to be criticizing one of the prosecutors, Matthew Colangelo, though he did not name him.

1214.
1215.
1216.
Trump is under a gag order that bars him from publicly commenting on prosecutors other than Manhattan District Attorney Alvin Bragg, in addition to witnesses, court staff and the family of Judge Juan M. Merchan.

1217.
1218.
1219.
“Look at the person, look at the person who argued almost the entire case. Where did he come from? He came from Biden,” Trump said.

1220.
1221.
1222.
Colangelo is a former Justice Department official who was hired by Bragg to lead the Trump investigation.

1223.
1224.
1225.
Later referring to “the man who did all the talking” Trump added: “He wasn’t at the DA’s office … He came in for one reason, and where did he come from? He came from Washington, D.C., the White House and the DOJ. And he argued the case. That means it’s Biden, that means it’s election interference.”

1226.
1227.
1228.
JUDGE CHIDES DEFENSE OVER ATTEMPT TO RAISE PRIOR ARGUMENT

1229.
1230.
1231.
Before court adjourned for the day on Tuesday, the judge in Donald Trump's hush money trial became stern over what he described as a “disingenuous” defense effort to raise an argument that had been foreclosed months ago.

1232.
1233.
1234.
Trump lawyer Emil Bove asked for a jury instruction that would get at, as he put it, “the fact that this entire trial was based on the word of an attorney who worked for President Trump, and he was entitled to draw some inferences from that” about the legality of various things.

1235.
1236.
1237.
However, the argument presented a problem: the defense said months ago that it wasn’t going to use what’s known as an advice-of-counsel defense — that a defendant’s conduct was guided by a lawyer’s OK.

1238.
1239.
1240.
By deciding against it, the defense didn’t have to waive Trump’s attorney-client privilege or turn over various documents, Judge Juan M. Merchan noted.

1241.
1242.
1243.
But, he complained, the defense has since tried to invoke the advice-of-counsel concept under different names, such as “presence of counsel” or “involvement of counsel.”

1244.
1245.
1246.
“My answer hasn’t changed, and honestly, I find it disingenuous for you to make the argument at this point,” he told Bove, who started to rise to respond.

1247.
1248.
1249.
The judge cut him off: “Please don’t get up. I let you speak,” he said, then added that he wouldn’t give that particular jury instruction, nor let the defense make such an argument in summations.

1250.
1251.
1252.
DEFENSE SEEKS TO EXPAND INSTRUCTIONS THE JURY HAS ALREADY HEARD

1253.
1254.
1255.
Before deliberating, jurors in Donald Trump's hush money case are likely to hear some of the same instructions they’ve already heard during the trial regarding certain testimony and evidence.

1256.
1257.
1258.
Trump’s lawyers are seeking to expand some of those instructions, proposing one that claims National Enquirer publisher American Media Inc. “did not admit to any violations of the law” in a non-prosecution agreement it reached with federal prosecutors in 2018 over its hush money payments to Karen McDougal and a Trump Tower doorman.

1259.
1260.
1261.
Prosecutor Joshua Steinglass called that proposal “outrageous” during Tuesday's charging conference.

1262.
1263.
1264.
“I wasn’t trying to be outrageous,” Trump attorney Emil Bove dryly replied.

1265.
1266.
1267.
Under the agreement, federal prosecutors agreed not to prosecute AMI in exchange for its cooperation in a campaign finance investigation that led to Michael Cohen’s guilty plea and prison sentence that same year.

1268.
1269.
1270.
The Federal Election Commission fined the company $187,500, deeming the McDougal deal as a “prohibited corporate in-kind contribution.”

1271.
1272.
1273.
Bove argued that describing AMI’s agreement to the jury is “a critical issue.”

1274.
1275.
1276.
“We do not intend to argue that Michael Cohen’s guilty plea or AMI’s non-prosecution agreement are evidence of the defendant’s guilt,” Steinglass said, noting that the proposed instructions would inform jurors that they could use the agreements in assessing the witnesses’ credibility.

1277.
1278.
1279.
JURY INSTRUCTION DEBATE TURNS TO TYPES OF PAYMENTS AT ISSUE

1280.
1281.
1282.
Debate over jury instruction in Donald Trump's criminal trial has shifted to the payments at the heart of the case.

1283.
1284.
1285.
Trump lawyer Emil Bove sought an instruction informing jurors that the types of hush money payments in Trump’s case are not inherently illegal.

1286.
1287.
1288.
“What the defense is asking is for you to make their argument for them in the jury charge,” prosecutor Joshua Steinglass countered, saying it was “totally inappropriate.”

1289.
1290.
1291.
Merchan said such an instruction would go too far and isn’t necessary.

1292.
1293.
1294.
LAWYERS SPAR OVER INCLUSION OF TAX-RELATED INSTRUCTIONS TO JURY

1295.
1296.
1297.
To convict Donald Trump in the hush money case, jurors must find his business records were falsified to commit or conceal another crime.

1298.
1299.
1300.
Trump’s lawyers took issue with the prosecution’s push to include violations of tax law as one of those other alleged crimes, arguing Tuesday that the evidence was insufficient to support that claim. They want Judge Juan M. Merchan to strike tax-related instructions from the jury instructions.

1301.
1302.
1303.
Prosecutor Matthew Colangelo countered that Trump and his top lieutenants at the Trump Organization were trying “to camouflage” reimbursements to Michael Cohen by paying them as income and increasing, or “grossing up,” the payments so he wouldn’t lose money on taxes.

1304.
1305.
1306.
Typically, business expenses are repaid as tax-free reimbursements. Cohen’s payments included a reimbursement for the $130,000 hush money payment he made to porn actor Stormy Daniels on the eve of the 2016 election.

1307.
1308.
1309.
“Falsely identifying corporate payments as income rather than reimbursement” is a tax law violation, Colangelo argued.

1310.
1311.
1312.
Trump lawyer Emil Bove countered that there’s no evidence Trump or his company derived a tax benefit from the arrangement with Cohen.

1313.
1314.
1315.
DEBATE TURNS TO ONE'S PRESENCE WHEN OTHERS AGREE TO COMMIT A CRIME

1316.
1317.
1318.
Donald Trump’s defense team argued for a jury instruction that any evidence that he was present when others agreed to commit a crime doesn’t, in itself, prove he agreed to engage in such a conspiracy.

1319.
1320.
1321.
Trump lawyer Emil Bove said that was important in light of testimony about Trump’s presence “in certain rooms at certain times” — an apparent reference to such episodes as the much-discussed 2015 Trump Tower meeting involving the then-candidate; Michael Cohen; then-National Enquirer publisher David Pecker and then-Trump aide Hope Hicks.

1322.
1323.
1324.
Pecker testified that he agreed at that meeting to be the campaign’s “eyes and ears” for potentially damaging rumors and stories so they could be suppressed.

1325.
1326.
1327.
Bove maintained that those were “pretty standard campaign activities,” but that the jury still should get that instruction.

1328.
1329.
1330.
Prosecutor Matthew Colangelo argued that “there just is no reasonable view of the evidence that” the meeting was a benign, “high-minded discussion of democracy.” And he maintained that the instruction would be confusing for jurors.

1331.
1332.
1333.
The judge hasn’t yet decided.

1334.
1335.
1336.
JUDGE SIDES WITH PROSECUTION, SAYING IT WOULD BE WRONG TO DEVIATE FROM STANDARD INSTRUCTIONS

1337.
1338.
1339.
Following several exchanges focused on minute wording changes and dense legal arguments related to jury instructions, defense attorneys in Donald Trump's hush money case urged the judge to consider the “extraordinarily important” nature of the case when issuing his jury instructions.

1340.
1341.
1342.
The judge, Trump attorney Emil Bove argued, should use his discretion to urge jurors to reach “very specific findings” so that “it’s very clear what happened at this trial.”

1343.
1344.
1345.
“The importance of the case is not a basis for deviating from the standard instructions on the law,” prosecutor Matthew Colangelo shot back.

1346.
1347.
1348.
Judge Juan M. Merchan sided with prosecutors, agreeing that it would be wrong to deviate from the standard instructions, even as he said he understood the defense’s larger point.

1349.
1350.
1351.
“When you say it’s a very important case, you’re asking me to change the law and I’m not going to do that,” Merchan said.

1352.
1353.
1354.
LAWYERS SPAR OVER WHAT ‘INTENDING TO DEFRAUD’ MEANS

1355.
1356.
1357.
In another difference in the debate over jury instructions, the prosecution in Donald Trump's criminal trial wants jurors to be told that the concept of intending to defraud someone doesn’t necessarily mean the aim is to con someone out of money or property.

1358.
1359.
1360.
The defense, meanwhile, wants an instruction that the concept is about having a “conscious objective or purpose to lead another into” something to that person’s disadvantage.

1361.
1362.
1363.
The judge hasn’t yet decided on this issue.

1364.
1365.
1366.
AT THE DEFENSE TABLE

1367.
1368.
1369.
As attorneys on both sides in Donald Trump's hush money trial haggled over the proposed tweaks to the jury instructions on Tuesday afternoon, the former president arranged sheets of papers on the desk before him.

1370.
1371.
1372.
After shuffling the stack on his knee, Trump directed his lawyer, Todd Blanche, to look at an image on one of the papers. Blanche smiled, cupped his hand over his mouth and then resumed listening to the conference.

1373.
1374.
1375.
Trump had started the hearing in his usual pose: leaned back in his chair with his eyes closed.

1376.
1377.
1378.
There was a markedly different atmosphere in the courtroom as the charging conference dragged on. The jurors were gone and there were several rows of empty seats in the gallery, which was packed earlier in the day for the conclusion of testimony.

1379.
1380.
1381.
CHALLENGING TERMINOLOGY INTRODUCES MOMENT OF HUMOR

1382.
1383.
1384.
Doling out a little humor at an otherwise dry charging conference, Judge Juan M. Merchan decided to remove a bit of legalese from the jury instructions after admitting he has no idea to pronounce it.

1385.
1386.
1387.
Joking that “the most challenging thing” facing him and the parties was figuring out how to pronounce the word “eleemosynary,” which means relating to charity or charitable.

1388.
1389.
1390.
“I’ve said it 100 times and I don’t know how to say it,” Merchan said. “So why do we need it?”

1391.
1392.
1393.
Merchan then elected to strike the word from jury instructions, but not before offering a little charity himself: spelling it for the court stenographer diligently taking down every word said in court.

1394.
1395.
1396.
WHAT SHOULD JURORS BE TOLD ABOUT CAMPAIGN-RELATED EXPENSES PAID FOR BY THE CANDIDATE?

1397.
1398.
1399.
As lawyers in Donald Trump's criminal case spar over the details of jury instructions, another point of contention has cropped up: what jurors will be told about how to view situations in which political candidates pay for things that aid their campaigns but also have other upsides.

1400.
1401.
1402.
Prosecutors want an instruction that someone’s status as a candidate doesn’t need to be the sole motivation for making a payment that benefits the campaign. Defense lawyers, meanwhile, want jurors to be told that if a payment would have been made even if the person wasn’t running, it shouldn’t be treated as a campaign contribution.

1403.
1404.
1405.
Merchan said he’ll decide later but is inclined to include both.

1406.
1407.
1408.
JUDGE DENIES DEFENSE REQUEST FOR CAMPAIGN FINANCE LAW LANGUAGE IN JURY INSTRUCTIONS

1409.
1410.
1411.
Judge Juan M. Merchan denied a defense request that he tell the jury in Donald Trump's criminal trial that there was no limit on federal candidates’ contributions to their own 2016 campaigns.

1412.
1413.
1414.
Trump lawyer Emil Bove suggested the language would help the jury “have a full picture of what constitutes contributions and expenditures” and understand that Trump could have paid such sums as the Stormy Daniels payout — if it were deemed a campaign contribution — from his own funds. Prosecutor Matthew Colangelo countered that campaign self-funding rules were “extraneous and totally irrelevant” to the case.

1415.
1416.
1417.
Merchan concluded it was unnecessary but told defense lawyers they could argue in their summation that Trump could have paid Daniels himself, instead of Cohen doing so.

1418.
1419.
1420.
DISCUSSION OF JURY INSTRUCTIONS BEGINS

1421.
1422.
1423.
Prosecutors and defense lawyers in Donald Trump's hush money trial began delving into the matter of jury instructions Tuesday afternoon during a charging conference.

1424.
1425.
1426.
“Charging conferences” about jury instructions are often highly detailed, word-by-word discussions, and the one for Trump's trial was no different. The conference began with the defense asking to insert the word “willfully” at two points in a section of the instruction having to do with federal election law, and prosecutors saying it was unnecessary.

1427.
1428.
1429.
TRUMP SPEAKS BEFORE DISCUSSION WITH JUDGE ON JURY INSTRUCTIONS

1430.
1431.
1432.
Speaking to reporters in the hallway outside the courtroom where his hush money trial is being held, Donald Trump did not address why he didn’t testify in the trial.

1433.
1434.
1435.
With a charging conference set to take place this afternoon, Trump suggested that the judge could try to “manufacture” a crime.

1436.
1437.
1438.
“There is no crime. So maybe they’ll try to devise one right now,” he said. “The judge has been very helpful to the other side.”

1439.
1440.
1441.
A REMINDER OF THE CHARGES, AND WHAT MUST BE PROVED FOR A CONVICTION

1442.
1443.
1444.
Donald Trump is charged with 34 counts of falsifying business records in his hush money case.

1445.
1446.
1447.
The charge is a Class E felony in New York, the lowest tier of felony charges in the state. It is punishable by up to four years in prison, though there is no guarantee that a conviction would result in prison time.

1448.
1449.
1450.
To convict Trump, prosecutors must convince jurors beyond a reasonable doubt that he not only falsified or caused business records to be entered falsely — which would be a misdemeanor — but also that he did so to conceal another crime, making the charges felonies. Prosecutors allege the other crimes included violations of campaign finance and election law.

1451.
1452.
1453.
Any verdict must be unanimous.

1454.
1455.
1456.
New York court records and newspaper archives show defendants convicted of felony falsifying business records charges are seldom sentenced to prison for that offense alone. Often, the charge is coupled with more serious felonies like grand larceny.

1457.
1458.
1459.
Trump’s case involves only charges of falsifying business records. He has pleaded not guilty to the charges and denies any wrongdoing.

1460.
1461.
1462.
WHO IS ON THE JURY?

1463.
1464.
1465.
The jury in Donald Trump’s hush money trial is comprised of 18 Manhattan residents. The main jury includes seven men and five women.

1466.
1467.
1468.
Six alternate jurors have listened to the testimony, but won’t join in the deliberations unless one of the main jurors needs to drop out or is removed.

1469.
1470.
1471.
The jurors represent a diverse cross-section of the borough and come from various professional backgrounds, including a sales professional, a software engineer, a security engineer, a teacher, a speech therapist, several lawyers, an investment banker and a retired wealth manager.

1472.
1473.
1474.
A RECAP OF THE TESTIMONY JURORS HEARD IN THE CASE

1475.
1476.
1477.
Across more than four weeks of testimony in Donald Trump's hush money trial, prosecutors called 20 witnesses. The defense called just two.

1478.
1479.
1480.
Among the prosecution’s key witnesses: Trump’s former fixer Michael Cohen, porn actor Stormy Daniels, tabloid publisher David Pecker and lawyer Keith Davidson, who negotiated hush money deals for Daniels and former Playboy model Karen McDougal.

1481.
1482.
1483.
Cohen testified that he paid $130,000 in hush money to Daniels at Trump’s behest weeks before the 2016 election to keep her quiet about her claims of a sexual encounter with him a decade earlier. He also said that Trump was involved in an arrangement to reimburse him and log the payments as legal expenses.

1484.
1485.
1486.
Daniels gave an at-times graphic account of the alleged encounter. Pecker testified about agreeing to be the “eyes and ears” of Trump’s campaign by tipping Cohen off to negative stories, including Daniels’ claim.

1487.
1488.
1489.
Davidson talked about negotiating the deals and what he said was Cohen’s frustration after the Daniels deal that Trump still hadn’t repaid him. The defense’s big witness was attorney Robert Costello, who testified Monday and Tuesday about negotiating to represent Cohen after the FBI raided Cohen’s properties in 2018.

1490.
1491.
1492.
WHAT IS A CHARGING CONFERENCE?

1493.
1494.
1495.
When court in Donald Trump's hush money trial resumes Tuesday afternoon, attorneys for both sides will return for a charging conference.

1496.
1497.
1498.
The charging conference is an opportunity for prosecutors and the defense to weigh in on how they want the jury to be instructed in the law and what the verdict sheet will look like.

1499.
1500.
1501.
At the conference, the parties may discuss how the charges are organized and the elements of a crime — spelled out in the law — that the prosecution needs to prove beyond a reasonable doubt to achieve a conviction.

1502.
1503.
1504.
They’ll provide the judge with their versions of instructions and the verdict sheet — a form the jury fills out listing each charge and the possible verdicts — but it’ll ultimately be up to Judge Merchan to decide how to instruct the jury.

1505.
1506.
1507.
Jury instructions are a roadmap to the sometimes complex legalities involved in the case. They are not designed to sway the jury one way or another, but rather to ensure that jurors have a good understanding of the charges they’re weighing and the laws involved.

1508.
1509.
1510.
WHERE THINGS STAND NOW

1511.
1512.
1513.
After more than four weeks of testimony, jurors in Donald Trump's hush money trial could begin deliberating as soon as next week to decide whether the former president is guilty of 34 felony counts of falsifying business records.

1514.
1515.
1516.
Trump’s lawyers rested their defense Tuesday morning without him taking the witness stand, moving the case closer to the moment the jury would begin deciding his fate.

1517.
1518.
1519.
After the defense rested, Judge Juan M. Merchan told jurors the court session could run late next Tuesday to accommodate both prosecution and defense summations — the last time the jury will hear from either side.

1520.
1521.
1522.
TRUMP POLITICAL ALLIES TURN OUT IN SHOW OF SUPPORT

1523.
1524.
1525.
A group of Donald Trump's allies that included Republican state leaders, lawmakers, state attorney generals and his son Donald Trump Jr. held a news conference near the courthouse in Manhattan on Tuesday morning.

1526.
1527.
1528.
“We are here because we are friends of Donald Trump, the president of the United States, and when a friend has trouble, friends have his back,” said Texas Lt. Gov. Dan Patrick. “If they can go after the former president of the United States of America, who has the ability and the financial resources to fight back, what happens to the average American?”

1529.
1530.
1531.
U.S. Rep. Troy Nehls of Texas wore a tie with photographs of Trump hugging the American flag patterned on it.

1532.
1533.
1534.
“They don’t want him on the ballot,” Nehls said, before comparing Trump’s ability to draw crowds to the pope. “This is five weeks in a courtroom when he should be out reaching the American people and telling the American people what he would like to do for this country.”

1535.
1536.
1537.
After the news conference, Donald Trump Jr. was asked why his father did not testify.

1538.
1539.
1540.
“There’d be absolutely no reason- no justification to do that whatsoever,” he said. “Everyone sees it for the sham that it is.”

1541.
1542.
1543.
DEMONSTRATORS GATHER IN PARK NEAR COURTHOUSE

1544.
1545.
1546.
As Donald Trump’s allies held a press conference near the Manhattan courthouse where his hush money trial is being held, a small group of demonstrators gathered in a nearby park with things growing heated between pro- and anti-Trump contingents.

1547.
1548.
1549.
Supporters shouted “We love Trump!” and waved American flags and a giant “TRUMP 2024 SAVE AMERICA” flag. Detractors shouted profanities.

1550.
1551.
1552.
Police officers then went into Collect Pond Park, telling them to “figure it out.”

1553.
1554.
1555.
Trump’s entourage has been holding its press conferences in the park in recent days, but the group was often drowned out on Monday by protesters.

1556.
1557.
1558.
TRUMP WILL NOT TESTIFY IN HIS TRIAL

1559.
1560.
1561.
Donald Trump left the courtroom where his criminal trial is taking place without speaking to reporters. He ignored a question about why he wouldn’t testify in the hush money case.

1562.
1563.
1564.
The former president and presumptive GOP presidential nominee previously said he wanted to take the witness stand to defend himself against what he claims are politically motivated charges.

1565.
1566.
1567.
DEFENSE RESTS ITS CASE WITHOUT TRUMP TESTIFYING

1568.
1569.
1570.
The defense in Donald Trump's hush money trial rested its case Tuesday morning without the former president taking the stand in his own defense.

1571.
1572.
1573.
“Your honor, the defense rests,” Trump lawyer Todd Blanche told the judge.

1574.
1575.
1576.
After the defense rested, Judge Juan M. Merchan told jurors they won’t be needed again in court until next Tuesday. That’s when he says both sides will give their closing arguments. He suggested the court session may run late that day to accommodate summations from both sides — the defense and prosecution. Merchan told jurors he then expects his instructions to them will take about an hour, after which they can begin deliberating, possibly as early as next Wednesday.

1577.
1578.
1579.
Merchan noted that normally summations would immediately follow the defense resting its case, but he expects summations in this case will take at least a day and — given the impending Memorial Day holiday — “there’s no way to do all that’s needed to be done” before then.

1580.
1581.
1582.
“I’ll see you in a week,” Merchan said.

1583.
1584.
1585.
CROSS-EXAMINATION OF COSTELLO CONCLUDES

1586.
1587.
1588.
Before finishing her cross-examination Tuesday morning, prosecutor Susan Hoffinger questioned Robert Costello’s true intent in maneuvering to represent Michael Cohen, citing a June 22, 2018, email in which the lawyer complained that Cohen was continuing to “slow play us and the president.”

1589.
1590.
1591.
Costello was in talks with Cohen to represent him in the wake of an April 2018 FBI raid on his apartment, office and hotel room, but Cohen has said he was wary of Costello’s ties to the White House and never hired him.

1592.
1593.
1594.
“Is he totally nuts?” Costello wrote in the email to his law partner, Jeffrey Citron

1595.
1596.
1597.
In the email, he asked what he should say to Cohen, using an expletive. “He’s playing with the most powerful man on the planet,” Costello wrote.

1598.
1599.
1600.
“That email certainly speaks for itself, doesn’t it, Mr. Costello?” Hoffinger asked Costello, mimicking the witness’s earlier answers that emails he turned over to the prosecutors’ office “speak for themselves.”

1601.
1602.
1603.
“Yes, it does,” Costello replied.

1604.
1605.
1606.
Hoffinger then asked if, at that point, Costello had “lost control of Michael Cohen for the president, did you not?”

1607.
1608.
1609.
“Absolutely not,” Costello bristled.

1610.
1611.
1612.
COSTELLO STRAIGHTENS UP ON THE STAND — SLIGHTLY

1613.
1614.
1615.
Defense witness Robert Costello was on Tuesday morning behaving better in the courtroom than he was the previous day when Judge Juan M. Merchan scolded him for speaking out of turn and rolling his eyes.

1616.
1617.
1618.
Still, Costello tried to tack on extra details to his answers to questions from the prosecution.

1619.
1620.
1621.
At one point, Costello told prosecutor Susan Hoffinger that there was additional context around an email regarding Rudy Giuliani, “which I would be delighted to tell you.”

1622.
1623.
1624.
“That’s alright. Let’s move on to the next one,” Hoffinger said.

1625.
1626.
1627.
Moments later, Hoffinger asked Costello if he felt like he was being played by Cohen, as he had written in another email. Costello said he did not.

1628.
1629.
1630.
“You want me to explain it?” Costello asked.

1631.
1632.
1633.
Again, Hoffinger told him that she did not. Costello huffed, adding: “Now you do want me to explain.”

1634.
1635.
1636.
PROSECUTORS CONFRONT COSTELLO WITH EMAILS HE SENT TO MICHAEL COHEN

1637.
1638.
1639.
As testimony in Donald Trump's hush money trial began for the day, prosecutor Susan Hoffinger showed defense witness Robert Costello an August 2018 email in which former Trump attorney Michael Cohen told him and one of his partners to stop contacting him because “you do not and never have represented me” and another lawyer did.

1640.
1641.
1642.
Asked whether he was upset that Cohen hadn’t paid him, Costello said he was — and volunteered that he had replied to the message in an email that prosecutors didn’t show.

1643.
1644.
1645.
Hoffinger went a step further and confronted Costello with emails he sent to Cohen in which he repeatedly dangled his close ties to Trump-ally Rudy Giuliani in the aftermath of the FBI raid on Cohen’s property.

1646.
1647.
1648.
In one email, Costello told Cohen: “Sleep well tonight. You have friends in high places,” and relayed that there were “some very positive comments about you from the White House.”

1649.
1650.
1651.
Costello testified Tuesday that “friends in high places definitely refers to President Trump.”

1652.
1653.
1654.
Hoffinger also showed Costello an email he sent to his law partner noting that Giuliani was joining Trump’s legal team.

1655.
1656.
1657.
“All the more reason for Cohen to hire me, because of my connection to Giuliani, which I mentioned in our meeting,” Costello wrote to law partner Jeffrey Citron in the April 19, 2018, email.

1658.
1659.
1660.
Cohen says he never hired Costello.

1661.
1662.
1663.
WITNESS TESTIMONY SET TO RESUME

1664.
1665.
1666.
Attorney Robert Costello has returned to the witness stand in Donald Trump's hush money trial to resume his testimony. The defense witness turned to Judge Juan M. Merchan and spoke to him briefly as they waited for the jury to file in.

1667.
1668.
1669.
Costello's words were inaudible to reporters. The judge acknowledged him, however, and nodded. The vibe in the courtroom was more cordial than it was during the drama that disrupted proceedings on Monday.

1670.
1671.
1672.
While waiting for the jury, Assistant District Attorney Joshua Steinglass asked the judge to poll jurors on their availability to work next Wednesday, a typical off day for the trial.

1673.
1674.
1675.
According to the judge, closing arguments will be held next Tuesday, the day after Memorial Day, so he may want jurors to work Wednesday to receive instructions in the law or start deliberating.

1676.
1677.
1678.
WHO WILL BE IN COURT WITH TRUMP?

1679.
1680.
1681.
Donald Trump will be joined Tuesday by an entourage including actor Joe Piscopo as well as his eldest son, Donald Trump Jr., former acting attorney general Matt Whitaker and former Florida attorney general Pam Bondi, according to his campaign.

1682.
1683.
1684.
He’ll also be accompanied by members of Congress including Sen. Eric Schmitt and Reps. Ronny Jackson, Troy Nehls and Maria Salazar.

1685.
1686.
1687.
RULING ON MOTION TO DISMISS WAITING IN THE WINGS

1688.
1689.
1690.
As witness testimony resumes in Donald Trump's criminal trial on Tuesday, a ruling on the defense's motion to dismiss the case is waiting in the wings.

1691.
1692.
1693.
Defense attorneys asked Judge Juan M. Merchan to dismiss the case on Monday after court adjourned for the day, arguing that prosecutors had failed to prove their case and there was no evidence of falsified business records or an intent to defraud.

1694.
1695.
1696.
Prosecutor Matthew Colangelo shot back that “the trial evidence overwhelmingly supports each element” of the alleged offenses, and the case should proceed to the jury.

1697.
1698.
1699.
Colangelo argued that the jury has seen “overwhelming” evidence that the records of the payments to Michael Cohen were falsely categorized as payments for legal services instead of reimbursement and that there was ample evidence that the alleged fudging was done to deceive people — including the voting public and government regulators.

1700.
1701.
1702.
Merchan did not indicate when exactly he would make a decision on the motion.
